46 CFR 178.310 Intact stability requirements—general.
(a) Except as provided in paragraph (c) of this section, each vessel must, in each condition of loading and operation, comply with the applicable requirements of—
(1) Part 170 of this chapter, except subparts G and H; and
(2) Part 171 of this chapter, subparts A and B.
As an alternative to meeting the requirements of paragraphs (a) and (b) of this section, a vessel may demonstrate compliance with an appropriate standard set forth in 178.320 of this part for non-sailing vessels.
Vessel recently installed new main propulsion engines, shafts, and reduction gears that were not a replacement in kind. This resulted in weight changes to the vessel and a change to the center of gravity of newly installed propulsion machinery. The vessels original stability letter was based off a sister vessel in 1976. The vessel has never undergone a stability test. Vessel must undergo a stability test to be witnessed by the Coast Guard to demonstrate satisfactory stability according to the applicable regulations for inspected small passenger vessels prior to carrying passengers.

The owner or managing operator shall make a vessel available for drydock examinations, internal structural examinations, and underwater surveys (UWILD) required by this section. A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. The vessel was undergoing repairs and not made available for a drydock and internal structural examination within the specified time frame. Once repairs are completed, the vessel shall undergo a drydock and internal structural examination prior to carrying passengers to the satisfaction of the attending Coast Guard marine inspector.
