SOLAS 1974 II-2 Regulation 21 Currently, All the crew berthing areas (below the bulkhead deck) have two means of escape. However, the second means of escape are in crewmember berthing rooms above the top bunks. Furthermore, the two means of escape for each berthing area lead to a common space (i.e. Lounge/lounges) above the crew berthing areas. Using the forward crew berth as an example: If a fire were to break out in the forward bar (located in the forward lounge) the crew below would have no escape route. The same scenario for the large aft crew berths under the Galley and main passenger lounge. * Submit plans to Coast Guard Marine Safety Center to correct the deficient means of escape from all three crew berths prior to sailing foreign. Until the means of escape meet SOLAS 1974 II-2 Regulations 21, the vessel is restricted to domestic voyages only.

Vessels with a keel laid date after March 28, 2022, must include plans for the monitoring device(s) within the plan submissions required in 46 CFR 116.202. The Coast Guard will work with the vessel operators to determine a reasonable implementation schedule once the plans are accepted. The monitoring device(s) must: (1) Ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive; (2) Remain operable during the nighttime watch; and (3) Be arranged to ensure proper coverage of the passenger accommodation spaces, common areas, and spaces with potential fire hazards. Vessel does not have an installed monitoring device on-board. Provide the following: (1) Submit plans to SEAK OCMI in accordance with 46CFR 115.700, for the installation and use of monitoring within 20 days.(2) Upon review of plan by a Marine Inspector, install and test system in accordiance with the submitted plan. 46CFR122.410

The owner, managing operator, or a qualified servicing facility as applicable shall conduct the following inspections and tests: (1) For portable fire extinguishers, the inspections, maintenance procedures and hydrostatic pressure tests required by Chapter 4 of NFPA 10, (incorporated by reference, see § 114.600 of this chapter) with the frequency specified by NFPA 10. In addition, carbon dioxide and halon portable fire extinguishers must be refilled when the net content weight loss exceeds that specified for fixed systems by Table 115.810(b). The owner or managing operator shall provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility may be required to perform the required inspections, maintenance procedures, and hydrostatic pressure tests. A tag issued by a qualified servicing organization, and attached to each extinguisher, may be accepted as evidence that the necessary maintenance procedures have been conducted. (2) For semiportable and fixed gas fire extinguishing systems, the inspections and tests required by Table 115.810(b), in addition to the tests required by §§ 147.60 and 147.65 of this chapter. The owner or managing operator shall provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility may be required to perform the required inspections, maintenance procedures, and hydrostatic pressure tests.
