The employer shall provide an Employee Assistance Program (EAP) for all crew members [name withheld] education program must include at least the following elements: display and distribution of a community service hot line telephone number for crew member assistance. EAP hot line was not displayed. 46 CFR 16.401

Vessel on oceans route must carry 6 hand orange smoke distress symbols approved IAW Subchapter Q. Orange flares were not meeting requirements of Subchapter Q. 46 CFR 180.68

The training program for a vessel under 46 CFR 175.110(c) must focus on firefighting proficiency. This includes training on firefighting equipment, ignition sources, flammable materials, fire hazards, constant vigilance, actions, fire detection, automatic systems, and fire classification. The program also includes drills required by § 185.524, fire location and type, and emergency egress training for all crew members. This training should occur monthly while employed on the vessel and each time a crew member.No logs were provided showing the crew training for fire fighting and egress. 46 CFR 185.420 (b)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests including;Inspection of the condition of the superstructure, masts, and similar arrangements constructed on the hull, and on a sailing vessel all spars, standing rigging, running rigging, blocks, fittings, and sails. Mouse all shackles on rigging. 46 CFR 176.802(a)(3)

Vessels operated solely within 20 nautical miles of land must be equipped with a VHF-DSC radiotelephone installation meeting the requirements of § 80.1101(c)(2). Missing VHF radio with DSC capability. 47 CFR 80.905 (1)

A vessel that is exposed to salt water more than three months in any 12-month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. The vessel has not completed a drydock examination within the last two years. Conduct satisfactory drydock examination prior to the carriage of passengers.

Alcohol testing must be conducted on each individual engaged or employed on board the vessel who is directly involved in the SMI. The alcohol testing of each individual must be conducted within 2 hours of when the SMI occurred, unless precluded by safety concerns directly related to the incident. There are no alcohol test devices on board the vessel.

The operator of each self-propelled vessel 12 meters or more in length shall carry, on board and maintain for ready reference, a copy of these Rules. The operator did not possess a copy of the Inland Navigation Rules.

Each disposable hydrostatic release unit must be marked with an expiration date of two years after the date on which the unit is installed. The hydrostatic release unit for the EPIRP was not marked with an expiration date.

Gauges to indicate engine revolutions per minute (RPM), jacket water discharge temperature, and lubricating oil pressure must be provided for all propulsion engines installed in the vessel. The gauges must be readily visible at the operating station. The gauges at the operating station were not connected to the propulsion engines and were not functioning. 46CFR 182.410(b)

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. There were dead end wires that were not properly capped originating from the water heater.

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The first-aid kit stored outside was not in a watertight container and was exposed to the elements.

Each vessel must have permanent loading marks placed on each side of the vessel forward and aft to indicate the maximum allowable trim and amidships to indicate the maximum allowable draft. There are no loading marks on the vessel to indicate the maximum allowable draft. To be completed by the next credit drydock.

The cognizant OCMI may require that a vessel and its equipment undergo any additional test or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. The vessel does not have a Preventative Maintenance Plan for the sail rigging required by NVIC 02-16.

Each floating waterlight installed after March 11, 1997, on a vessel carrying only one ring buoy, must be attached to the lanyard with a corrosion-resistant clip. The clip must have a strength of at least 22.7 kilograms (50 pounds), and allow the waterlight to be quickly disconnected from the ring life buoy. The waterlight was attached to the lifeline instead of the ring buoy. 46 CFR 180.70(d)(3)

Unless otherwise provided by this subpart, each vessel required to have a Certificate of Inspection is subject to the annual vessel inspection fee listed in table 2.10-101 for its vessel category. The user fees have not been paid for 2021 or 2022.

Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Vessel does not have installed detectors in required spaces by 27Dec2022. Vessel has been limited to a Limited Coastwise route and no overnight passengers until detector installation has been verified by a Marine Inspector. 46 CFR 181.405(c)

On vessels described by 46 CFR 175.110(c), flammable items not otherwise covered by the regulations of this subchapter, such as rechargeable batteries, including lithium ion batteries utilized for commercial purposes, must be handled, stored, and operated in a way that mitigates the risk of hazardous conditions. Vessel has not submitted plan for lithium ion battery charging. Vessel has been limited to a Limited Coastwise route and no overnight passengers until lithium ion charging plan has been verified by a Marine Inspector. 46 CFR 185.364

For a vessel described by 46 CFR 175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include, but need not be limited to (Listed in cite). Vessel has not shown to have met training requirements. Vessel has been limited to a Limited Coastwise route and no overnight passengers until training has been verified by a Marine Inspector. 46 CFR 185.420(b)

Vessels described by 46 CFR 175.110(d) must submit plans to the cognizant OCMI, in accordance with 46 CFR 176.700, for the installation and use of monitoring device to ensure the wakefulness of the watchmen required in paragraph (a) of this section. The Coast Guard will work with the vessel operators to determine a reasonable implementation schedule once the plans are accepted. The monitoring device(s) must:(1) Ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive; (2) Remain operable during the nighttime watch; and (3) Be arranged to ensure proper coverage of the passenger accommodation spaces, common areas, and spaces with potential fire hazards. Vessel has been limited to no overnight passengers until monitoring device has been verified by a Marine Inspector. 46 CFR 185.410(b)

The master of a vessel described by 46 CFR 175.110(d) must conduct passenger emergency egress drills from the passengers' assigned overnight accommodation spaces prior to beginning an excursion with new passengers. (1)If the passengers are not assigned an overnight accommodation space, the master of a vessel described by 46 CFR 175.110(d) must conduct passenger emergency egress drills from an accommodation space prior to beginning an excursion with new passengers. (2) For the purposes of this section, excursion includes anytime thethe vessel gets underway, or anytime passengers remain overnight on the vessel. Provide plan for conducting passenger egress to OCMI. Vessel has been limited to no overnight passengers until passenger egress plan has been verified by a Marine Inspector. 46 CFR 185.507

A vessel on an oceans, coast-wise, limited coast-wise, or Great Lakes route must carry six hand red flares distress signals and six hand orange smoke distress signals approved in accordance with 46 CFR 160.037 in sub-chapter Q of this chapter, or other standards specified by the Commandant. Vessel did not have adequate amount of distress flares on board. Corrected on the spot.

Each ring life buoy must be marked with type II retro-reflective material approved in accordance with 46 CFR 164.018 or other standard specified by the Commandant.

A mechanically propelled vessel that carries more than 12 passengers on an international voyage must comply with the applicable requirements of SOLAS, as well as this subchapter. Vessel does not have required lifesaving onboard for international route. 46 CFR 175.120

Rail course or the equivalent must be installed between a top rail required by paragraph (a) of this sections, and the deck so that no open space exists that is more that 305 millimeters (12 inches) high except: Bars, slats, rail courses, or an equivalent spaced at intervals or not more than 100 millimeters (4 inches). Due at next drydock. 46 CFR 177.900 (g)(iii)

Operator must submit application for renewal of a Certificate of Inspection to OCMI at least 30 days prior to expiration date of the Certificate of Inspection. Vessel did not schedule inspection prior to expiration date of COI.

Crew is not permitted to sleep on engine room bench.

Each vessel must have adequate emergency lighting fitted along the line of escape to the main deck from all passenger and crew accommodation spaces located below the main deck. Emergency light for passenger accommodation space was inoperable. 46 CFR 183.432 (a)

Each overnight accommodation space on a vessel with overnight accommodations for passengers must be fitted with an independent modular smoke detection and alarm unit in compliance with 181.450. Batteries for alarm in the port berthing area were missing. 46 CFR 181.405
