The company should establish procedures for the implementation of corrective action, including measures intended to prevent recurrence. Objective evidence indicates the Company has failed to ensure nonconformities are rectified. IMO detentions dated 13 Feb 2025 and 24 July 2025 identified deficiencies, and follow-up ISM audits identified nonconformities, that continue to persist. Further examination today revealed additional objective evidence of an inability to implement an effective Safety Management System. 74 SOLAS (24) IX/3.1 - ISM Code 9.2

Every oil fuel pipe shall be fitted with a cock or valve directly on the tank capable of being closed from a safe position outside the space. Quick closing valves to numerous storage tanks and daily service tanks in groups 1, 2, 3, 4, 6, 7, 8, and 9 failed to close associated valves. 74 SOLAS (97) II-2/15.2.5

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCOs observed fuel oil leaks on the fuel injector drains associated with cylinders 3, 5, 8, 9, 10, and 12. 74 SOLAS (24) I/11

Before the ship leaves port and at all times during the voyage, all lifesaving appliances shall be in working order and ready for immediate use. Rescue boat failed to engage into forward gear. 74 SOLAS (01) III/20.2

The ring, lines and letters shall be permanently marked on the sides of the ship. Deck line on starboard side is not permanently marked. ILLC66 Annex I Reg. 8

The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The technical and/or operational nature of the deficiencies noted in deficiency 2,4,and 5 below provide objective evidence of a serious failure of the implementation of the ISM Code. An external audit report satisfactory to the OCMI must be submitted prior to clearance of this deficiency. 74SOLAS(24) IX/3.1 ISM Code 10.1

Every oil fuel pipe, which, if damaged, would allow oil to escape from a storage, settling or daily service tank situated above the double bottom, shall be fitted with a cock or valve directly on the tank capable of being closed from a safe position outside the space concerned in the event of a fire occurring in the space in which such tanks are situated. PSCO observed eight of the ten hydraulic reservoirs for activating the vessel's quick closing valves did not have the required amount of hydraulic fluid. Upon testing points 1,2, & 9 the crew was unable to activate the quick closing valves in a timely manner. A review of the vessel's maintenance history shows the maintenance for the system was listed as "good" on work done date, 21 June 2025. Vessel's crew refilled reservoir which drained themselves again within two hours. 74SOLAS(97) II-2/15.2.5

In addition to the requirements contained elsewhere in the present regulations, ships shall be designed, constructed and maintained in compliance with the structural, mechanical and electrical requirements of a classification society which is recognized by the Administration. PSCO observed main engine electronic governor system panel being artificially cooled by auxiliary fan. 74SOLAS(04) II-1/3-1

Four sets of full protective clothing resistant to chemical attack shall be provided in addition to the fireman's outfits required by regulation 10.10 and shall be selected taking into account the hazards associated with the chemicals being transported and the standards developed by the organization according to the class and physical state. The protective clothing shall cover all skin, so that no part of the body is unprotected. PSCO noted that all four chemical protective clothing suits had severely dry-rotted rubber seals on either the neck or wrist, making the suits ineffective in a chemical emergency. A review of the vessel's monthly checks revealed that the crew inspected the suits, but these checks did not report the observed condition. 74SOLAS(2024) II-2/19.3.6

Each enclosed space entry and rescue drill shall include checking and use of instruments for measuring the atmosphere in enclosed spaces. PSCO observed that the vessel's three gas meters were overdue for annual shore calibration. A review of the vessel's SMS showed worked done date 04 June 2025 as "good" despite being overdue on this date. 74SOLAS(24) III/19.3.6.2.3

For all ships the means for embarkation shall be inspected and maintained in a suitable condition. PSCO observed a that at the top of the gangway where the gangway connects to the ship, the bolts were missing their washers and were in danger of pulling through the connection. 74SOLAS(2024) II-1/3-9.3

Fire protection systems shall be maintained and ready for use. The ships fire detection system was found to be inoperable in at least five (05) zones including: CO2 room, emergency generator room, fuel/purifier separator room, workshop and Main Diesel Generator (MDG) spaces (port and starboard). Available SMS records indicates that at least some faults were present since January 5th. There was no record that flag/class was informed until the day of, and just prior to, the PSC exam, at which point a dispensation was issued. SOLAS(2004 Cons) II-2/14.1.1 30 a/c

A secondary starting source of energy shall be provided for the emergency generator. The hydraulic accumulator for the EDG was inoperable. While SMS records demonstrate the ship reported the issue to the company on January 13, 2025, there was no objective evidence that the failure was reported to class or flag until yesterday (12 Feb 2025) when a dispensation was issued one day prior to USCG exam. Hydraulic steering gears shall be provided with audible/visual alarms on the navigation bridge to indicate a leak or loss of hydraulic fluid. These alarms were not fitted on the ships navigation bridge. SOLAS(2004 Cons) II-1/29.12.2 17a/c

The Company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the Company. Objective evidence indicates that the company has failed to report various deficiencies to the Administration or the Recognized Organization and failed to take appropriate corrective actions in a timely fashion resulting in repeated failures, particulary of the ships' alarm systems. An external safety management audit shall be carried out by the Administration or the RO prior to the ship being released from detention. SOLAS(2020 Cons) IX/3.1 & ISM 10.1 30 a/c

A clear view from navigation bridge windows shall be provided at all times. The bridge has two windows that each have spiderweb cracking over ~4ft of glass panes. Interviews of onboard deck officers indicates that the windows have been broken for at least five months and no records could be found that the ship or the company had made any attempts to repair. The Oil Record Book Part I shall be completed on each occasion, on a tank-to-tank basis if appropriate, whenever any of the following machinery space operations take place in the ship: bunkering of fuel or bulk lubricating oil. PSCO's observed Bunker Delivery Notes dated that was not entered into the Oil Record Book. Cite: MARPOL Annex I Reg. 17.2.5 Code: 10c

0635: MANUAL BRAKES SHALL BE ARRANGED SO THAT THE BRAKE IS ALWAYS APPLIED UNLESS THE OPERATOR, EITHER ON DECK OR IN THE SURVIVAL CRAFT, HOLDS THE BRAKE CONTROL IN THE "OFF" POSITION. THE PSCO NOTED DURING THE LOWERING OF THE PORT LIFE BOAT THAT THE BRAKE REMAINED OFF WHEN THE OPERATOR LET GO. 74 SOLAS(97) III/48.2.10
