The construction and arrangement of a vessel must allow the safe operation of the vessel iaw the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. -Stbd generator exhaust connection weld at the side-shell had a cracked weld. -weld found cracked in (aft bulkhead outboard where the deck meets the bulkhead) and crack under bit at the base plate in sewage overboard valve space.

When operating a vessel on a body of water where the discharge of untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods of securing the device include— Padlocking each valve leading to an overboard discharge in the closed position. Valve was found opened and not locked.
