A hatch cover must: Be attached to the hatch frame or coaming by hinges, captive chains, or other devices of substantial strength to prevent its loss. MI found the port engine room access panel is missing 8 bolts. 46 CFR 179.360(b)

Electrical equipment on a vessel must be installed and maintained to: Minimize accidental personnel contact with energized parts. MI found dead end wire in port void above the fresh water tank. 46 CFR 183.200(c)

Every portable fire extinguisher must be supplied with a suitable bracket which will hold the extinguisher securely in its stowage location on vessels or boats, and which is arranged to provide quick and positive release of the extinguisher for immediate use. MI found multiple extinguisher brackets wasted. 46 CFR 162.028-3(c)

Each window, port hole, and its means of attachment to the hull or deck house, must be capable of withstanding the maximum load from wave and wind conditions expected due to its location on the vessel and the authorized route of the vessel. MI found port aft window cracked. 46 CFR 177.1020

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. MI found port engine room deck plate is unsupported, resulting in unstable surface. 46 CFR 176.830

Electrical equipment exposed to the weather must be watertight. MI found two exterior lights not watertight. 46 CFR 183.210(b)

All electrical equipment and circuits must be clearly marked and identified. MI found electrical panels in the engine room with missing labels. 46 CFR 183.220(d)

Flexible nonmetallic hose may be used in lube oil, fuel oil and fluid power systems, subject to the following requirements: For the purpose of flexibility only, flexible hose installed in lengths of not more than 30 inches and subject to pressures of not more than 35 kPa. Observed that the port generator fuel return line consisted of flex hose for entire length. Install hard piping to the satisfaction of the MI. 46 CFR 182.720(e)(3)(v)

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Observed deck hose line in starboard engine room leaking. Rectify leak to the satisfaction of the MI. 46 CFR 176.800(a)

Electrical equipment and installations must be suitable for the roll, pitch, and vibration of the vessel underway. Observed that the bilge alarm float switches were not adequately mounted in voids #2 and #3, port and starboard. Securely mount float switches to the satisfaction of the MI. 46 CFR 183.220(a)

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Observed that the child life jackets were not separated from adult life jackets. Stow life jackets separately to the satisfaction of MI. 46 CFR 180.78(a)(5)

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with § 80.59 once every five years. Observed that the FCC Safety Radiotelephone Certificate was expired. Provide a current certificate to the satisfaction of the MI. 47 CFR 80.903

All metallic enclosures and frames of electrical equipment must be permanently grounded to the hull on a metallic vessel. Ground wires found detached on both main diesel engines. Reattach to satisfaction of MI. 46 CFR 183.372

Electrical equipment and installations must be suitable for the roll, pitch, and vibration of the vessel underway. Bilge alarm junction box not properly mounted. Mount junction box to the satisfaction of MI. 46 CFR 183.220(a)

Machinery spaces must be separated from accommodation spaces by boundaries that prevent the passage of vapors. Forward bulkhead of port engine room not vapor tight. Make vapor tight to the satisfaction of the MI. 46 CFR 177.405(c)

Piping conveying vapor, gas, or liquid, the temperature of which exceeds 150 °F, must be suitably insulated where necessary to prevent injuries. Exhaust lagging not adequate on port main engine. Install sufficient-sized lagging to satisfaction of MI. 46 CFR 177.970

All cable and wire must be installed with metal supports spaced not more than 24 inches apart, and in such a manner as to avoid chafing and other damage. Metal cable support in overhead of port engine room, outboard aft, found detached from frame. Reinstall support. 46 CFR 183.340(b)(4)

The owner... shall have ready for inspections all accessible parts of the hull, the watertight bulkheads, and weather decks. Excess water found in forward voids, port and starboard. Pump all water out. 46 CFR 176.802(a)(1)

The forward STBD forepeak had cracked weld on second frame / top longitudinal frame meeting point. Make permanent repairs to the satisfaction of the marine inspector. 46 CFR 176.600

Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels. Vessel’s consortium enrollment for the Drug and Alcohol program was expired. 46 CFR 16.230(a)

Each device must be – free of design defects that would allow toxic substances to escape to the interior of the vessel. MI’s observed leaking sewage dripping from port and starboard tank connections into the bilge. 33 CFR 159.95 (a)(1)

Each marine sanitation device must meet all other safety requirements of the regulations applicable to the type of vessel for which it is certified. Portside #2 void sewage piping is being supported by zip ties. Vessel to install permanent supports to the satisfaction of the marine inspector. 33 CFR 159.95(a)(3)

The vessel experienced a small fire in the engine room, resulting in melted wires and engine fluctuations. Provide root cause, determine extent of damages, and undergo visual inspection to the satisfaction of the attending MI. 46 CFR 176.840

Each marine employer shall ensure that random drug tests conducted under this part are unannounced and that the dates for administering random tests are spread reasonably throughout the calendar year. Company has designated a vessel Master to serve as the Company Designated Employer Representative (DER). This arrangement does not allow for a random selection of crewmembers as intended by this regulation. Company to assign responsibilities of DER to an employee that is not one of the members that shall be randomly drug tested as required by this regulation.

Piping, valves, and fittings in a fire main system must comply with subpart G, part 182, of this chapter. Starboard fire main pump has a leaking seal that requires replacement and the port fire main piping is leaking in the machinery space and fuel tank void. Submit plans for repairs to the satisfaction of the attending MI prior to replacement. 46 CFR 181.310(b)

No more than four terminals shall be secured to any one terminal stud in accordance with ABYC E-11 Standard. The battery in the starboard engine compartment has more than 4 conductors secured to the terminal. Submit plans for repairs to the satisfaction of the attending MI prior to replacement. 46 CFR 183.130(a)(2)

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. The sewage tank piping is cracked. 46 CFR 177.100

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. There are dead end wires originating from the fuel purifier in the starboard machinery space. 46 CFR 183.200(b)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. The safety radiotelephony call sign differs from the station license. 46 CFR 184.502

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved in accordance with § 161.012 in subchapter Q of this chapter. There were numerous life jackets lights that were inoperable or missing. 46 CFR 180.75(a)

Each disposable hydrostatic release unit must be marked with an expiration date of two years after the date on which the unit is installed. The hydrostatic release unit for the EPIRB was expired. 46 CFR 185.740(b)

Each survival craft, rescue boat, and launching appliance must be visually inspected to ensure its readiness for use. The painter line for the IBAs were incorrectly attached to the hydrostatic release unit. 46 CFR 185.720(a)

At each initial and subsequent inspection for certification the owner or managing operator shall be prepared to test the steering systems of the vessel and make them available for inspection to the extent necessary to determine that they are in suitable condition and fit for the service intended. The starboard bolt for the steering post was loose. 46 CFR 176.814

Except when individual pumps are provided for separate spaces, individual bilge suction lines must be led to a central control point or manifold and provided with a stop valve at the control point or manifold and a check valve at some accessible point in the bilge line. The bilge lines were not sufficiently marked at the manifold to distinguish the location of the lines. 46 CFR 182.510(c)

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. While re-floating the vessel after drydock, a pinhole leak was discovered under port fire pump strainer mounting bolt. Submit repair proposal and make repairs to satisfaction of attending Marine Inspector.

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. When repairs are made during an emergency, the owner, managing operator, or master shall notify the OCMI as soon as practicable after such repairs or alternations are made. Repairs or alterations that affect the safety of the vessel include, but are not limited to: replacement, repair, or refastening of deck or hull planking, plating, and structural members; repair of plate or frame cracks; damage repair or replacement, other than replacement in kind, of electrical wiring, fuel lines, tanks, boilers and other pressure vessels, and steering, propulsion and power supply systems; alterations affecting stability; and repair or alteration of lifesaving, fire detecting, or fire extinguishing equipment. Vessel has been altered to include a semi-permanent installation of fuel piping from the fuel fill containment, through the deck, and into the engine room. End result is that slop fuel is collected and stored in a 5 gallon bucket secured by a bungee chord in the engine rooms. Master states that this is normal operations for this vessel. Remove buckets, fuel hoses, and ball valves. Plug holes in deck to make watertight.

Each fire hydrant must have a valve installed to allow the firehose to be removed while the fire main is under pressure. Fire station at aft end of house found with seized valve. After repair, test of fire main required once vessel is back in water.

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. During drydock exam, found all but one engine mount bolts sheared on starboard engine. Found several sheared engine mount bolts on port engine. Replace all engine mounting bolts with new. Additionally, found missing bolt on starboard engine raw water inlet flange. Fit flange with bolt.

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. While propellers were off, Bay Propeller found a crack in the starboard propeller. Replace in kind to the satisfaction of attending MI.

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may... require the vessel... to effect permanent repairs. Hole and a soft patch in weather deck was found near the transom above the port side lazarette. Both had been taped and painted over. Operator to submit repair proposal for approval prior to starting repair. Due prior credit drydock.

At each inspection for certification and at every other vessel inspection, the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard or clog bilge pumping systems. Excess accumulation of oil, trash, debris, dust, and storage found in both engine rooms. Clean and prepare both engine spaces in order for full ISE to be completed and hazards removed from spaces. Remove portable fuel containers from vessel.

A fire pump outlet must be fitted with a pressure gauge. Gauge found broken on fire pump. Make repairs to the satisfaction of attending [name withheld] (17OCT2022): Guage fitted, but pup will not come up to pressure and does not register on guage. Giving vessel 30 days to rectify but will not extend.

All cable and wiring must be installed with metal supports spaced not more than 24 inches apart. Wiring all over the vessel was found unsupported or dead ended. Support all necessary wiring and remove all unused wiring to the satisfaction of attending [name withheld] prior to credit drydock.

Each distribution panel and switchboard must be in a dry location as practicable, adequately ventilated, and protected from falling water and debris. Several Blue Seas branded fuse blocks and buses are missing their drip shields. The toilet junction box and port lazarette high water switch junction boxes are wasted and exposed. Make repairs to the satisfaction of attending [name withheld] prior to credit drydock.

The number of penetrations in watertight bulkhead must be minimized..and made watertight. There are three holes in the starboard engine room forward bulkhead. Propose repairs to attending MI prior to commencing work.

Protection from mechanical damage must be specifically considered and all protective covering or shields must be installed to the satisfaction of the cognizant [name withheld] generator raw water hose found chaffed where hose passes through deck hole. Make repairs to the satisfaction of attending MI.

Whenever there is a hazardous condition, as defined by 46 CFR 176.400, on board the vessel, the owner, master, agent, or person in charge shall immediately notify the Captain of the Port of the port of place of destination and the Captain of the Port or place in which the vessel is located of the hazardous condition. Vessel experienced a ruptured drip-less water seal on the starboard tail shaft while operating with passengers onboard. Master got vessel underway, without reporting to Coast Guard, and transited from home port of Monterey to Alameda for emergency drydock. Vessel to make repairs to the satisfaction of the attending Marine Inspector. Marine Inspector will witness set screw install.

The employer must provide an Employee Assistance Program (EAP) for all crew-members. An EAP program was not fully established. No required EAP training conducted. Company must establish an EAP with training conducted for all crew-members, conduct appropriate training, and have designated EAP supervisory level trained personnel.

Employers must ensure that they and their crewmembers meet the requirements of this part. Employers are responsible for the actions of their officials, representatives, and agents in carrying out the requirements of this part. Vessel could not provide pre-employment chemical testing records for all Masters and the last three hires. Company owner to provide records of chemical testing for “ASTS Current Active Employee List” dated 08/16/2022 prior to carriage of passengers.

A pre-engineered fixed gas fire extinguishing system must automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space. Vessel's generators don't secure with activation of port and starboard fire-boys.

Drug testing programs required by 46 CFR Part 16 must be conducted in accordance with 49 CFR 40, Procedures for Transportation Workplace Drug and Alcohol Testing Programs. The company’s drug and alcohol testing program has not met the Procedures for Transportation Workplace Drug and Alcohol Testing requirements since 2019. No Management Information System (MIS) data, required by 46 CFR 16.500, has been provided in accordance with 49 CFR 40.26 for calendar year 2020 or 2021.

Provision must be made for closing all supply duct cowls or scoops and exhaust duct discharge openings for a space protected by a fixed gas extinguishing system. Vessel's aft dampers inoperable.

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. Vessel missing fuel shutoff station labels.

Battery chargers must have an ammeter connected in the charging circuit. The new battery charger installed for the starboard battery bank does not have an ammeter connected in the charging circuit.

Complete but simple instructions for the operation of a fixed gas fire extinguishing system must be located in a conspicuous place at or near each pull box and stop valve control. Vessel's instructions for its fire-boy system illegible.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other person, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Vessel has multiple dead end wires in port lazarette and stbd pump room and one battery cable in the port engine room is missing its sheathing.

Each lighting fixture globe, lens, or diffuser must have a guard or be made of high strength material. Port E/R light cover broken.

A hatch exposed to the weather must be watertight. Vessel's hatches on the starboard side and port lazarette hatch are not watertight. Make watertight by next credit dry dock.

On a vessel of at least 7.9 meters(26 feet) in length, a visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces: a machinery space bilge, bilge well,or other spaces subject to flooding from sea water piping within the space. Vessel's high level alarms inoperable in stbd E/R and stbd pumproom.

A vessel must be provided with a satisfactory arrangement for draining any watertight compartment, other than small buoyancy compartments, under all practicable conditions. Vessel's bilge system incapable of pumping water out of port lazarette space.

Each inflatable liferaft required on a vessel by this part must have a capacity of 6 or more. Vessel rated to carry 156 passengers, however, inflatable liferafts onboard account for a max capacity of 136 persons. Two 50 person, one 30 person, and one 6 person life raft are present. Vessel's max passenger count alotted is 136 until liferafts are verified to account for more passengers. - 46 CFR 180.200

The number and identification of the items stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets. Vessel has no markings to indicate location or size of life jackets on 2nd deck. 46 CFR 185.604(f)

46 CFR 183.200(a) Electrical equipment on a vessel must be installed and maintained to protect passengers/crew from electrical shock. Vessel's switchboard covers in the port engine room have open wiring and pose a hazard to the crew.

Propulsion machinery must be suitable in type and design for propulsion requirements. Vessel's port generator tray is filled with coolant and poses a hazard for normal operation.

A self priming power driven fire pump must be installed on a vessel. The minimum capacity for the pump must be at a pressure of not less than 60 psi at the pump outlet. The vessel's port fire pump has a leak (that needs to be repaired. Also, the starboard pump only outputs a pressure of 50 psi (though adequate hose stream observed).

Electrical equipment must be installed and maintained to protect passengers/crew from electrical hazards. Vessel's overhead light in the port lazarette dos not have a cover and poses a hazard to crew.

Electrical equipment must be installed and maintained to protect passengers/crew from electrical hazards. Vessel's port lazarette has a 110v outlet with no cover. Additionally, the aft house has a 110v recepticle with a twist cover that is missing.

Each vessel certificated to operate on an oceans route in cold water must be provided with inflatable buoyant apparatus of aggregate capacity that will accommodate 100% of the total persons permitted on board. Vessel's 6 person life raft is not installed. Reduced passenger count to 150 total persons on board (147 pax and 3 crew).

Each survival craft must be secured to the vessel by a painter with a float-free link permanently attached to the vessel. The painter for the IBA's was not hooked up to the proper section of the hydrostatic release; and therefore, would not properly break free from the vessel. 46 CFR 180.130(a)

Each survival craft must be stowed so that when the vessel sinks the survival craft floats free and if inflatable, inflates automatically. The hydrostatic releases for the 03 50-person IBA's and the 01 6-person IBA were installed incorrectly. The hydrostatic release rigging was corrected on the spot to the satisfaction of the Marine Inspector. 46CFR180.130(a)(2)

On a vessel on which the number of passengers permitted on upper decks is limited by stability criteria, as indicated by the vessel's stability letter, the maximum number of passengers allowed on an upper deck must be indicated by a durable marking of at least 1 inch numbers and letters at the entranceway to that deck. The vessel does not currently have a marking at the entrance way to the upper deck. Provide marking IAW 46CFR185.602 to the satisfaction of the Marine Inspector.
