All fire main piping, valves, and fittings shall be in accordance with good marine practice and suitable for the purpose intended. MI observed a significant leak in the fire pump shaft packing and in the piping threads on the discharge side of the fire pump. 46 CFR 181.15-5(c)

Stations in the maritime service must be licensed by the FCC. MI observed the vessel's station license was expired. Vessel is limited to operations less than 1,000 feet from shore. 47 CFR 80.13(a)

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions MI observed no emergency checkoff lists in an area accessible to passengers. Rectify within 7 days. 46 CFR 185.510

The master shall conduct drills and give instructions as necessary to ensure that all crew members are familiar with their duties. MI observed a severe lack of communication among the crew members that resulted in a delay and unsafe manner of recovery during the man overboard drill. Additionally, 02 crew members asserted to not know their responsibilities during a fire. Rectify within 7 days. 46 CFR 185.524

On a vessel of at least 7.9 meters in length, a visual and audible alarm must be provided at the operating station to indicate a high water level in each bilge well. MI observed the bilge well in the berthing room space had a high water alarm that provided a visual alarm to the operating station, but did not provide an audible alarm. 46 CFR 182.530

Each connection to a conductor or terminal part of a conductor must be made within an enclosure. MI observed cables connecting each bank of batteries that were spliced together and wrapped with electrical tape in the engine room. 46 CFR 183.340(g)

All vessels shall be provided with suitable steering apparatus. MI observed severely corroded flexible hose fittings going into the steering ram in the lazarette. 46 CFR 182.30-1

The Certificate of Inspection must be posted under glass or other suitable transparent material, such that all pages are visible. MI observed COI pages stapled together under the glass such that all pages were not visible. 46 CFR 176.302

The Stability Letter must be posted under glass or other suitable transparent material, such that all pages are visible. Stability letter not posted as to be visible. 46 CFR 176.306

Flexible hose may be used provided it is fitted with suitable connection fittings and has high resistance to saltwater, petroleum oils and vibration. Marine inspector observed a fuel leak from flexible hose attached to the port main diesel engine, outboard side of motor. 46 CFR 182.720(e) 46 CFR(10-1-94 Edition) 182.20-40(2); 60c

An exposed hazard, such as gears or rotating machinery, must be properly protected by a cover, guard, or rail. Marine Inspector observed missing guard for rotating belt on forward section of the starboard main diesel engine. 46 CFR 177.960; 16c

Employers must maintain records of chemical tests to identify the total number of individuals chemically tested annually for dangerous drugs. Marine inspector observed current employment list does not reflect new employee hired. 46 CFR 16.260(b)(2);16c

All marine employers must submit drug testing program data required by 49 CFR 40.26 and appendix H to 49 CFR 40. Marine Inspector observed no copy of report on file verifying proof of submission. 46 CFR 16.500(a)(1);16c

Each life float must be fitted with a lifeline, pendants, two paddles, a painter, and a light. Marine Inspector observed 01 life float light not operational. 46 CFR 180.175(d);16c

The equipment required for life floats must meet the following specifications: Each paddle must be of at least 1,220 millimeters (4 feet) in length, lashed to the life float to which it belongs and buoyant. Marine inspector observed all paddles for 07 life floats not lashed to the life floats which it belongs to. 46 CFR 180.175(f)(2);16c

Each lighting fixture globe, lens, or diffuser must have a guard or be made of high strength material, except in an accommodation space, radio room, galley, or similar space where it is not subject to damage. Marine inspector observed 03 light missing guards. 46 CFR 183.410(a);16c

Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Marine inspector observed fire detection systems not interconnected. 46 CFR 181.405(c);16c

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. MI observed EPIRB batter was expired. Route reduced to no more than 3 miles from the coastline. 46 CFR 180.64

A vessel must comply with the applicable requirements for any radio and EPIRB installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR 80. MI observed that the MF radio was inoperable. Route restricted to no more than 20 miles from the coastline. 46 CFR 184.502

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. MI observed that the port side navigation light was inoperable. Restricted to daylight operations only. 46 CFR 183.420

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved in accordance with 160.012 in subchapter Q. MI observed 02 life jacket lights were inoperable. Restricted to 74 passengers when operating on an oceans or coastwise route. 46 CFR 180.75(a)

Each life float must have a floating water light approved under series 161.010. MI observed 01 life float light that was inoperable. Vessel restricted to daylight operation only. 46 CFR 180.175(f)(4)

When life floats are stowed in tiers, the separate units must be kept apart by spacers. MI observed that each tier of life floats did not have spacers in use. One week given to rectify deficiency. 46 CFR 180.137(f)

Each life float and buoyant apparatus must be individually attached to the painter by a line meeting 180.175(f)(3)(ii), (iii), and (iv) and long enough that each life float can float without contacting any other life float in the group. MI observed that port side life float(s) were not attached to the weak link via the painter. One week given to rectify deficiency. 46 CFR 180.137(e)(3)

At least 50% of the crew shall have current first aid and CPR certifications. MI observed that none of the crew had current first aid or CPR certificates. Vessel given one week to identify certified course. 46 CFR 15.103 NVIC 1-91

Piping, including valves, pipe fittings and flanges, conveying vapor, gas, or liquid, the temperature of which exceeds 150 degrees F must be suitably insulated where necessary to prevent injuries. MI observed port side MDE lagging was torn. 46 CFR 177.970

The installation and location of each portable fire extinguisher must be to the satisfaction of the Officer in Charge, Marine Inspection. MI observed bracket for the portable fire extinguisher at the bottom of the stairwell leading to the engine room was severely wasted, replace. 46 CFR 182.520

The marine employer shall ensure that all personnel directly involved in a serious marine incident are chemically tested for evidence of dangerous drugs and alcohol in accordance with 46 CFR 4.06. MI observed alcohol test strips were expired. Replace strips within one week. 46 CFR 16.240

Vessels which have overnight accommodations, or operate on an oceans or coastwise route must install interconnected fire detection systems in all enclosed areas where passengers and/or crew have routine access, including accommodation spaces and machinery spaces. MI observed no interconnected system was in place. Provide plan for placement of fire detector locations, and install system. 46 CFR 185.364

On vessels described by 46 CFR 175.110(c), flammable items not otherwise covered by the regulations of this subchapter, such as rechargeable batteries, including lithium ion batteries utilized for commercial purposes, must be handled, stored, and operated in a way that mitigates the risk of hazardous conditions. MI observed that there was not a designated location for the charging of devices containing a lithium ion battery. 46 CFR 185.364 CG-CVC Policy Letter 20-03

Vessels described by 46 CFR 175.110(d) must ensure that the two means of escape required in paragraph (b) of this section are unobstructed and the door, hatch, or cuttle is not located directly above, or dependent on, a berth. MI observed that one means of escape from the lower accommodation space was dependent on a berth for escape. 46 CFR 177.500(n)

Vessels described by 46 CFR 175.110(d) must submit plans to the cognizant OCMI, in accordance with 46 CFR 176.700, for the installation and use of monitoring device to ensure the wakefulness of the watchmen required in paragraph (a) of this section. The Coast Guard will work with the vessel operators to determine a reasonable implementation schedule once the plans are accepted. The monitoring device(s) must: 1. Ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive; 2. Remain operable during the nighttime watch; and 3. Be arranged to ensure proper coverage of the passenger accommodation spaces, common areas, and spaces with potential fire hazards. MI observed that no BNWAS type system was installed. Submit plan for type and installation of system. 46 CFR 185.410(b)(1)-(3)

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. MI observed stbd side steering hydraulic line fitting was severely wasted, replace. 46 CFR 182.100

A power-driven vessel underway shall exhibit a sternlight showing an unbroken light over an arc of the horizon of 135 degrees and so fixed as to show the light 67.5 degrees from right aft on each side of the vessel. MI observed stern light was inoperable. Restricted to day light operations. 33 CFR 83.23(a)(iv)

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. MI identified a new battery charger installation in the engine compartment. Submit electrical plans to the MSC for review and approval. 46 CFR 183.115

Each hatch exposed to the weather must be watertight. Identified a flush deck hatch on the laz/fuel tank space that has a damaged gasket. 46 CFR 171.124(a)

Each life float must be fitted with a lifeline, pendants, two paddles, a painter, and a light. Each paddle must be of at least 1,220 millimeters (4 feet) in length, lashed to the life float to which it belongs and buoyant. Identified 7 fractured paddles for life floats. 46 CFR 180.175

Each item of survival craft equipment must be of good quality, and efficient for the purpose it is intended to serve. Each platform must be of a material that is resistant to deterioration by exposure to weather or must have a surface that protects it from deterioration by exposure to weather. Each metal part of a buoyant apparatus must be -410 stainless steel or have salt water and salt air corrosion characteristics equal or superior to 410 stainless steel; and Galvanically compatible with each other metal part in contact with it. Identified the corrosion to all life float metal used to support the net arrangement required to have a min breaking strength of 355 lbs. Replace all metal with 410 stainless. 46 CFR 180.175

An adult life jacket must be provided for each person carried on board a vessel. 19 Adult lifejackets were found unsuitable for service. Passenger count reduced to 59 when operating on voyages less than 12 hours. 46 CFR 180.71

A marine employer whose vessel is involved in a casualty or incident...shall comply with the requirements of 4.06. The alcohol testing of each individual must be conducted within 2 hours. Alcohol testing devices are expired. 46 CFR 185.212 & 46 CFR 4.06-3(a)

Each item of survival craft equipment must be of good quality, and efficient for the purpose it is intended to serve. 03 lifefloat paddles found fractured. 46 CFR 180.175(a)

A power-driven fire pump shall be installed on each mechanically propelled "S" vessel which is a ferry vessel or which is permitted to carry more than 49 passengers, and on each mechanically propelled "L" vessel per 46 CFR 181-10(a). The minimum capacity of the power fire pump shall be 50 gallons per minute at a pressure of not less than 60 pounds per square inch at the pump outlet. The master of the vessel was unable to energize the power-driven fire pump using power from the ship's generator during the inspection. The crew is unable to effectively fight a fire using the fire pump and fire main system. Prove proper operation of the fire pump prior to carrying passengers. 46 CFR 181-10(c)

Means of escape from lounge areas shall be provided in accordance with Subpart 177.15. Except as otherwise provided in this section, all vessels shall be provided with not less than two avenues of escape from all general areas accessible to the passengers or where the crew may be quartered or normally employed, so located that if one is not available the other may be. The vertical escape route located in the passenger berthing is not functional and found with objects that impede egress. The aft vertical emergency escape hatch is blocked on the deck above by a permanently installed table fixture. The crew installed a locking nut under the table top which must be twisted to release the table top from its foundation. A passenger must be able to find the locking nut behind the table leg, twist the locking nut 180 degrees to release the table from its foundation, and lift the table vertically to escape the berthing area. Provide two functional avenues of escape from all general areas accessible to the passengers prior to carrying passengers on overnight voyages. 46 CFR 177.30-7(c)

Adequate emergency lighting automatically actuated upon failure of the main lighting system shall be fitted along the line of escape in vessels having lounge areas below the main deck as per subpart 177.30-7 of this subchapter. The passenger berthing area has one emergency light positioned at the top of the forward vertical staircase and no other emergency lighting. The second avenue of escape in the passenger berthing area is located aft of the staircase and obstructed from the one light that is installed at the top of the staircase. Provide adequate emergency lighting along the line of escape located aft of the staircase in the passenger berthing area prior to carrying passengers on overnight voyages. 46 CFR 184.30-5

Each generator and motor must be designed for an ambient temperature of 50 deg C except that: a generator or motor designed for 40 deg C may be used in 50 deg C ambient locations provided the generator or motor is derated to 80 percent of the full load rating, and the rating or setting of the overcurrent devices is reduced accordingly. Each generator must be protected by an overcurrent device set value not exceeding 115 percent of the generator full load rating. Generator installed in the engine room is rated for 40 deg C at ambient temperature. No Coast Guard approved electrical plans or AC load analysis was completed prior to installation of the new AC generator in 2008. Provide an AC load analysis and submit AC electrical plans to USCG Marine Safety Center for review. Contact USCG Sector St. Pete once electrical plans are approved by MSC. 46 CFR 183.320(b)(2)

Use of a Coast Guard type-approved AIS Class B device in lieu of an AIS Class A device is permissible on a self propelled vessel of 65 feet or more in length, engaged in commercial service. A Class A or Class B AIS is not installed on the vessel. Install a Class A or Class B AIS and prove proper operation of the AIS to the attending USCG marine inspector. 33 CFR 164.46(b)

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, must comply with 46 CFR 183. Electrical equipment on a vessel must be installed and maintained to minimize accidental personnel contact with energized parts. 120 V AC conductors found disconnected behind the breaker panel under the operating station on the starboard side and behind the steering apparatus. Install conductors in accordance with 46 CFR 183.340 and contact USCG marine inspector for re-inspection. 46 CFR 183.200(c)

Each Marine Sanitation Device certified under this section which is installed aboard an inspected vessel must comply with 33 CFR 159.97 and Subchapter F of Title 46 CFR. MSD Type III holding tanks located above the port and starboard fuel tanks were found with corroded inlet pipes. Crop and renew inlet piping on both tanks prior to receiving credit at the next scheduled dry dock. 33 CFR 159.12a(d)

Shutoff valves, installed so as to close against the fuel flow, shall be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop the fuel flow when servicing accessories. The shutoff valve at the tank shall be operable from outside the tank compartment, preferably from an accessible position on the weather deck. The fuel tank remote shutoff located outside of the tank compartment is attached to a wood block in between the shutoff valve and remote actuation lever. The wood block is not an acceptable attachment point for the shutoff valve in the event of a fire. Replace the wood block with a suitable remote shutoff valve that is accessible from outside of the tank compartment. 46 CFR 182.20-40(b)(3)

All cable and wire must not be installed with sharp bends. Conductors installed on starting and house batteries located on the port and starboard side were found with sharp bends at the battery terminal. The conductor between the starting battery and the engine starter do not have overcurrent protection and sharp bends will create heat at the cold cranking amperage (550amps). Install conductors on house batteries so no sharp bends are installed. 46 CFR 183.340(b)(5)

Where an exhaust pipe passes through a watertight bulkhead, the watertight integrity of the bulkhead must be maintained. Where flexibility is necessary, a section of flexible metallic hose may be used for wet exhaust systems. Newly installed generator exhaust flexible hose found backing off of the exhaust outlet on the starboard side of the engine room. Water found under the flexible hose at the side shell plate. Renew as original. 46 CFR 182.430(f)

Each hatch exposed to the weather must be watertight. Discovered a watertight hatch used for entry into the anchor compartment on the main deck missing a rubber gasket. Replace rubber gasket and make hatch watertight. 46 CFR 171.124(a)

Raw water pickup welded spool piece for water pump located on the starboard side of the engine room at the bottom plate was found corroded. Crop and renew prior to credit at the next scheduled dry dock. 46 CFR 176.20-1

The inspection and maintenance of survival craft and EPIRB shall be logged or otherwise documented. No log for survival craft inspection was available for inspection. Begin a log for survival craft and EPIRB maintenance, testing, and inspection. 46 CFR 185.722 and 46 CFR 185.728

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date U.S. Coast Pilot and Coast Guard Light List. A U.S. Coast Pilot #5 for the Tampa, FL area is not on board. A 2020 Coast Guard Light List is not on board. 46 CFR 184.420

Electrical equipment must be installed to minimize accidental personnel contact with energized parts. Starboard distribution panel has open spare. Repair. IAW: 46 CFR 183.200

All escape hatches shall be marked on both sides using at least 1 inch letters: "Emergency Exit, Keep Clear." Passenger berthing needs markings. Rectify prior to completion of next drydock. - 46CFR815.30-15
