Stairways and lift trunks which penetrate more than a singledeck shall be surrounded by at least "A-0" class divisions and be protected by self-closing doors at all levels. PSCO observed unauthorized modification to class A fire boundary on deck 3. Ship's crew ran internet cable from passageway into ladder well. Additionally, PSCO observed hole in class A fire door leading from engineer's workshop to escape trunk. 74 SOLAS (97) II-2/46.1

Fire-fighting systems and appliances shall be kept in good working order and readily available for imediate use. PSCO observed fire and safety equipment locker locked with a pad-lock. during fire drill ships crew could not find the key for over five minutes. 74 SOLAS (20) II-2/14.2.1.2

Doors required to be self-closing shall not be fitted with hold-back hooks. PSCO observed hold-back on self-closing fire door leading from passageway to main ladder well on deck 1. Additionally, door gasket was loose preventing door from closing. 74 SOLAS (97) II-2/47.2

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or the persons on board. PSCO observed temporary repair on ballast water piping below ballast pump number 2 leaking at approximately 30 drops per minute. 74 SOLAS (20) I/11(a)

A ship when in a port of another contracting government is subject to control by officers duly authorized by such government concerning operational requirements in respect of the safety of ships, when there are clear grounds for believing that the master or crew are not familiar with essential shipboard procedures relating to the safety of ships. PSCO observe 2 unsatisfactory fire drills. During both drills when asked to perform a check of their equipment members were lacking a radio, and also were not on the correct channel. During Both drills members were observed removing their gloves to use their radios, flashlights, and to check the pressure of their SCBA. The lifeline attached to the fire team was made of combustible material in both drills the proper boundaries were not set. SOALS XI-1/4.1

By the first scheduled dry docking after 1 January 2010 fixed carbon dioxide fire extinguishing systems for the protection of machinery spaces on ships constructed before 1 July 2002 shall comply with the provisions of paragraph 2.2.2 of chapter five of the fire safety systems code; PSCO observed the fixed CO2 system controls activated the release of CO2 gas prior to opening the main valve in which the gas will be directed. SOLAS II-2/ 10.4.1.5

The company and ship shall comply with the requirements of the international safety management code for the purpose of this regulation the requirements of the code shall be treated as mandatory. The company should establish procedures to ensure the new personnel and personnel transfer to new assignments related to the safety and protection of the environment are given proper familiarization with their duties. PSCO Observed multiple personnel with security duties on board the vessel were unaware of the proper baggage screening procedures at all security levels. ISM 6.3

Where cables are installed in hazardous areas introduce the risk of fire or explosion in the event of an electtical fault in some areas, special precautions against such risks shall be taken to the satisfaction of the Administration. PSCO observed exposed electrical wiring on a junction box inside the paint locker located at the entry door. 74SOLAS(04)/II-1/45.5.4

Electrical installations shall be such that the safety of passengers, crew and ship from electrical hazards will be ensured. PSCO observed crew accomodation light fixture cover missing, exposing light bulbs and wires. 74SOLAS(04) II-1/40.1.3

THE SURVEY SHALL BE SUCH AS TO ENSURE THAT THE SHIP'S ANTI-FOULING SYSTEM FULLY COMPLIES WITH THIS CONVENTION. PSCO OBSERVED EXCESSIVE ALGAE GROWTH ON THE SHIP'S HULL

Any required fixed fire detection and firm alarm system with manually operated call points shall be capable of immediate operation at all times. PSCO observed smoe detection system for cargo holds were turned off.

Hydrolic power operated steering gear shall be provided with a fixed storage tank having sufficient capacity to recharge at least one power actuating system including the reservoir. PSCO observed hydrolic oil storage tank containing approximately 60 liters of fluid. Each pump has 100 liter capacity and the reservoir an additional 20 liters.

The condition of the ship and it's equipment shall be maintained to torm with the provisions on the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed ballast water pump valve tied into the open position with a shoe lace bypassing the system.

The company shall establish procedures to ensure the ship is maintained in accordance with relevant rules and regulations. In meeting these the company shall ensure inspections are held at appropriate intervals and non-conformities are reported and corrected. The mechanical and operational nature of the deficiencies noted below provide objective evidence of a serious failure of implementation of ISM code. An external audit report with focus on readiness and testing of emergency, lifesaving, and fire fighting equipment satisfactory to the OCMI must be submitted prior to clearing of this deficiency. 74 SOLAS (20) IX/3.1 ISM Code 10.2

PSCO observed fire detection system panel on bridge indicates zone 6 as empty and repeater panel in ECR indicates zone 8 as empty. Crew was unsure which zone is open. SMS test reports indicate crew is only testing zones 1 – 7. 74 SOLAS (97) II-2/13.1.1

Rescue boats shall be stowed in a state of continuous readiness for launching in not more than 5 minutes. PSCO observed that it took approximately 15 minutes to start the rescue boat. 74 SOLAS (97) III/14.1

Hydraulic power operated steering gear shall be provided with a low-level alarm for each hydraulic fluid reservoir to give the earliest practicable indication of hydraulic fluid leakage. PSCO observed inoperable low hydraulic level alarm additionally hydraulic fluid reservoir was empty. An immersion suit of an appropriate size shall be provided for every person assigned to crew the rescue boat. PSCO observed immersion suits of inadequate size for chief engineer and electrician. 74 SOLAS (97) III/7.3

Irrelevant markings, labels, placards, orange panels, signs, and marine pollutant marks shall be removed prior to packing. PSCO observed numerous placarded containers on deck, However vessels crew indicated that they were empty. IMDG 7.5.2.6

The machinery, boilers, and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board,... PSCO Observed excessive accumulation of oil in the vicinity of the hydraulic tank and stern tube tank located in the aft portion of the engine room. 74 SOLAS (04) II-1/26.1

Each emergency generating set arranged to be automatically started shall be equipped with starting devices with a stored energy capability of at least three consecutive starts. PSCO observed emergency generator primary and secondary starting device fail to start. Ships crew was able to start after an hour of troubleshooting. 74 SOLAS (04) II-1/44.2

Any required fixed fire detection and fire alarm system with manually operated call points shall be capable of immediate operation at all times. PSCO observed smoke detector in the engine control room was inoperable. Additionally, multiple manually operated call points located in accommodation passageways were duct taped and unable to be tested per manufacturer's instructions. 74 SOLAS (97) II-2/13.1.1

Before the ship leaves port and at all times during voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed one life buoy cracked.

The master, owner, operator, agent, or person in charge or a vessel equipped with ballast tanks that operates in the waters of the U.S. must employ one of the following BWM methods. The Master, Owner, Operator, Agent, or person in charge of the vessel subject to this subpart must properly maintain the BWMS in accordance with all manufacture specifications. The vessel's BWTS manual indicates that ballast is to be treated both on uptake and discharge the systems log is missing discharge events indicated in the vessels hand written log. Additionally, the system log recorded multiple errors and alarms regarding the UV light units, high difference pressure, and missing feeback on valves, indicating the system may not be working properly.

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: Fire detection and fire alarm systems. Two smoke alarms in the engine control room failed to activate when tested.

A ship when in a port or offshore terminal of another party is subject to inspection by officers duly authorized by such party concerning operational requirements under this annex, where there are clear grounds for believing that the master or crew are not familiar with essential shipboard procedures relating to the prevention of pollution by oil. (MARPOL 1/11.1) Ship's personnel could not demonstrate to PSCO's how to perform an operational test of oil filtering equipment. Vessel is equipped with oil filtering equipment complying with Resolution MEPC.60(33).

The Company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the Company. (10.1) The Company should ensure that all personnel involved in the company's Safety Management System have an adequate understanding of relevant rules, regulations, codes, and guidelines. (6.4) 74 SOLAS (20) IX/3.1, ISM Part A/6.4, ISM Part A/10.1 Vessel could not provide PSCO's with any SMS procedures regarding testing and maintenance of the ship's oil filtering equipment. (6.4) As referenced in Deficiency #2, vessel's personnel failed to act in accordance with its ships procedures. Require internal audit focusing on testing and maintenance of oil filtering equipment, and security within 90 days.

07126 – Oil Accumulation in Engine Room - The purpose of this regulation is to limit the fire growth potential in every space of the ship. Means of control for flammable liquids in the space shall be provided. PSCO observed approximately 200 gallons of oil in the bilge under the main engine. – 74 SOLAS (04) II-2/5.1.1 – 17ac

11129 – Operational Readiness of Lifesaving Appliances - All life-saving appliances prescribed in this part shall where exposed to sunlight, be resistant to deterioration. In addition, be fitted with retro-reflected material where it will assist in detection and in accordance with the recommendations of the organization. PSCO observed fasteners on windshield and windows of lifeboat corroded and wasted, multiple cracks around fastener holes. Reflective tape in the front of the lifeboat was no longer reflective. – 74 SOLAS (97) III/30.2.5 and 30.2.7 – 17ac

07110 – Fire fighting Equipment and Appliances - Nozzles shall be of an approved dual-purpose type, incorporating a shutoff. PSCO discovered 6 out of 8 fire nozzles on deck were seized. – 74 SOLAS (04) II-2/10.2.3.3.4 – 17ac

02199 – Other (Structural Condition) - The strength of the deckhouses used for accommodation of the crew shall be to the satisfaction of the administration. PSCO discovered that the entire superstructure was supported above the deck by steel beams and associated securing devices, the steel beams and associated devices are wasted and failing. – ILL Annex I/25.1 – 50bc

09298 – Working Conditions (Accident Prevention) - The steering gear compartments shall be provided with handrails and gratings or other nonslip surfaces to ensure suitable working conditions in the event of hydraulic fluid leakage. PSCO observed no non-slip matting or grating in front of steering gear machinery controls. – 74 SOLAS (04) II-1/45.2 – 40ac

CG006 – Ballast Water Management System – AMA, of keel laid date 01DEC1997 and ballast water capacity of 2450 m3, is past its compliance date per the implementation schedule in 33 CFR 151.2035(b). Vessel’s current ballast water management method is exchange and discharge, which is not authorized. Vessel has no BWTS installed. Vessel is not authorized to discharge untreated ballast into US waters. This deficiency will not be cleared until CG examiners receive documentation that the vessel has installed a BWTS, has decided to use only public water from the US public water system, or has updated its ballast water management plan to state that the vessel’s ballast water management method in US waters is no discharge. – 33 CFR 151.2035 – 15c

Where necessary, oil fuel and lubricating oil pipelines shall be screened or otherwise suitably protected to avoid as far as practicable oil spray or oil leakages on to hot surfaces on into machinery air intakes. The number of joints in such piping system shall be kept to a minimum and, where practicable, be collected and arrangements provided for on alarm to be given. PSCOs observed excessive oil on steering gear, main engine, and bilge pockets. 74 SOLAS (97 Cons)II-2/15.5.1

Doors required to be self-closing shall not be fitted with hold-back hooks. However, hold-back arrangements fitted with release devices of the fail safe type may be utilized. PSCOs observed hold-back on A-60 self-closing fire boundry door. 74 SOLAS (97 Cons)II-2/47.2

A food ration shall be kept in airtight packaging. PSCO observed 10 of the required 15 foor ration packages with air inside. SOLAS 74(97 Cons) III / 13.1.4 LSA (2017) CH. IV 4.4.8.12

Oil fuel and lubricating oil pipelines shall be suitably protected to avoid as far as practicable oil spray or oil leaks onto hot surfaces. PSCO observed accumulations of oil under main engine, reduction gear, and shaft, creating a fire hazard. SOLAS 74 (97 CONS) II-2 / 15.5.1

THE DESIGN AND ARRANGEMENT OF NAVIGATIONAL SYSTEMS AND EQUIPMENT ON THE BRIDGE AND BRIDGE PROCEDURES SHALL BE TAKEN WITH AIM OF PREVENTING OR MINIMIZING ANY CONDITIONS OR DISTRACTIONS ON THE BRIDGE WITCH MAY CAUSE FATIGUE OR INTERFERE WITH THE VIGILANCE OF THE BRIDGE TEAM AND THE PILOT. PSCOS RECEIVED REPORT FROM GALVESTON PILOTS ONBOARD ABOUT EXPERIENCING EXCESSIVE HEAT CONDITIONS ON THE BRIDGE. UPON ATTENDING VESSEL, PSCOS WITNESSED TEMPERATURES EXCEEDING 30C ON THE BRIDGE AT 2300 LOCAL TIME. IN ADDITION PSCOS OBSERVED RECORDED TEMPERATURES ON BOARD EXCEEDING 35C ON THE BRIDGE AND EXCEEDING 41C IN THE BRIDGE TEAM'S REST AND ACCOMODATION SPACES. SOLAS 14 CH V/ 15.6

THE CONDITION OF THE SHIP AND ITS EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PROVISIONS OF THE PRESENT REGULATION TO ENSURE THAT THE SHIP IN ALL RESPECTS WILL REMAIN FIT TO PROCEDD TO SEA WITHOUT DANGER TO THE SHIP OR PERSONS ONBOARD. PSCOS FOUND THAT THE VESSELS AIR CONDITIONING UNIT HAS BEEN INOPERABLE FOR A PERIOD EXCEEDING ONE AND A HALF MONTHS. VESSEL MASTER AND CREW HAD RECORDED TEMPERATURES INSIDE THE NAVIGATION BRIDGE AND ACCOMODATION SPACES EXCEEDING 35C AND UP TO 41C, CREATING A POTENTIALLY UNSAFE ENVIRONMENT DUE TO EXCESSIVE HEAT. SOLAS 14 CH I/11(A)

1420 - The associated piping systems and fittings shall be of a design and construction adequate fot the service for which they are intended. Pipe located on starboard bottom level of engine room is leaking excessive oil to the extent that a bucket need ed to be placed to collect it. Bucket was half filled with oil. 74SOLAS(2004CONS) II-1/26.1

0940- In order to discharge ballast water in the waters of the United States, the vessel must use a ballast water management system (BWMS) type approved by the US Coast Guard, use an alternative management system (AMS) or use ballast with water from US public water system (PWS) according to the schedule in paragraph (b) of this section. The existing vessel keel laid in 16DEC97 with a ballast capacity of 2450m3, dry-docked in 11JAN18 has passed its compliance date and has not installed a BWMS or AMS, prior to discharging untreated ballast water in the waters of the United States, the vessel must comply with one of the approved ballast water management methods listed in 33CFR151.2035(a). 33CFR151.2035(a)

0699 - Posters or signs shall be provided on or in the vicinity of survival craft and their launching controls and shall illustrate the purpose of controls and the procedures for operating the appliance and give relevant instructions or warnings. Signs for liferaft launching procedures are worn and weathered to the point o being indecipherable and need to be replaced. 74SOLAS (1997CONS.)II-2/20.1

0915 - In all ships, general arrangements shall be permanently exhibited for the guidance of the ship's officers showing clearly the various fire sections enclosed by "A" and "B" class divisions and means of access to different compartments and decks. Ship's fire control plan does not properly show class "A" boundaries and self closing doors between various compartments and decks. Fire control plans next to gangway and outside galley do not match. 74SOLAS (1997CONS.) II-2/20.1

2550 - The company should establish procedures to ensure that the ship is maintained in conformity with the provisiion of the relevant rules and regulations. The vessel is past its compliance date (01JAN2018) and did not install a ballast water treatment system during drydock (11JAN2018-05FEB2018) 74SOLAS (2014CONS.) IX/3.1 ISM CODE 10.1

The motor vessel INDUSTRIAL AMA owner/operator provided false information in regard to untreated ballast water discharge both into the waters of the Port of Houston, TX. and the Exclusive Economic Zone of the United States.

A FIREMANS OUTFIT SHALL CONSISTS OF PROTECTIVE CLOTHING OF MATERIAL TO PROTECT THE SKIN FROM HEAT RADIATING FROM THE FIRE AND FROM BURNS AND SCALDING BY STEAM. ONE OF VESSELS FIREMANS OUTFITS DOES NOT CONTAIN A FACE HOOD OR SHIELD.74 SOLAS (1997 CONS.ED.)CH II-2 REG. 17.1.1.1

IF A SHIP HAS ANY WATCH OR WORKSTATIONS WHICH ARE LOCATED REMOTELY FROM THE PLACE OR PLACES WHERE IMMERSIONS SUITS ARE NORMALLY STOWED,ADDITIONAL IMMERSIONS SUITS SHALL BE PROVIDED AT THESE LOCATIONS FOR THE NUMBER OF PERSONS NORMALLY ON WATCH OR WORKING AT THOSE LOCATIONS AT ANYTIME. VESSEL DOES NOT HAVE ANY IMMERSION SUITS ON THE BRIDGE OR ENGINE ROOM. 74 SOLAS (2014 CONS.ED.) CH. III,REG.32.3.3

ALL WASTE RECEPTACLES SHALL BE CONSTRUCTED OF NON-COMBUSTIBLE MATERIALS WITH NO OPENINGS IN THE SIDES OR BOTTOMS. ENGINE ROOM HAS MULTIPLE BAGS FILLED WITH OILY RAGS AND PLASTIC CONTAINERS FILLED WITH OILY WATER MIXTURE.74 SOLAS (1997 CONS. ED.)CH. II-2 REG.18.5

Efficient guardrails or bulwarks shall be fitted to all exposed parts of the freeboard and superstructure decks. Guard rail port side amidships, top rail wasted. ICLL 66 I/25(2)

Fireman’s lifeline was not of the fire resistant type. Vessel is to replace life line with fire resistant type, have class submit a report attesting the life line is approved.

Bilge eduction system for aft steering is capable of discharging hydraulic fluid directly to sea via eductor and firemain, bypassing OWS.

Disicator element on OWS is indicating "white" and is expired. There are no spares onboard.

OWS was found to have two soft patches on associated suction piping.

Prior to departure the vessel is required to submit documentation from the certificate issuing authority attesting to the cause of the loss of propulsion, corrective action and the ability of the vessel to safely transit through the Port of Houston.
