A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. Vessel's first aid kit was inadequate for operations. O/O to renew/replace first-aid kit. 46 CFR 184.710

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible. OCMI allows for vessels operating within 1000 ft from shore in tender servce to use a laminated up to date charlet for it's operating area onboard vs a full corrected paper chart. Vessel did not have any acceptable charts or chartlets onboard. 46 CFR 184.420(a)(1)

Each vessel must be equipped with at least two operable portable battery lights. Local OCMI allows for vessel's operating within 1000 ft from shore in tender service to only have 1 operable portable light on board. Vessel's portable light was inoperable. O/O to repair/replace portable light. 46CFR183.430

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018 or other standard specified by the Commandant. The arrangement of the retroreflective material applied after March 11, 1996, must be as specified by IMO Resolution A.658(16). Vessel's life ring buoy was missing type II retroreflective tape on one side of buoy. 46 CFR 185.604(i)

The cognizant Officer in Charge, Marine Inspection (OCMI) determines the total number of persons permitted to be carried on a vessel. In determining the total number of persons, the OCMI may consider the total weight of passengers, crew, and variable loads; stability restrictions and subdivision requirements of the vessel; the vessel's route, general arrangement, means of escape, and lifesaving equipment; minimum manning requirements; and the maximum number of passengers permitted in accordance with § 176.113 of this part. OCMI has approved the reduction in total persons onboard to 24 and total passengers to 23 in lieu of vessel completing a new SST post main engine re-power. If operator wants to operate with number or personas allowed on their stability letter in the future, a new SST must be conducted. 46 CFR 176.112

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that: (7) A positive shutoff valve is installed at the hull penetration. Bilge shutoff not installed at the overboard penetration. Install positive action valve to the satisfaction of the attending marine inspector.

A pre-engineered fixed gas fire extinguishing system must: (3) Automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space. Devise a means of securing ventilation to engine compartment intake during activation of pre-engineered fixed fire fighting system.

The master of a vessel,shall keep a correct, written count of all passengers that embark on and disembark from the vessel. Vessel needs to provide a means of accurately tracking passengers.

Before getting underway on a voyage the master of a vessel shall ensure that suitable public announcements are made informing all passengers of the following:(1) The location ring life buoys;(2) The stowage location(s) of life jackets;(3) The proper method of donning and adjusting life jackets 4) The location of the instruction placards for life jackets and other lifesaving devices;(5) That all passengers will be required to don life jackets when possible hazardous conditions exist, as directed by the master. Vessel needs to create a safety orientation for passengers.

The managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by § 185.510 of this part. Vessel needs to develop crew member orientation for effective emergency management and ensure it is logged.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions

Each EAP education program must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crew member assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. Managing operator must ensure all necessary Employee Assistance Program placards are posted for crew members in a conspicuous area.

Vessel was re-powered in Sector SENE. In accordance with stability letter issued 15JUNE2012, no changes in construction or equipment and no fixed ballast or other such weights shall be added, removed, altered, and/or relocated without the authorization and supervision of the cognizant Officer in Charge, Marine Inspection. Have a stability review completed by Sector Boston to determine if a new SST will be required prior to the carriage of passengers or cargo.

Emergency instructions must be posted aboard the vessel. Alternatively, emergency instructions may be kept on board in a waterproof binder or container. Emergency instructions kept in a container or binder must be made available to the crew, passengers, and marine inspectors upon request. The vessel did not have emergency instructions.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date charts. No charts available. Provide charts of operating area.

Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. The training entry shall include the following information. (1) Date of the training; and (2) General description of the training topics. No records of firefighting or man overboard drills available. Provide vessel log with properly documents drills at intervals of no greater than every 3 months.

When, in accordance with §178.210 of this chapter, a vessel must be provided with a stability letter, the stability letter must be posted under glass or other suitable transparent material, such that all pages are visible, at the operating station of the vessel. If posting is impracticable, the stability letter must be kept on board in a weather tight container readily available for use by the crew and display to passengers and others on request. No Stability letter available. Provide a copy of vessels stability letter.
