Vessel received amended COI allowing for 33 passengers and 02 crew. Vessel is not to carry more than current lifesaving capacity of 30 persons until additional IBA is installed to the satisfaction of a Marine Inspector.

All fuel tanks shall be bonded to the common ground. Starboard fuel tank bonding connection tab was completely corroded and disconnected from fuel tank. Tank is not bonded to the common ground. Clean bonding tab area and reconnect bonding wire to the satisfaction of a Marine Inspector. 46 CFR 182.20-25(b)(4)

A vessel must comply with the applicable requirements for any radio and EPIRB installations, including the requirements for a station license and installation certificates to be issued by the FCC, as set forth in 47 CFR part 80. Provide valid Safety Radio Certificate and Station License for VHF/MF/EPIRB installation. Restricted to not more than 1,000 feet from shore until rectified. 46 CFR 184.502

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved IAW 161.012 in subchapter Q of this chapter. 03 child lifejackets did not have lights. 46 CFR 180.75(a)

All electrical installations shall be to the satisfaction of the [name withheld] space lighting is inadequate. When lights are energized, there is no visibility of critical areas such as shaft seals, gauges, and fuel valve alignment. Provide adequate lighting to the satisfaction of a Marine Inspector. 46 CFR 183.01-15(a)

Each entrance to a space storing CO2 cylinders must be conspicuously marked as follows: “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. VENTILATE THE AREA BEFORE ENTERING. A HIGH CONCENTRATION CAN OCCUR IN THIS AREA AND CAUSE SUFFOCATION.” The battery room, which contains the CO2 cylinder for machinery space protection, does not have the above warning sign. Place sign to the satisfaction of a Marine Inspector. 46 CFR 185.612(g)(1)

The Rules concerning shapes shall be complied with by day. Vessel is required to carry shapes for signaling purposes for restricted in ability to maneuver (ball, diamond, ball) as vessel is over 12 meters in length. Provide day shapes to satisfaction of a Marine Inspector. 33 CFR 83.20(d)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: U.S. Coast Pilot and Coast Guard Light List. Vessel did not have the required publications onboard. 46 CFR 184.420(a)

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other than small buoyancy compartments,under all practical conditions. Vessels bilge pump started to smoke during operation. Vessel to repair pump to the satisfaction of the attending marine inspector. 46 CFR 182.25-1(a) Old T

At each initial and subsequent inspection for certification, the owner or managing operator must be prepared to vhave the vessel ready for inspection of each portable fire extinguisher, semi-portable fire extinguisher, and fixed gas fire extinguishing system to check for excessive corrosion and general condition. Vessel has two portable extinguishers that need to be serviced. Vessel to service extinguishers to the satisfaction of the attending marine inspector.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Dead end wires found in battery compartment and lazerette. Vessel to remove or cap wires to the satisfaction of the attending marine inspector.

Vapor barriers must be provided where insulation of any type is used in spaces where flammable and combustible liquids or vapors are present, such as machinery spaces and paint lockers. Vessel has cable transit from lazerette to the engine room that is not vapor tight. Vessel to make cable transit vapor tight to the satisfaction of the attending marine inspector.

On a vessel of at least 7.9 meters (26 feet) in length, a visual and audible alarm must be provided at the operating station to indicate a high water level. Indicator in lazerette is not giving a visual alarm at the operating station. Vessel to fix visual alarm to the satisfaction of the attending marine inspector.

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other than small buoyancy compartments, under practical conditions. FWD void bilge pump pick up inoperable and battery void bilge pump pick up missing. Vessel to repair FWD void bilge pick up and install pick up in battery void space to the satisfaction of the attending marine inspector. 46 CFR 182.25-1(a) “Old T”

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved in accordance with § 161.012 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.112. Each life jacket light must be securely attached to the front shoulder area of the life jacket. 05 life jacket lights inoperable. Vessel to replace or repair inop lights to the satisfaction of the attending marine inspector.

The person in command of a documented vessel must have on board the original Certificate of Documentation currently in effect for that vessel. Vessel's certificate of documentation is expired. Vessel to obtain new Certificate of Documentation to the satisfaction of the attending marine inspector.

A vessel on an oceans, coastwise, limited coastwise, or Great Lakes route must carry six hand red flare distress signals and six hand orange smoke distress signals. Vessels has only 4 red flares. Vessel to obtain flares to the satisfaction of the attending marine inspector.

The master shall conduct sufficient fire drills to make sure that each crew member is familiar with his or her duties in case of a fire. There are no fire drills being conducted. Vessel to conduct drills and log them to the satisfaction of the attending marine inspector.

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons who have fallen overboard. There are no abandon ship or man overboard drills being conducted. Vessel to conduct drills and log them to the satisfaction of the attending marine inspector.

For a vessel described by 46 CFR 175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include, but need not be limited to— (1) Training in the use and location of firefighting equipment and general firefighting knowledge, including: (i) Location of firefighting appliances and emergency escape routes; (ii) Types and sources of ignition; (iii) Flammable materials, fire hazards and spread of fire; (iv) The need for constant vigilance; (v) Actions to be taken on board; (vi) Fire and smoke detection and automatic systems on board; and (vii) Classification of fire and applicable extinguishing agents. (2) The drills required by § 185.524, including fire location and fire type; and (3) Emergency egress training for each member of the crew, to occur for all members of the crew— (i) At least monthly while such members are employed on board the vessels; and (ii) Each time a crew member joins the crew of such vessel. Vessel is certified for oceans route. Operator has not been conducting quarterly training or monthly egress training despite being informed on the requirements during the last inspection. Vessel to conduct and log training to the satisfaction of the attending marine inspector.

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. Lithium plan for charging of devices is not being followed. Vessel to follow plans for lithium charging to the satisfaction of the attending marine inspector.

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The first aid kit onboard is expired. Vessel to replace expired meds or obtain new first aid kit to the satisfaction of the attending marine inspector.

The alcohol testing of each individual must be conducted within 2 hours of when the SMI occurred, unless precluded by safety concerns directly related to the incident. The alcohol testing strips onboard the vessel are expired. Vessel to obtain new testing strips to the satisfaction of the attending marine inspector. Vessel is limited to 2 hours from the nearest testing facility. 46 CFR 4.06-3 "Old T"

A power-driven vessel underway shall exhibit a sternlight. Stern light is inoperable. Vessel to repair or replace stern light to the satisfaction of the attending marine inspector. Vessel limited to daytime and/or unlimited visibility operations until repaired.

Batteries must be mounted in trays lined with, or constructed of, a material that is resistant to damage by the electrolyte. Vessel’s batteries are mounted without trays. Vessel to mount batteries in trays to the satisfaction of the attending marine inspector.

Unless other means are provided to ensure that a potential waste receptacle fire would be limited to the receptacle, waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom. Vessel has plastic trash can on board. Vessel to remove and replace trash can with appropriate material to the satisfaction of the attending marine inspector.

The master of the vessel shall ensure that the EPIRB's battery is replaced after it is used, or before the date required by FCC regulations in 47 CFR part 80, whichever comes sooner. Vessels EPIRB battery has expired. Vessel to replace EPIRB battery to the satisfaction of the attending marine inspector. Vessel is limited to 3 nautical miles from shore.

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. Vessel’s EPIRB registration is expired. Vessel to register EPIRB and replace EPIRB sticker to the satisfaction of the attending marine inspector. Vessel is limited to 3 nautical miles from shore.

The Coast Guard will issue a medical certificate to a mariner meeting the medical and physical standards for merchant mariners. The medical certificate will be issued for various periods of time based upon the endorsements the mariner holds. The master does not have a medical certificate. Master to obtain and show proof of medical certificate to the satisfaction of the attending marine inspector.

Each EPIRB must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative and shall be logged or otherwise documented, as applicable. Vessel has not continuously logged EPIRB testing monthly. Vessel to log monthly EPIRB testing to the satisfaction of the attending marine inspector.

Battery chargers must have an ammeter connected in the charging circuit. Vessel does not have an ammeter connected in the circuit causing the batteries to hiss. Vessel to install an ammeter prior to next credited drydock to the satisfaction of the attending marine inspector.

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) must comply with this part. Vessel’s battery charger is temporarily installed through a wall outlet. Vessel to submit plans to the OCMI for approval and, once approved, install battery charger prior to next credited drydock to the satisfaction of the attending marine inspector.

Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Vessel does not have installed detectors in required spaces by 27Dec2022. Vessel has been limited to a Limited Coastwise route until detector installation has been verified by a Marine Inspector. 46 CFR 181.405(c)

The method of opening a means of escape must be obvious, rapid, and of adequate strength. The means of opening the door to the secondary means of escape on the port forward section of the structure does not open easily.

Provision shall be made by means of plugs, covers, etc., to prevent the admission of air into the space protected. There are no means to prevent the admission of air into the engine room through the engine air intake openings. 46 CFR 181.20-35(a)“Old T”

Each opening in the collision bulkhead must have a watertight closure. The opening in the collision bulkhead is not watertight. 46 CFR 171.085(g)(2)“Old T”

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (21 2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. There are no fire buckets on board.

Batteries shall be effectively screened by a cage or similar structure to minimize the danger of accidental spark through dropping a metal object across terminals. There was no covers to protect the exposed battery terminals from accidentally sparking. 46 CFR 183.05-20(a) “Old T”

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: Spaces protected by carbon dioxide - “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. WHEN ALARM OPERATES OR WINTERGREEN SCENT IS DETECTED, DO NOT ENTER UNTIL VENTILATED. LOCK OUT SYSTEM WHEN SERVICING.” The reference to wintergreen scent may be omitted for carbon dioxide systems not required to have odorizing units and not equipped with such units. Entrance to the engine room was not marked as a space protected by a carbon dioxide system.

Batteries shall be secured against shifting with motion of the boat. Batteries were not strapped down to prevent shifting. 46 CFR 183.05-20 (b)“Old T”

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency. There were no records for crew training for emergencies.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. There are no alcohol testing devices on board the vessel.

The master of the vessel shall ensure that each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. There are no records of testing the EPIRB.

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. The master did not have a Federal Communications Commission Marine Radio Operator Permit.

Each collision bulkhead must extend to the weather deck. There were openings on the outboard sections of the collision bulkhead that did not extend to the weather deck. To be rectified at their next drydock by 31MAR2023. 46 CFR 171.085(h)(1) “Old T”

Through hull fittings and shutoff valves shall be metal. There were various plastic through hull fittings installed throughout the vessel. To be rectified at their next drydock by 31MAR2023. 46 CFR 182.40-1(a)(3) “Old T”

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Deckhand has not completed a pre-employment drug test

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. The doors constructed as a means of escape are not as originally designed, reducing the designed space of the opening. To be rectified at their next drydock by 31MAR2023

A space containing propulsion machinery must be equipped with a fire detection & alarm. E/R heat detector did not activate upon testing at the alarm. Repair/replace.
