The master or person in charge of a ship to which this section applies shall ensure that the ship is not operated unless a garbage management plan meeting paragraph (b) of this section is on the ship and that each person handling garbage follows the plan.(b) Each garbage management plan under paragraph (a) of this section must be in writing and—(1) Provide for the discharge of garbage by means that meet Annex V of MARPOL, the Act, and §§ 151.51 through 151.77;(2) Describe procedures for minimizing, collecting, processing, storing, and discharging garbage; and(3) Designate the person who is in charge of carrying out the plan. Provide and post garbage management plan.

The operator of each self-propelled vessel 12 meters or more in length shall carry, on board and maintain for ready reference, a copy of these Rules. Vessel missing inland navigation rules ready reference. Provide a ready reference of the inland navigation rules to the attending marine inspector.

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Vessel's FCC Safety Radiotelephony Certificate expired 22May20. Provide updated Safety Radiotelephony Certificate to the attending marine inspector.

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (2 1/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Vessel's fire buckets were only 2 gallon capacity. Provide fire (3) fire buckets of 2.5 gallon capacity to the attending marine inspector.

Each life jacket must be marked with Type I retroreflective material approved in 46 CFR 164.018 or other standard specified by the Commandant. The arrangement of the retroreflective material applied after March 11, 1996, must be as specified by IMO Resolution A.658(16) (incorporated by reference; see 46 CFR 175.600). (3) child life jackets retroflective tape were faded and peeling. Replace the (3) child life jackets retroflective tape.

Waste receptacles. Unless other means are provided to ensure that a potential waste receptacle fire would be limited to the receptacle, waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom. Vessel had combustible plastic waste receptacles onboard the vessel. Replace all combustible waste receptacles with non-combustible type.

All passenger accommodations must be arranged and equipped to provide for the safety of the passengers in consideration of the route, modes of operation, and speed of the vessel. Port passenger accommodation stairwell top step was loose and missing adequate support. Provide repair and proper support to the stairwell's top step to the attending marine inspector.

Fire, abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: (1) Date of the drill and training; and (2) General description of the drill scenario and training topics. Logs recording drills, training and inspection and testing of lifesavign and firefighting equipment were not available during inspection. Provide logs showing completion of drills, trianign and inspections to attending marine inspector.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. On board alcohol swabs were expired. Provide current alcohol testing devices.

On vessels described by 46 CFR 175.110(d) of this chapter, a passenger safety bill must be posted by the master in each cabin or stateroom, and in passenger accommodation spaces. (b) Each passenger safety bill required by this section must list: (1) The embarkation station and the number and location of the survival craft to which each passenger is assigned, if applicable; (2) The fire and emergency signal and the abandon ship signal; (3) Essential action that must be taken in an emergency; and (4) If immersion suits are provided for passengers, the location of the suits and illustrated instructions on the method of donning the suits. Vessel did not have posted passenger safety bills. Provide passenger safety bills in each bunk room.

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (21/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Two of the three provided fire buckets did not have attached lanyards. Provide three acceptable fire buckets.

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have the following equipment at the operating station: (3) A means to reset devices used to automatically shut down ventilation systems and engines as required by paragraph (a)(3) of this section. The Fire Boy engine shut down override was not functioning. Repair or replace and demonstrate proper operation.

An internal structural examination conducted in compliance with § 176.600 may be conducted while the vessel is afloat or out of the water and consists of a complete examination of the vessel's main strength members, including the major internal framing, the hull plating and planking, voids, and ballast, cargo, and fuel oil tanks. A longitudinal frame and a hanging knee were found delaminating and separating from the hull on the starboard side of the vessel in the lazarette. Provide repair proposal to attending marine inspector.

The owner, managing operator, or a qualified servicing facility as applicable must conduct the following inspections and tests: For fixed-gas fire extinguishing systems, the inspections and tests required by Table 176.810(b) of this section, in addition to the tests required by 46 CFR 147.60 and 147.65. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility may be required to perform the required inspections, maintenance procedures, and hydrostatic pressure tests. No record was available for the annual inspection of the fixed pre-engineered firefighing system installed in the engine room. Provide documentation showing completion of annual inspection and servicing.

Vessels described by 46 CFR 175.110(d) must submit plans to the cognizant OCMI, in accordance with 46 CFR 176.700, for the installation and use of monitoring device to ensure the wakefulness of the watchmen required in paragraph (a) of this section. The Coast Guard will work with the vessel operators to determine a reasonable implementation schedule once the plans are accepted. The monitoring device(s) must: (1) Ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive; (2) Remain operable during the nighttime watch; and (3) Be arranged to ensure proper coverage of the passenger accommodation spaces, common areas, and spaces with potential fire hazards. Plans have not been submitted to the cognizant [name withheld] plans to include electrical load analysis and bill of materials.

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by § 185.510 of this part and, when applicable, the duties listed in the station bill required by § 185.514 of this part. Training must include the items listed in 46 CFR 185.420 (b). in addition, Emergency egress training for each member of the crew, to occur for all members of the crew - (i) At least monthly while such members are employed on board the vessels; and (ii) Each time a crew member joins the crew of such vessel. Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. The training entry shall include the following information. (1) Date of the training; and (2) General description of the training topics.

A person may not employ or engage an individual in a position required to hold an MMC unless that individual maintains a current medical certificate. Vessel's licensed Master did not have medical certificate available for inspection. Provide proof of medical certificate or correspondence from NMC attesting to valid medical certificate.

Except when in the judgment of the cognizant OCMI the operation of a vessel does not present one of the hazards listed, the emergency instruction placard should contain at least the applicable portions of the “Emergency Instructions” listed in § 185.512. The emergency instructions must be designed to address the particular equipment, arrangement, and operation of each individual vessel. Vessel's emergency instructions were not vessel specific. Provide vessel specific emergency instructions.

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (21/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Vessel was missing one bucket and existing buckets require replacement lanyards. Provide 3 properly arranged fire buckets.

Abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: (1) Date of the drill and training; and (2) General description of the drill scenario and training topics. Records were not available for abandon ship drills. Upon questioning, master and crew stated that they held table-top abandon ship training but did not log it. Conduct abandon ship drill and associated log entry.

The master of the vessel shall ensure that: (a) Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative; (b) The EPIRB's battery is replaced after it is used, or before the date required by FCC regulations in 47 CFR part 80, whichever comes sooner; and (c) The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. Log of EPIRB testing was not available. Master and crew attested that EPIRB was tested monthly along with other equipment inspections. Test EPIRB and provide log entry.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. The pilot house was found to have ungrounded electrical outlet.

Public address system not audible in passenger bunk rooms. Provide speakers in all passenger accessible spaces.

Provide a letter for consideration on galley grease hood extraction system.

Provide a current FCC safety certificate.

Fire equipment service expires in July 2020, have equipment serviced.

Life saving equipment servicing expires in July 2020, Have equipment serviced.
