The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with additional requirements which may be established by the company. Due to the objective evidence in the deficiencies noted below, the vessel is not being maintained and not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel's SMS under the ISM code. An external audit conducted by the Flag or RO is required before the ship will be released from its detention to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port. 74 SOLAS (20) XI-1/4.1 ISM Code 10.2

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present Convention to ensure that the ship in all respects will remain fit to proceed to sea without presenting an unreasonable threat of harm to the the marine environment. Chief engineer informed PSCO that incinerator had not worked for approximately one month. PSCO observed engineers attempt to start the incinerator as designed, witnessed a fuel leak at the fuel injectors, and automatic start-up failure. MARPOL I/6.4.1
