THE OPERATION OF A VESSEL WITH A CAPACITY OF 250 OR MORE BARRELS OF OIL, HAZARDOUS MATERIAL, OR LIQUIFIED GAS AS REGULATED IN TABLE 4 OF 46CFR PART 154 SHALL PROVIDE TRANSFER PROCEDURES THAT MEET THE REQUIREMENTS OF THIS PART AND PART 156 OF THIS CHAPTER FOR TRANSFERRING FROM TANK TO TANK WITHIN THE VESSEL. VESSEL WAS UNABLE TO PROVIDE TRANSFER PROCEDURES TO VESSEL PERSONNEL. 33 CFR 155.720(b)

THE VESSEL OPERATOR OF EACH VESSEL REQUIRED BY 33 CFR 155.720 TO HAVE TRANSFER PROCEDURES SHALL MAINTAIN THEM CURRENT AND SHALL REQUIRE VESSEL PERSONNEL TO USE THE TRANSFER PROCEDURES FOR EACH TRANSFER OPERATION. VESSEL PIC WAS FOUND NOT USING TRANSFER PROCEDURES DURING TRANSFER. 33 CFR 155.730

EACH PERSON IN CHARGE REQUIRED BY PARAGRAPH (5) OF THIS SECTION IS AT THE SITE OF THE TRANSFER OPERATION AND IMMEDIATELY AVAILABLE TO THE TRANSFER PERSONNEL. PIC WAS FOUND NOT IMMEDIATELY AVAILABLE OR ON SITE DURING PART OF THE TRANSFER. DIRECTLY RESULTING IN TANK OVERFILL. 33 CFR 156.120(t)(1)

THE COMPANY AND THE SHIP SHALL COMPLY WITH THE REQUIREMENTS OF THE INTERNATIONAL SAFETY MANAGEMENT CODE. FOR THE PURPOSE OF THIS REGULATION THE REQUIREMENTS OF THE CODE SHALL BE TREATED AS MANDATORY. IN ORDER TO PROPERLY MANAGE EFFICIENTLY A TOP PRIORITY IS TO IDENTIFY TRAINING NEEDS AMONGST VESSEL PERSONNEL. VESSEL BASED STAFF IS TO HAVE IN HOUSE TRAINING THAT WILL BE CONDUCTED ON BOARD THE VESSEL USING THE SMS. PSCO IDENTIFIED A LACK OF TRAINING RESOURCES IN RELATION TO TRANSFER PROCEDURES AND PIC DUTIES. INTERNAL ISM SMS AUDIT REQUIRED. SOLAS 74 (2020) IX/3.1 ISM CODE 6.3 SMS/6.5

Each liferaft or group of liferafts shall be stowed witha float-free arrangement so that each floats free and if inflatable, automatically inflates when the ship sinks. Six life rafts were installed without painters attached to the weak link. 74SOLAS(14) Ch. III Reg 13.4.2

The fire resistance of doors shall, as far as practicable, be equivalent to that of the division to which they are fitted. EDG/CO2 space door to AC room was wasted at bottom and had no gasket/seal between the spaces. 74 SOLAS (97) Ch. II-2 Reg 47.1

Machinery space openings in position shall be properly framed and efficiently enclosed by steel casings of ample strength, and where the casings are not protected by other structures, their strength shall be specially considered. Access openings in such casings shall be fitted with doors complying with the requirements of regulation 12(1). WTD into E/R gasket was found to not seal and port Z-drive WTD was missing dog and did not seal properly. ICLL Ch. I Reg 17(1)

Ships shall follow the basic principles underlined in the 74SOLAS(97) Ch. II-2 having regard to the potential fire hazard involved: restricted use of combustible mate Aux. machinery space bilges had excessive amounts of oil soaked absorbent mats, the E/R bilges were found to be soaked with oil-residue. Remove excessive oil. 74 SOLAS(97) Ch. II-2 Reg 2.2.5

Ladders shall be arranged to provide ready means of escape. The escape hatch from the E/R on the main deck was not labeled & not readily identifiable for immediate use. 74SOLAS(97) Ch. II-2 Reg 28.1

Fire-fighting systems & appliances shall be kept in good working order & readily available for immediate use. The remote fuel shut off valves on the main deck weren't labeled & the "T" rod for actuating the valves was not immediately available. 74SOLAS(14) Ch. II-2 Reg 14

Ships of 300 GT & greater must have a fixed containment under each fuel or oil tank vent. 3S fuel oil tank and waste oil tank vent containments were missing mechanical plugs. 33CFR155.320

A clear view through at least two of the navigation bridge windows shall be provided at all times, regardless of weather conditions. All Pilot house window wipers were in poor condition & were in need of maintenance/replacement. 74SOLAS(14) Ch. V Reg 22.9.9.4

Stbd tailshaft in the Z-drive room was found to have gease seal on the aft line shaft bearing loose and making improper noise when in operation. 74SOLAS(14) Ch. 1 Reg 11(a)

Electrical installations shall be such that the the crew and ship shall be protected against electrical hazards. Electrical components, wiring and penetrations found in disrepair in following locations: stbd Z-drive room doors, overhead of the upper stairwell landing for entry into E/R from main deck, cable gland at bottom of hydraulic motor controller located above shore connection box stbd side of E/R, emergency steering station had exposed electrical components, shore power box on stbd side of E/R cover was missing and improper wire connections, stbd main pyrometer junction box was missing covering, knife switches for the battery banks A and B, located on the port side of the aux. machinery space were tied closed, and both the SSDG's and crane generator battery boxes had damaged ventilation tubes so as to allow ingress of water/fluids. 74SOLAS(04) Ch. II-1 Reg 40.1.3

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in a normal manner. Main switchboard ground detection indicated large ground. 74SOLAS(04) Ch. II-1 Reg 45.1.3

The termination of sounding pipes are to be fitted with self-closing blanking devices and with self-closing control cock located below the blanking device for the purpose of ascertaining before the blanking device is opened so that oil fuel is not present. Provisions shall be made so as to ensure that any spillage of oil fuel through the control cock involves no ignition hazard. Sounding tubes, located in the engine room just fwd of the SSDG's, were found to have their self-closing devices tied open and missing plugs.

The company must establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations with any additional requirements which may be established by the company. In meeting these requirements, the company must ensure that inspections are held at appropriate intervals, any non-conformity is reported, with its possible cause, appropriate corrective action is taken, and records of these activities are maintained. The inspections must be integrated into the ship's operational maintenance routine. The company shall conduct an internal audit of the ship's Safety Management System to ensure that the requirements of the ISM Code Clause 10 are properly implemented & shall provide a report to Marine Safety Unit Port [name withheld] Vessel Inspection Division and the responsible Recognized Organization issuing the vessel's Safety Management Certificate on behalf of the Coast Guard.
