Portable and semi-portable extinguishers must be inspected and maintained in accordance with NFPA 10. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility must perform the required inspections, maintenance procedures, and hydrostatic pressure tests. Provide a servicing certificate, and a servicing report detailing what type of service and tests were conducted on the pre-engineerd CO2 gas fire extinguishing system. 46 CFR 176.810

Fire fighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information:(1) Date of the drill and training; and(2) General description of the drill scenario and training topics. Drills are not being recorded in the log following the above format as required above. 46 CFR 185.524

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date:(1) Charts of large enough scale to make safe navigation possible;(2) U.S. Coast Pilot or similar publication;(3) Coast Guard Light List;(4) Tide tables; and(5) Current tables, or a river current publication issued by the U.S. Army Corps of Engineers or a river authority.(b) Extracts from the publications listed above for the areas to be transited may be provided instead of the complete publication. Vessel is missing tide tables, current tables, light list and coast pilot publications. 46 CFR 184.420

An Employment Assiatnce Program (EAP) training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Provide evidence of training for owner/captain (Supervisory), and crewmembers (non-supervisory), and provide evidence of training to the USCG. 46 CFR 16.401

Piping, including valves, pipe fittings and flanges, the temperature of which exceeds 150 degrees Fahrenheit must be suitably insulated where necessary to prevent injuries. The lagging on the exhaust hose on the port side engine was severely deteriorated and no longer maintained its original integrity. Replace the lagging to the satisfaction of the marine inspector.

Boundaries that separate machinery spaces from accommodation spaces, service spaces, and control spaces must be lined with noncombustible panels or insulation approved in accordance with § 164.009 in subchapter Q of this chapter. The insulation in generator compartment and both the port and starboard side engine compartments had missing pieces of insulation. Replace the insulation in the three compartments to the satisfaction of the marine inspector.

A hatch exposed to the weather must be watertight. All the hatches on the main deck allowed water to ingress due to gaps on the gaskets. Replace all of the gaskets on all of the hatches to the satisfaction of the attending marine inspector.

Each ring life buoy on a vessel must:(1) Be approved in accordance with § 160.050 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.150. Grab line found deteriorated and broke when inspecting.

A visual indicator must be provided at the operating station to indicate when any automatic bilge pump is operating. Visual indicator inoperable at lower control station.

The master of the vessel shall ensure that:(a) Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative;(b) The EPIRB's battery is replaced after it is used, or before the date required by FCC regulations in 47 CFR part 80, whichever comes sooner; and(c) The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. Captain did not have monthly test logged.

46 CFR 181.420 (a) (3) The installed fixed fire system did not secure the port engine when testing.

46 CFR 182.530 (a) On a vessel of at least 7.9 meters (26 feet) in length, a visual and audible alarm most be provided at the operating station to indicate high water level. The port aft bile alarm failed to operate at the fly bridge; fly bridge is lacking visual alarm.

46 CFR 184.402 Except as otherwise provided in this section every vessel must be fitted with a suitable magnetic compass designed for marine use, to be mounted at the primary operating station. Compass is difficult to read due to uv damage.

46 cfr 183.200 electrical equipment on a vessel must be installed and maintained to: (a) Provide services necessary for safety under normal and emergency conditions.

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have a means to reset devices used to automatically shut down ventilation systems and engines as required. The pre-engineered fixed gas system was unable to be reset at the operating station after manually activating the shut down inside the machinery space.

Shutoff valves must be fitted in the fuel supply lines and installed so as to close against the fuel flow and must be manually operable from outside the compartment. The starboard emergency fuel shutoff valve was unable to be closed due to a cable restriction inside the machinery space.

A visual and audible alarm must be provided at the operating station to indicate a high water level. The visual indicator for the port mid bilge high water level alarm was not operational.

Each item of survival craft equipment must be of good quality and efficient for the purpose it is intended to serve. Lifefloat painters must meet the following specifications: (i) The painter must be at least 100 feet in length, but not less than 3 times the distance between the deck where the life float or buoyant apparatus it serves is stowed and the lowest load waterline of the vessel; (ii) Have a breaking strength of at least 1,500 pounds; (iii) Be of a dark color if synthetic, or of a type certified to be resistant to deterioration from ultraviolet light; and (iv) Be stowed in such a way that it runs out freely when the life float floats away from a sinking vessel. The painter currently attached to the lifefloat must be replaced due to UV light deterioration.

On each container for life jackets, the number and identification of the items stowed inside, and their sizes, must be marked in clearly legible letters and numbers at least 2 inches high. The stowage containers for the adult and child life jackets must be marked in accordance with the regulations.

Marine employers must ensure that they and their crew members meet the requirements of a drug and alcohol detection program. Employers are responsible for all the actions of their officials, representatives in carrying out the requirements of a drug and alcohol program in all its parts and requirements. Vessel licensed captain failed upon asking to demonstrate knowledge and proficiency in: a. implementation and required testing time frame following a marine casualty, b. implementation of an Employment Assistance Program, c. not able to mention an approved testing facility as designated by its maritime consortium. d. did not have available any means to conduct an alcohol testing device following a marine casualty, e. failed in provide evidence of drug and alcohol training conducted for both supervisory and nonsupervisory personnel. 46CFR16.203

Survival craft must be in good quality, and efficient for the purpose of it is intended to serve. Lifefloat was found to have fractures and large areas of exiting repairs. Replace exiting with a USCG approve lifefloat. 46 CFR180.175

Each portable fire extinguisher on board a vessel must be of an approved type. Vessel was found to have two plastic made, 10-B:C portable fire extinguishers that were passed due their 6 years manufacturing date and were found to be still in service on board the vessel in accordance with NFPA code, incorporated by reference. Replace with new and USCG/NFPA approved portable fire extinguishers. 46 CFR 181.500/ NFPA 10.

A vessel must carry either a first-aid kit approved under the approval series 160.041 or a kit with equivalent contents in a suitable watertight container marked "First-Aid Kit". Vessel was found to have missing and expired items that required. Provide an approved type first-aid kit. 46 CFR184.710.

A vessel must carry adequate and up-to-date: updated nautical chart, Coast pilot, light list, tide and current tables. Extracts from these publications for the area to be transited may be provided instead of the complete publication. Vessel existing publication on board were either missing or dated on YR2017. Provide up-to-date publications or extracts as required by CFR. 46CFR1084.420.

EPIRB must be tested monthly and test shall be logged or otherwise documented. USCG Marine Inspector found that the EPIRB is not being tested monthly and test not being logged. Conduct an EPIRB testing each month and log it for the satisfaction of USCG Marine Inspector. 46 CFR185.728

Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. The training entry shall include date of training, a general description of the training topics. Exiting crew drill and training logged was found not to have current dates, and several entries were found to have dates for Yrs 2007, and 2008. Provide a current drills and training log, and carry out training in accordance with the CFR. 46CFR185.420 (c).

Gauges to indicate lubrication oil pressure must be provided for all propulsion engines. The lubrication oil pressure located in the lower operating station for the starboard side main diesel engine was found not operable. Demonstrate proper operation of oil pressure gauge. 46CFR182.410(b)

Master shall keep a correct and written passenger count and shall be available to USCG upon request. No passenger count was being kept documented and not provided, Conduct passenger count as required by CFR. 46CFR185.504.

Fire fighting and man over board drills shall be logged or documented for review of the USCG upon request. The drill shall include date of drill and general description of scenario. Conduct drills and provide drill logs for the satisfaction of USCG. 46CFR185.524

A visual an audible alarm must be provided at the operating station to indicate high water bilge level. The bilge audio alarm was inoperable in both starboard side steering compartment and port side forward compartment. Prove proper operation of these audible alarms. 46CFR185.530.

Vessel must be equipped with at least two operable portable battery lights. One must be located at the operating station and the other at the access to the propulsion machinery. One portable light was inoperable and none of the portable lights were found installed in accordance with the regulation. 46CFR183.430.

A hatch exposed to the weather must be watertight and be attached to the hatch frame or coaming by hinges, captive chains or other devices of strength to prevent its loss. Both port & stbd hatches aren't secured. Properly secure hatches according with requirements. 46 CFR179.360.

Vessels of more than 26 feet but not more than 65 feet must carry a minimum of one life ring of not less than 24 inches in diameter. Life ring on board was found deteriorated. Replace the life ring in accordance with the regulation. 46CFR180.70(2).

Placard containing instructions for the donning and use of life jackets must be posted. Current placard displays a different life jacket model ([name withheld]), different from the ones carried on board. Replace current donning placard with the model currently being carried on board. 46CFR185.516.

At each inspection for certification and at every other inspection, bilges and other spaces may be examined to see that there is no excess of oil, debris, trash or other matter that might create a fire hazard. A large plastic combustible storage bin and a diesel plastic gasoline portable tank were found in the engine room. Remove all combustible materials to prevent fire risks.46CFR176.840.

Provisions must be made for closing all supply duct cowls or scoops and exhaust discharge openings for a space protected by a fixed gas extinguishing system. All closure devices must be readily available and mounted in the vicinity of the vent. Provide a means easily deployable to close both port & starboard ventilation cowls that is efficient in preventing the exchange of air upon actuation of the pre-engineered fixed fire extinguishing system. 46CFR182.465 (h).

All around light means a light showing an unbroken light over an arc of the horizon of 360. Current all around light is installed underneath the flying bridge operating station and incapable of being seen from vessel navigating in the vicinity. All around light must be relocated in a visible location as required by regulation and navigation rules. Vessel is limited to daylight operations only, until deficiency is corrected. 33CFR83.21/83.23/84.03.

Stern light means a white light placed as nearly as practicable at the stern showing an unbroken light over an arc of the horizon of 135 degrees and so fixed as to show the light 67.5 degrees from right aft on each side of the vessel. The stern light is located close to mid ship and underneath the operating station, close to the all around light. 33CFR83.21/84.03.

The rules concerning shapes shall be complied with by day. Vessel was found not having the following day shapes: a. one diamond shape; b. one ball shape. 33CFR83.20.

1.Each ring life buoy must be marked with Type II retroflective material. The ring life buoy needs to have suitable type II retroflective tape IAW 46 CFR 185.604.

2.Each pendant for buoyant apparatus must be secured by not more than two turns of twine. Pendants are currently sectured by zip ties.

A vessel must comply with applicable requirements for radio installations as set forth in 47 CFR 80. Vessel must have a radio telephony certificate, must connect GPS to VHF Radio and must enter MMSI Number in VHF Radio.

Operator must secure MSD in a manner which prevents discharge of treated or untreated sewage. Vessel must secure sewage overboard discharge valve.

A vessel on a Limited Coastwise Route must have 6 hand red flares and six orange smoke signals or any combination thereof. Vessel only has on board 8 red hand distress signals. Provide either 4 additional red hand flares or 4 orange smoke signals.

General purpose resin may be used instead of fire retardant resin if non-combustible panels/insulation is installed in machinery space boundaries with accommodation spaces. Stbd side machinery space does not have non-combustible insulation installed. Install by next dry dock.
