If a vessel operates on exposed or partially protected waters, an opening port light is not permitted below the weather deck unless—(1) The sill is at least 30 inches (76.2 centimeters) above the deepest subdivision load line; and(2) It has an inside, hinged dead cover. 1.Portside forward engine room hinged dead cover for port light had a torn gasket; and 2.Starboardside aft engine room hinged dead cover for port light had a missing wing-nut for closing/watertightness. Replace both the gasket and wing-nut to the satisfaction of Marine Inspector. Due prior to credit drydock. 46 CFR 171.119(a)(2)

Provision must be made for closing all supply duct cowls or scoops and exhaust duct discharge openings for a space protected by a fixed gas extinguishing system. All closure devices must be readily available and mounted in the vicinity of the vent. Port damper located in lazarette which is covered by fixed CO2 extinguishing did not close upon test actuation. Damper must be corrected prior to operation of lazarette auxiliary engine. 46 CFR 182.465(h)

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: Spaces protected by carbon dioxide—“CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. WHEN ALARM OPERATES OR WINTERGREEN SCENT IS DETECTED, DO NOT ENTER UNTIL VENTILATED. LOCK OUT SYSTEM WHEN SERVICING.” The reference to wintergreen scent may be omitted for carbon dioxide systems not required to have odorizing units and not equipped with such units. Markings and warnings were not provided for lazarette and machinery spaces protected by fixed CO2 extinguishing. 46 CFR 185.612(g)

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a dry-dock examination and an internal structural examination at least once every two years. As per her COI, vessel is currently outside compliance and can no longer operate under the conditions of her COI. The vessel may operate in the following alternative services, within the limits of the vessel’s current stability letter: (a) as a small passenger vessel, carrying 6 or less passengers without deck cargo, with one licensed master. (b) as a bareboat chartered recreational vessel carrying 12 or less passengers with no crew provided by the Owner/Operator. Vessel must undergo a satisfactory dry-docking in compliance with 46 CFR Sub-chapter T, in the presence of a USCG Marine Inspector, in order to clear this deficiency.

At each initial and subsequent inspection for certification, the owner or managing operator must be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including inspection of controls for each fixed gas fire extinguishing system and detection system to determine that the system is in operating condition. Pressure switches in E/R and lazerette were found to not have been serviced as per records provided from owner. Provide proof of satisfactory servicing of pressure switches, and inform this office what the pressure switches function are, to attending Marine Inspector.

Each disposable hydrostatic release unit (HRU) must be marked with an expiration date of two years after the date on which the unit is installed (or as per manufacturer recommendations). HRO was marked as expired. Replace w/ properly marked HRU to manufacturer specifications. Vessel must stay within 03 miles of a harbor of safe refuge until resolved and made satisfactory to attending Marine Inspector.

Each life jacket carried on a vessel on a coastwise route, must have a life jacket light approved in accordance with § 161.012 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.112. Numerous lifejacket lights were not operable. Until this deficiency is corrected, the vessel is limited to a route that does not extend more than 20 miles from a harbor of safe refuge. Vessel must make life jackets in compliance to the satisfaction of attending Marine Inspector.

A vessel on coastwise route must carry six hand red flare distress signals & six hand orange smoke distress signals. Six hand red flare distress signals can be substituted for six hand orange smoke distress signals. Vessel was missing 08 distress signals. Vessel is limited to short runs approximately 30 minutes away from the dock. Make number and type of distress signals as required for route on COI.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel's testing devices were unavailable. Until such time that valid testing devices are available onboard,vessel must stay within 2 hours of a location to perform the required alcohol tests from the time of occurrence of the SMI. Vessel will need to replace testing devices as required and or show written policy attesting to how the vessel will obtain the devices and conduct the required alcohol tests within 2 hours from the time of occurrence of the SMI.

Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements: (1) Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. (2) Where the station power exceeds 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a general radiotelephone operator license or higher class license. Vessel Master/owner did not have available a Federal Communications Commission Marine Radio Operator Permit. Provide valid Federal Communications Commission Marine Radio Operator Permit.

The person in command of a documented vessel must have on board that vessel the original Certificate of Documentation (COD) currently in effect for that vessel. Vessel did not have valid COD on board. Provide proof of valid COD to attending Marine Inspector.

The owner, charterer, master or managing operator shall instruct each crew member, at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by 46 CFR 185.510. Vessel was not able to produce logged drills for abandon ship and man overboard. Provide next logged drills within 30 days to attending Marine Inspector & continue as internal policy as required by the regulations.

A vessel must carry either a first-aid kit approved under approval series 46 CFR 160.041 or a kit with equivalent contents and instructions. Items in kit were expired/missing. Make kit in compliance with regulations.

Each ring life buoy must be marked in clearly legible block capital letters with the vessel's name. 02 required ring life buoys were not marked with the vessel's name. Have ring life buoy's marked in accordance with regulations and to the satisfaction of the attending Marine Inspector.

The number and identification of life jackets stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets. Letters and numbers must be at least 2 inches high. Containers for life jackets were not correctly marked. Make containers and stowage as required by regulation.

Heat activated device was found to not have been serviced as per records provided from owner. Provide proof of satisfactory servicing of heat activated device in lazerette to attending Marine Inspector.

Markings on vessels IBA HRU were non-existent or unreadable. HRU was installed upside down. Replace with properly marked/ installed HRU to manufacturer specifications. Make satisfactory to attending Marine Inspector.

Each survival craft must be stowed so that when the vessel sinks the survival craft floats free. Float free configuration was not installed correctly on vessel IBA. Correct float free configuration to manufacturer specifications and Marine Inspector satisfaction.

At least one ring life buoy must be fitted with a lifeline. Each lifeline on a ring life buoy must be buoyant; be of at least 60 feet in length; be nonkinking; have a diameter of at least 5 16 inch; have a breaking strength of at least 1,124 pounds; and be of a dark color if synthetic, or of a type certified to be resistant to deterioration from ultraviolet light. Lifeline was not fitted to ring life buoy. Fit appropriate lifeline to ring life buoy.

A vessel must carry one floating waterlight, unless it is limited to daytime operation. Each ring life buoy with a floating waterlight must have a lanyard of at least 3 feet in length, but not more than 6 feet, securing the waterlight around the body of the ring life buoy. Vessel's waterlight was not operational and was not attached to ring life buoy. Make waterlight serviceable and attached to ring life buoy.

On a vessel of more than 65 feet in length, the minimum capacity of the fire pump must be 50 gallons per minute at a pressure of not less than 60 psi at the pump outlet. Vessel's fire pump was operating at 35 psi at the pump gauge. Make pump satisfactory to attending Marine Inspector.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, machinery failure and personnel injury. Vessel's bilge pump belt was loose and began smoking. replace or repair belt to avoid hazardous conditions mentioned above.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date charts of large enough scale to make safe navigation possible. Vessel's chart was not up-to-date. Provide current/corrected charts for operational areas.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. Except when in the judgment of the cognizant OCMI the operation of a vessel does not present one of the hazards listed, the emergency instruction placard should contain at least the applicable portions of the “Emergency Instructions” listed in §185.512. The emergency instructions must be designed to address the particular equipment, arrangement, and operation of each individual vessel. Emergency instruction covering fire aboard vessel is not addressed. Vessel must update emergency procedures as addressed during vessel's annual inspection to address the particular equipment, arrangement, and operation of the vessel.

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by 46 CFR 185.510. Training shall be logged and include: date of the training; and general description of the training topics. Moving forward ensure this instruction is being conducted as required.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: U.S. Coast Pilot or similar publication; Coast Guard Light List; tide tables; and crrent tables. Publications were not available for inspection. Make publications (electronic) available for inspection.

Each survival craft on a vessel must be inspected monthly, using the manufacturer's instructions to make sure it is complete and in good order. Survival craft not being inspected as per regulations. Begin inspecting survival craft as required and document to show compliance.

The master of the vessel shall ensure that each EPIRB must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. The EPIRB test shall be logged. Moving forward, test EPIRB and log as required.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Dead-end wires found under operating station. Remove/make wire in compliance with regulations to satisfaction of attending Marine Inspector.

A FIXED FIRE EXTINGUISHING SYSTEM ABOARD A VESSEL MUST BE APPROVED BY THE COMMANDANT AND BE CUSTOM ENGINEERED TO MEET THE REQUIREMENTS FOUND IN 46 CFR 181.410. A STORAGE CYLINDER FOR A FIXED FIRE EXTINGUISHING SYSTEM MUST BE INSTALLED AT LEAST 2 INCHES BETWEEN THE DECK AND THE BOTTOM OF THE STORAGE CYLINDER. CYLINDERS MUST BE TESTED BY A CG APPROVED FACILITY AT LEAST EVERY 12 YEARS. MI DISCOVERED THAT THE CO2 STORAGE CYLINER IN THE LAZARETTE SPACE WAS ON THE DECK RESULTING IN A SIGNIFICANT AMOUNT OF CORROSION FOUND ON THE BOTTOM PORTION OF THE CYLINDER. LAST KNOWN SERVICE DATE STAMPED ON THE LAZARETTE'S CO2 CYLINDER WAS DEC 2007. VESSEL MUST PROPERLY ARRANGE CYLINDER AND HAVE REQUIRE TESTS/INSPECTIONS PERFORMED ON THIS DEVICE OR PROVIDE PLAN TO REPLACE WITH ACCEPTABLE SYSTEM. VESSEL MAY OPERATE PER COI PROVIDING LAZARETTE GENERATOR IS NOT USED (VESSEL HAS SEPARATE GENERATOR IN ENGINE ROOM) UNTIL CORRECTED.

Prove proper operation of engine room and lazerette fire dampers.

Prove proper operation or provide a 3rd party report of a functionality test of the CO2 systems in the E/R and LAZ.

Replace battery on EPIRB or provide a new EPIRB with NOAA registration.

Provide current alcohol swabs.

Provide 35 adult PFD's with lights & 06 children PFD's with lights.

First aid kit contained expired items. Provide complete and current first aid kit.

Provide alcohol testing devices for all crew.

Provide passenger count ashore.

Conduct EPIRB testing monthly.

Provide public address speakers for all passenger areas.

Hole was found in a fresh water system for the aft head in the flexible hose right after the pipe penetrated the bulk head and entered the engine room. Flexible hose must be replaced with approved flexible hose. 46 CFR 177.01-1

Provide GPS position on VHF-DSC radio.

Replace white 24" lifering with orange 24" lifering.

Renew grab lines on liferings.

Provide 60' of bouyant line and bracket for lifering light.

Provide 12 additional type I adult lifejackets for a total of 65; vessel restricted to 53 persons.
