"A hinged watertight bulkhead door must be fitted with quick action closing device operable from both sides of the door..." Hinged watertight door for engine room was not able to be secured. Ensure dogs for engine room watertight door can be tightened. 46 CFR 179.330(b)

"At each inspection for certification... all observed unsafe practices, fire hazards, and other hazardous situations must be corrected..." Manual ventilation opening flaps for engine room was observed to be not operational. Ensure ventilation flaps are operational. 46 CFR 176.830(a)

"Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replaced." 11 lifejackets on top deck were observed to be cracked and not in serviceable condition. Replace the lifejackets not in serviceable condition prior to operating with more than 133 passengers. 46 CFR 176.808(b)

"A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural examination at least once every two years." Vessel exceeded 2 year dry dock requirement. Prior to carriage of passengers, vessel must receive credit drydock. 46 CFR 115.600(c)(1)

The owner, managing operator, or a qualified servicing facility as applicable must conduct the following inspections and tests: For fixed-gas fire extinguishing systems, the inspections and tests required by Table 176.810(b) of this section, in addition to the tests required by 46 CFR 147.60 and 147.65. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. Owner/Operator could not produce evidence of servicing the fixed CO2 fire suppression system. 46 CFR 176.810(b)(2)

The Rules concerning lights (§§ 83.20 through 83.31) shall be complied with from sunset to sunrise, and during such times no other lights shall be exhibited, except such lights as cannot be mistaken for the lights specified in these Rules or do not impair their visibility or distinctive character, or interfere with the keeping of a proper lookout. 33 CFR 83.20(b)

Shutoff valves shall be fitted in the fuel supply lines to stop fuel flow. Fuel shutoff for auxiliary fuel tank is inoperable. 46 CFR 182.20-40(b)(3) "Old-T"

Employers must maintain records of chemical tests and must make these records available to Coast Guard officials upon request. Owner/Operator failed to provide Drug and Alcohol Program records. 46 CFR 16.260

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards. 1.) Generator Room transformer bank needs cover. 2.) Alarm Light in generator room needs mounting. 3.) Breaker panel in generator room needs blanks installed. 4.) multiple open wires, open junction boxes, and electrical hazards in the generator room, main engine room, bridge, top deck. Repair to satisfaction of OCMI. 46 CFR 183.200

Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replace. Multiple lifejackets on upper deck were found without retro-reflective tape, and not in serviceable condition. Replace life jackets or remove lifejackets not apart of the official COI Lifejacket count. 46 CFR 176.808(b)

At each inspection for certification and at every other vessel inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard, clog bilge pumping systems, or block emergency escapes. Engine room bilge had excessive oil accumulation and forepeak had excessive water and debris. 46 CFR 176.830(b)

Inspection of all accessible parts of the interior of the hull. Forepeak longitudinal has cracked weld, and transverse frame vertical deck stiffener requires weld. Submit repair plan. 46 CFR 176.802(a)(1)

Installation of diesel engine exhaust pipe shall be in accordance with 182.15-20. Exhaust piping shall be gas tight. Inspector found exhaust leak on the starboard main engine. 46 CFR 182.20-20 "Old T"

At each vessel inspection all observed fire hazards and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. 1.) Vessel has hardwired installed unapproved heater on main deck. 2.) Guard must be installed around alternator on Centerline Diesel Propulsion engine. 3.) Gate or chain to prevent unauthorized passenger access to Bow, and subsequently mark area as Crew Only. 46 CFR 176.830(a)

Special attention shall be paid to insure that guards or protective devices are provided in all hazardous places. No lagging on port and starboard main engine exhaust. 46 CFR 176.25-10(b) "Old T"

All electrical installations shall be to the satisfaction of the [name withheld] wiring was not mounted. 46 CFR 183.01-15 "Old T"

Batteries shall be secured against shifting with motion of the boat. Starboard generator battery and battery under helm in the bridge were not secured. 46 CFR 183.05-20(a) "Old T"

Remote fuel shutoff stations shall be marked in at least 1 inch letters indicating purpose of the valve and the direction of operation. Fuel shutoff valves had no labeling. 46 cfr 185.30-20 "Old T"

On a vessel on which the number of passengers permitted on upper decks is limited by stability criteria, as indicated by the vessel’s stability letter, the maximum number of passengers allowed on an upper deck must be indicated by a durable marking of at least 25millimeters (1 inch) numbers and letters at the entrance way to that deck. Aft Stairwell leading up to upper deck is not marked with maximum passengers. 46 CFR 185.602(g)

Master shall conduct sufficient drills that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons who have fallen overboard or in case of a fire. These items shall be logged or otherwise documented for review by the coast guard upon request. Vessel has not been operating and has not been conducting drills, prior to re-completing the COI vessel shall conduct drills prior to USCG arrival. 46 CFR 185.524

The stability letter must be posted under glass or other suitable transparent material that all pages are visible at the operating station of the vessel. If impracticable, the stability letter must be kept on board in a weather tight container readily available for use by the crew and display to passengers and others on request. 46 CFR 178.306

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station emergency instructions containing actions to be taken in the event of Fire, Heavy Weather, or Man overboard conditions. Vessel does not have emergency instructions posted at the operating station. 46 CFR 185.510

Vessel must carry a first aid kit approved under approval series or a kit with equivalent contents and instructions. Vessel’s first aid kit had expired items. Replace expired items. 46 CFR 184.710

No pressure vessel need be hydrostatically tested except when a defect is found that, in the marine inspector's opinion, may affect the safety of the pressure vessel. No records present of both pressure vessels last inspection date and pressure vessels showing signs of corrosion internally. Hydrostatically test both pressure vessels at 1.5xMAWP through a 3rd party and provide record of testing to marine inspector.

This term means that the operator of the vessel may start and stop the engines and control the direction and speed of the propeller from the principal station from which the vessel is steered. Repair malfunctioning remote, emergency stops for main propulsion machinery.

This part is intended to provide a minimum standard of regulations for electrical installations and equipment that will result in a vessel that is reasonably safe from fire caused by and/or originating in electrical equipment, and reasonably safe from electrical shock of personnel. Restore all malfunctioning gauges on electrical switchboard.

When operating a vessel on a body of water where the discharge of untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods of securing the device include— (1) Closing each valve leading to an overboard discharge and removing the handle; (2) Padlocking each valve leading to an overboard discharge in the closed position; or (3) Using a non-releasable wire-tie to hold each valve leading to an overboard discharge in the closed position. Type III device was not secured in an acceptable manner to prevent accidental discharge of sewage.

At least one ring life buoy must be fitted with a lifeline... Each lifeline on a ring life buoy must: (1) Be buoyant; (2) Be of at least 18.3 meters (60 feet) in length; (3) Be non-kinking; (4) Have a diameter of at least 7.9 millimeters (5/16 inch); (5) Have a breaking strength of at least 5 kilonewtons (1,124 pounds); and (6) Be of a dark color if synthetic, or of a type certified to be resistant to deterioration from ultraviolet light. No lifeline observed on vessel's life buoys.

(1) On passenger decks of a ferry...the following must be installed: (i) Bulwarks; (ii) Chain link fencing or wire mesh that has openings of not more than 4 inches in diameter; or (iii) Bars, slats, rail courses, or an equivalent spaced at intervals of not more than 100 millimeters (4 inches). Insufficient rail courses or equivalent installations on the Main Dk access the rescue boat deck (aft quarter of port side).

(a)Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels... (d)Marine employers may... use sponsoring organizations, or may use contractors, to conduct the random chemical testing programs required by this part. Operator did not have proof of crew enrollment in Drug and Alcohol Consortium agency. Email a copy/objective evidence of all crew mbr's enrollment and designated testing crew mbr.

Portable fire extinguishers shall be installed and located to the satisfaction of the Officer in Charge, Marine Inspection. Operator will install dual-point mounting brackets for all required fire extinguishers.

A ship, except a ship of less than 26 feet in length, must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space, or at the bilge and ballast pump control station, stating the following: Discharge of Oil Prohibited The Federal Water Pollution Control Act prohibits the discharge of oil or oily waste into or upon the navigable waters of the United States, or the waters of the contiguous zone, or which may affect natural resources belonging to, appertaining to, or under the exclusive management authority of the United States, if such discharge causes a film or discoloration of the surface of the water or causes a sludge or emulsion beneath the surface of the water. Violators are subject to substantial civil penalties and/or criminal sanctions including fines and imprisonment. Operator will obtain the specified placard and post.

The construction and arrangement of a vessel must allow the safe operation of the vessel...giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places...Pending a structural review of upper deck support, Passenger limit of 60 imposed on upper deck.

Every ship of 12 m or more in length overall and fixed or floating platforms shall display placards which notify the crew and passengers of the discharge requirements of regulations 3, 4, 5 and 6 of this Annex...A placard must be posted in a prominent location, durable make, and at least 5in x 8in prohibiting the discharge of garbage into the sea.

Each [marine sanitation] device must have a placard suitable for posting on which is printed the operating instructions, safety precautions, and warnings pertinent to the device. The size of the letters printed on the placard must be one-eighth of an inch or larger. A placard must be posted in a prominent location, durable make, and at least 5in x 8in prohibiting the discharge of sewage into the sea.
