THE SECRETARY MAY ORDER ANY VESSEL, IN A PORT OR PLACE SUBJECT TO THE JURISDICTION OF THE UNITED STATES OR IN THE NAVIGABLE WATERS OF THE UNITED STATES, TO OPERATE OR ANCHOR IN A MANNER THE SECRETARY DIRECTS IF - BY REASON OF WEATHER, VISIBILITY, SEA CONDITIONS, PORT CONGESTION, OTHER HAZARDOUS CIRCUMSTANCES, OR THE CONDITION OF SUCH VESSEL, THE SECRETARY IS SATISFIED SUCH DIRECTION IS JUSTIFIED IN THE INTEREST OF SAFETY. SHIPS SHALL HAVE ON BOARD FOOD AND WATER SUPPLIES WHICH, HAVING REGARD TO THE SIZE OF THE CREW AND THE DURATION AND NATUAE OF THE VOYAGE, ARE SUITABLE IN RESPECT OF QUANTITY, NUTRITIVE VALUE, QUALITY AND VARIETY. PSCO OBSERVED SPOILED FOOD IN THE MEAT AND FISH STORES, AND THE VEGETABLE STORES WERE EMPTY. PWSA, 46 USC 70002 (3) ILO-147 (PG.30 - PARA 2)

Fire protection systems and fire-fighting systems and appliances shall be maintained ready for use. PSCO observed the smoke detector above the ships service generators disconnected from the mounting and covered with a shirt. 74 SOLAS (14) II-2/14.1.1

Electrical installations shall be such that the safety of passengers, crew and ship from electrical hazards will be ensured. PSCO observed water dripping from light and wire fixtures in the accommodation area. 74 SOLAS (04) II-1/40.1.3

THE MASTER, OWNER, OPERATOR OR PERSON IN CHARGE OF ANY VESSEL EQUIPPED WITH BALLAST WATER TANKS THAT OPERATES IN THE WATERS OF THE UNITED STATES MUST REMOVE FOULING ORGANISMS FROM THE VESSELS HULL ON A REGULAR BASIS ANO DISPOSE OF ANY REMOVED SUBSTANCES IN ACCORDANCE WITH LUCIL, STATE, AND FEDERAL REGULATIONS. PSCO OBSERVED EXCESSIVE GROWTH OF FOULING ORGANISMS ON BOTH PORT AND STARBOARD SIDE OF VESSEL'S HULL, AS WELL AS ON THE STERN. 33CFR151.2050(f)

THE CONDITION OF THE SHIP AND ITS EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PROVISIONS OF THE PRESENT REGULATIONS TO ENSURE THAT THE SHIP IN ALL RESPECTS WILL REMAIN FIT TO PROCEED TO SEA WITHOUT DANGER TO THE SHIP OR PERSONS ON BOARD. PSCO OBSERVED MINOR HYDRAULIC LEAK ON THE STARBOARD MOORING WINCH ON THE POOPDECK. THE WINCH AND SURROUNDING AREA HAD STANDING HYDRAULIC OIL AND IS WRAPPED WITH CLOTH TO PREVENT FURTHER LEAK. 74 SOLAS (20) I/11

The company and the ship shall comply with the requirements of the International Safety Management Code. For the purpose of this regulation, the requirements of the Code shall be treated as mandatory. The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. In meeting these requirements, the company should ensure that any non-conformity is reported, with its possible cause, if known. The nature of the below deficiencies provides objective evidence of a serious failure of the implementation of the ISM Code. An external ISM audit report, satisfactory to the Coast Guard, must be submitted prior to clearance of this deficiency and departure. 74 SOLAS (20) IX/3.1 ISM Code Part A/10.1

The siting and installation of accumulator batteries which provide a reserve source of energy shall be such as to ensure reasonable safety. PSCO's observed a large hole on the starboard side bulkhead of the space containing the GMDSS reserve accumulator batteries. This hole presents an unsafe environment for the batteries due to the ability of rain and moisture to negatively impact the condition of the batteries. 74 SOLAS (20) IV/13.7.3

All access openings in bulkheads at ends of enclosed superstructures shall be fitted with doors...and weathertight when closed. PSCO's observed that both the port and starboard exterior doors on Deck A of the superstructure were not weathertight due to light being visible from the inside. ICLL (66) Reg. 12.1

The means for securing and maintaining weathertightness shall be to the satisfaction of the Administration. The arrangements shall ensure that the tightness can be maintained in any sea conditions. PSCO's observed that port side door on the forecastle was not weathertight due to light being visible from the inside. ICLL (66) Reg. 16.4

Hydraulic power-operated steering gear shall be provided with arrangements to maintain the cleanliness of the hydraulic fluid taking into consideration the type and design of the hydraulic system. During the operational test, PSCO's observed a leak emanating from the No. 1 steering gear pump. 74 SOLAS (04) II-1/29.12.1

In all ships a duplicate set of fire control plans or a booklet containing such plans shall be permanently stored in a prominently marked weather-tight enclosure outside the deckhouse for the assistance of shoreside fire-fighting personnel. PSCO's observed that the enclosure for the fire control plan located on the starboard side was seized shut. 74 SOLAS (97) II-2/20.2

After any survey of the ship under regulations 7,8,9 or 10 has been completed, no change shall be made in the structural arrrangements, machinery,equipment and other items covered by the survey, without sanction of the administration. During cargo operations, the operators housing detached from the crane turret, resulting in injury to the operator. Crane found to be inoperable due to the disconnected operators housing. Cargo Operations are suspended until class surveyor verifies remaining cranes are functionally serviceable.

To discharge ballast water into the waters of the United States, the master, owner, operator, agent, or person in charge of a vessel subject to 151.2025 of this subpart must wither ensure that the ballast water meets the ballast water discharge standard in 151.2030(a), use an AMS as described in 151.2025(a)(3), or ballast with water from a US public water system, according to the schedule in paragraph (b) of this section. Subject vessel, of keel laid date 10MAR1998 and ballast water capacity of 26375.1m3, is past its compliance date per the implementation schedule in 33 CFR 151.2035(b). Vessel's current ballast water management method is exchange and discharge, which is not authorized. Vessel has no BWTS installed. Vessel is not authorized to discharge untreated ballast water into US waters. THis deficiency will not be cleared until USCG examiners receive documentation that the vessel has installed a BWTS, has decided to use only public water from the US public water system, or has updated its ballast water management plan to state that the vessel's ballast water management method in US waters is no discharge. During review of BWMP, PSCO observed that the plan did not include necessary provisions listed in 33 CFR 151 Subpart D.

Hydraulic power-operated steering gear shall be provided with the following: a fixed storage tank having sufficient capacity to recharge at least one power actuating system including the resivoir, where the main steering gear is required to be power-operated. Observed insufficient oil level of fixed storage tank for the steering gear.

The C/O, 2/O, and 3/E did not possess appropriate flag state endorsements, nor applications for the same on board. STCW Ch I/Reg I/4.1.1

03 "A-60" boundary self-closing doors in the engine room were found with hooks as hold-backs. 74 SOLAS (97) Ch. II-2/47.2

No person may use any hose in under water service for transfer operations unless the operator of the vessel has tested and inspected as applicable. Vessel's chief engineer was not able to provide proof of hydrostatic test being conducted. 33CFR156.170(d). 10c.
