These regulations prescribe the minimum standards, procedures, and means to be used to test for the use of dangerous drugs. During audit of Chemical Testing Program Compliance the vessel was unable to provide evidence of the following: -Copy of latest Management Information System (MIS) form, or Consortium letter stating report filed for employer. (46 CFR 16.500) -Employee Assistance Program (EAP) informational material (46 CFR 16.401) -Crewmembers properly trained before assuming safety sensitive position prior to starting safety-sensitive function or Supervisor(s) received 1 hour EAP training(46 CFR 16.401) -Substance Abuse Professional (SAP) name and contact information (46 CFR 16.401) (46 CFR 16.101(a))

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: "CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. WHEN ALARM OPERATES, DO NOT ENTER UNTIL VENTILATED. LOCK OUT SYSTEM WHEN SERVICING.” The engine room does not have a sign notifying that the space is protected by carbon dioxide. 46 CFR 185.612(g)(2)

All escape hatches and other emergency exits used as means of escape must be marked on both sides in clearly legible letters at least 50 millimeters (2 inches) high: “EMERGENCY EXIT, KEEP CLEAR”, unless such markings are deemed unnecessary by the cognizant OCMI. The escape hatch is not marked on the deck side. 46 CFR 185.606

This part is intended to provide a minimum standard of regulations for electrical installations and equipment that will result in a vessel that is reasonably safe from fire caused by and/or originating in electrical equipment, and reasonably safe from electrical. There are numerous dead end wires throughout the vessel in the machinery space and sewage holding space. 46 CFR 183.01-5(a) "Old T"

Through hull fittings and shutoff valves must be metallic. In the case of nonmetallic hulls, materials that will afford an equal degree of safety and heat resistivity as that afforded by the hull may be approved. The through hull fittings for the sewage tank vent and the galley sink discharge are plastic. 46 CFR 182.720(d)(3)

An adult life jacket must be provided for each person carried on board a vessel. 07 adult kapok life jackets and 01 child kapok life jacket are leaking air and no longer in serviceable condition. 46 CFR 180.71(a)

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (21/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Fire buckets are not marked. 46 CFR 181.610

No more than 19 liters (five gallons) of flammable liquids may be stowed in any machinery space. The flammable liquids must be in containers of 3.8 liters (one gallon) or less. There was an excess of oil being stored in the engine room. 46 CFR 147.45(c)

At each inspection for certification and at every other vessel inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard, clog bilge pumping systems, or block emergency escapes. There is an accumulation of debris in the bilge in the machinery space. 46 CFR 176.830(b)

At each initial and subsequent inspection for certification the owner or managing operator shall be prepared to test the steering systems of the vessel and make them available for inspection to the extent necessary to determine that they are in suitable condition and fit for the service intended. There is a longitudinal crack in the wood of the steering post on the starboard side of the bolt. 46 CFR 176.814

All vessels of 26 feet in length and over shall be provided with individual bilge lines and bilge suctions for each watertight compartment. The bilge line in the machinery space could not be verified of its operational status due to its location and cleanliness of the bilge. 46 CFR 182.25-5(a) "Old T"

Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Vessel does not have installed detectors in required spaces by 27Dec2022. Vessel has been limited to a Limited Coastwise route until detector installation has been verified by a Marine Inspector. 46 CFR 181.405(c)

The items contained in first-aid kit shall be as listed in Table 160.041-4(b)...Opthalmic ointment. Opthalmic ointment is expired and must be replaced.

A vessel on a...coastwise route must carry- (1) Six hand red flare distress signals; (2) Six hand orange smoke distress signals. Vessel missing six orange smoke distress signals.

Crew accommodations [must be] of sufficient size adequate construction, and with suitable equipment to provide for the protection and accommodation of the crew. Exposed staples in the overhead of the crew accommodation space must be removed. 46 CFR 177.25-1(a) OLD T.

A vessel exposed to salt water more than three months in any 12 month period must undergo a drydock and internal structural examination at least once every two years. Vessel has failed to schedule drydock and internal structural examination within two years of last drydock as listed on the COI.

Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. Vessel did not have operable fuel shut off valve.

Each survival craft must be secured to vessel by a painter. Vessel's has deteriorated painter line. 46 CFR 180.20-1

Each life float must be fitted with a light. 01 lifefloat had inoperable light. 46 CFR 180.15-5(d)

At each initial and subsequent inspection for certification and reinspection the MI shall inspect all lifesaving equipment to determine its serviceability. 10 Kapok life jackets plastic covered pads were wasted. 46 CFR 176.25-20(a)

A vessel operating on a coastwise route must carry six orange and six red hand flares. Missing 04 flares. 46 CFR 180.35-5

Pyrotechnic distress signals shall stowed in a portable watertight container. 46 CFR 180.35-10

As appropriate for the intended voyage, vessel must carry up-to-date U.S. Coast Pilot. Operator did not have access to coast pilot on board. 46 CFR 185.20-35

Each survival craft must be visually inspected to ensure it's readiness for use on a weekly basis. Operator had no log of survival craft maintenance.

Items in a first aid kit shall contain 10 ammonia inhalants. Vessel's first aid kit had expired ammonia inhalants. 46 CFR 184.710 & 46 CFR 160.041-4(b)

Remote fuel shutoff stations must be marked in clearly legible letters at least 01 inch high indicating direction of operation. Fuel shutoff stations labeling too small and missing direction of operation. 46 CFR 185.30-25

Lifefloats must be marked with Type II retroreflective material. Reflective tape worn on life floats.

46CFR 180.25-1(a)(7) - Life floats and buoyant apparatus when stowed in tiers, the seperate units must be kept apart by spacers. Life floats stacked in a tier of 3 on the vessel with no spacers in between the seperate units. Add spacers per regulation.

On a vessel of 26 or more feet in length, a visual and audible alarm must be provided at the operating station to indidcate a high water level in the affected space. Engine room bilge high level alarm indicator light at the operating station indicated multiple spaces (ER & Aft space) being activated. Repair so high level alarm activation in each space only indicates the appropriate compartment.

Batteries shall be effectively screened by a cage or similar structure to minimize the danger of accidental spark through dropping a metal object across the terminals. All battery boxes missing appropriate cover to protect the terminals. Install covers across all batteries.

46CFR 177.01-5 - The scantlings, material, workmanship, and arrangement of each vessel are such as to provide for safe operation in accordance with the terms of its certificate of inspection. Vessel deck rails consisting of 02 cracked welds on stbd side. Vessel must repair or replace all areas of rails containing deterioration, cracking, and corrosion at next credit dry dock in 2021.

Vessel does not have emergency instructions onboard and posted. 46 CFR 185.510.

Vessel's masthead light is inoperable. 33 CFR 83.21 and 33 CFR 83.23.

Vessel has wire and cable runs passing through the engine room bulkheads into both fore and aft compartments that are not vapor tight. 46 CFR 177.405(e)

Vessel does not have alcohol testing equipment onboard. 46 CFR 4.06

The marine inspector may conduct a visual exam and require NDT of the propeller shafting whenever the condition is in question. Propeller contained heavey pitting, 2 separate 1 inch cracks within 6 inches of the hub, and a 3 inch portion of several cracks on a previous repair on the hub.

Make bulkhead penetrations watertight in Laz and E/R

Replace ring life buoy.

Submit proof of EPIRB regristration.

Fixed Bilge pump must be operational and pump at 25 gallons per minute. Repair cracked lazarette bilge pipe.
