No marine employer may engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Marine Inspector observed that Deckhand on board at time of the inspection was not included on the list of crew members for the consortium.

Internal combustion engine exhaust, boiler, and galley uptakes, and similar sources of ignition shall be kept clear of and suitably insulated from any woodwork or other combustible matter. Marine Inspector found insulation removed from exhaust pipe and needs to be reinstalled.

Penetrations and openings in watertight bulkheads must; have means to make them watertight... Observed wire penetration between engine room and rudder room on upper port side of bulkhead to not be watertight. Seal bulkhead penetration to the satisfaction of the attending Marine Inspector.

Before getting underway on a voyage or as soon as practicable thereafter, the master of a vessel shall ensure that suitable public announcements are made informing all passengers of the following: (1) The location of emergency exits, survival craft embarkation areas, and ring life buoys;(2) The stowage location(s) of life jackets;(3) Either:(i) The proper method of donning and adjusting life jackets of the type(s) carried on the vessel including a demonstration of the proper donning of a lifejacket, or(ii) That passengers may contact a crew member for a demonstration as appropriate, prior to beginning an oceans or coastwise voyage(4) The location of the instruction placards for life jackets and other lifesaving devices; (5)That all passengers will be required to don life jackets when possible hazardous conditions exist, as directed by the master; and (6)If the vessel is operating with reduced manning or equipment requirements in § 176.114 of this chapter... Vessel did not have a standard brief for crew passengers prior to getting underway. Perform passenger brief to include items 1 through 6 above to the satisfaction of the attending Marine Inspector.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date:(1) Charts of large enough scale to make safe navigation possible... Vessel's electronic chart not up to date. Ensure charts are updated to the satisfaction of the attending Marine Inspector.

Unless other means are provided to ensure that a potential waste receptacle fire would be limited to the receptacle, waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom.

All vessels shall be provided with a hand operated portable fire pump having a capacity of at least 5 gallons per minute. This fire pump shall be equipped with suction and discharge hose suitable for use in fire fighting. (b) The hand portable fire pump may also serve as a bilge pump. Vessels portable hand pump was inoperable. Additional hose used to reach the water was not secure. 46 CFR 181.10-5

Each water light must be of an approved automatic electric type, constructed in accordance with subpart 161.010 of this chapter, except as allowed under paragraph (c) of this section. Water light was inoperable and was fitted with a battery that has been expired for 8 years. Vessel is daylight restricted. 46 CFR 180.30-1(b)

Each life preserver carried on a vessel must have at least 200 sq. cm (31 sq. in.) of retroreflective material attached on its front side, at least 200 sq. cm on its back side, and at least 200 sq. cm of material on each of its reversible sides. Retroreflective material on 2 PFDs were wasted and not longer reflective. Vessel is authorized to carry 41 passengers. 46CFR 180.25-25

Before getting underway, the master of each vessel subject to this subpart shall ensure that suitable public announcements, instructive placards or both are provided in a manner which affords all passengers the opportunity to become acquainted with… Proper method of donning and adjusting life preservers of the type(s) carried on the vessel; Vessel provided instructions for 2 out of 5 types of PFDs carried on board. Master will demonstrate donning instructions until all 5 PFD donning placards are posted. 46CFR 185.25-1(d)(2)

Except as otherwise provided in this section, it shall be the duty of the master of any vessel subject to the regulations in this Subchapter to prepare and post emergency checkoff lists in a conspicuous place accessible to crew and passengers. Vessel had no emergency instructions provided for the crew or passengers. Master will brief emergency instructions to crew and passengers prior to getting underway until emergency instructions are posted. 46 CFR 185.25-1(a)

The employer shall provide an Employee Assistance Program (EAP) for all crewmembers.... must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. Crew was unfamiliar with EAP and there was no display or distribution on information. 46 CFR 16.401

Vessel must have onboard a 25 foot fire hose which can be a garden hose. Vessel only had a 12 foot garden hose onboard which could not reach around to the engine room.

Vessel's life ringbuoy was missing retroreflective tape

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other than small buoyancy compartments under all practical conditions. IAW Table 182.25-10(a) S vessels with less than 49 passengers 26' to 65', 1 fixed 10 GPM and 1 portable 5 GPM or 1 fixed hand pump 10 GPM and 1 portable hand pump at 5 GPM. Vessel's fixed bilge system is not drawing suction from all spaces. 46 CFR 182.25-1

Except as further modified in this section where fire extinguishing systems or equipment are not required, but are installed, the system or equipment must meet this part. Vessel is equipped with a fixed fire pump and portable fire pump instead of fire buckets required by New Subchapter "T", the fire pump cannot produce adequate pressure to extinguish a fire. Hand pump not on board. 46 CFR 181.05-5

Lifejacket placard containing instructions for donning and use of the lifejacket aboard the vessel must be posted in conspicuous places that are regularly assessible and visible to the crew and passengers. Vessel has two types of lifejackets, but only a placard for one type. 46 CFR 185.516

Lifejackets - All vessels shall be provided with an approved adult type life preserver for each person carried. The vessel is required 45 adult life lifejackets and only has 36. Vessel is restricted to 34 passengers until 9 additional lifejackets are approved and provided. Owner replaced 8 of 9, passenger count reduced to 42 until last PFD is replaced. 46 CFR 180.25-5

Each ring buoy must be marked with type II retroreflective material approved in accordance with 46 CFR 164.018. The ring buoy was not marked with retro-refelctive material. 46 CFR 185.604(i)

A marine employer whose vessel is involved in a marine casulty or incident, that is, or is likely to become a serious marine incident shall comply with the requirements of 46 CFR 4.06. 46 CFR 4.06 states a marine employer must have a sufficient number of alcohol testing devices readily accessible onboard the vessel. The vessel did not have alcohol testing devices nor did they have an established plan to get alcohol testing completed within 2 hours. 46 CFR 189.212

All vessels shall be equipped with a hand operated portable pump having a capacity of at least 5 gallons per minute. The vessel was missing the required hand fire pump. 46 CFR 181.10-5

All hand portable fire extinguishers and semi-portable fire extinguishing systems shall be checked as noted in Table 176.25-25(a)(2), and in addition shall be examined for excessive corrosion and general condition. One of two portable fire extinguishers for the machinery space is missing a tamper seal. 46 CFR 176.25-25(a)(2)

All electrical installations shall be to the satisfaction of the Officer In Charge, Marine Inspection. Exposed wire terminal lugs were observed to be disconnected and unlabeled in the space underneath operating station console and the forward bulkhead of the engine room. Cables that are unused shall be removed from service. 46 CFR 183.01-15(a)

A vessel must comply with the structural design requirements of ABS aluminum Vessel Rules. Inspection of hull revealed 03 holes of varying sizes 1" to 2" in diameter penetrating the hull on the STBD side approximately 4-6" up from the keel. Repairs must be completed prior to the completion of dry dock. 46 CFR 177.300 (d)(ii)

46 CFR 176.01-1(a) Except as noted in this subpart, every vessel subject to inspection and certification shall, when carrying more than six passengers, have on board a valid certificate of inspection and shall be operated in compliance therewith. Vessel was being operated without a deckhand when the COI requires there to be one onboard.

46 CFR 16.210: No marine employer shall engage or employ and individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Discovered that the crew member used after DEF #1 was issued the company used an employee who had not been drug tested to act as a deckhand.

Vessels will be provided with bilge pumps in accordance with table 182.25-10(a). Vessels bilge pump is inoperative.
