Remote fuel shutoff stations shall be marked in at least 1 inch letters indicating purpose of the valve and direction of operation. Remote fuel shutoff is missing direction of operation. 46 CFR 185.30-20(a)

Portable fire extinguishers shall be installed and located to the satisfaction of the Officer in Charge Marine Inspection. Fire extinguisher in cabin space is being stored on deck and not in a bracket. 46 CFR 181.30-10

Rails or equivalent protection shall be installed near the periphery of all weather decks. Forward handrail base has broken welds.

A hatch cover must be attached to the hatch frame or coaming by hinges, captive chains, or other devices of substantial strength to prevent its loss. Forward peak hatch needs to be adjusted and captive chain securing the hatch in cabin room is missing.

Unless otherwise stated in this section, life jackets must be stored in convenient places distributed throughout accommodation spaces. Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child life jackets are not physically separated from adults.

The employer shall provide an Employee Assistance Program for all crew members that includes both education and training on the effects and consequences of drug and alcohol use. Supervisory personnel must receive at least 60 minutes of training. Conduct chemical testing program compliance audit and provide satisfactory evidence of an Employee Assistance Program.

Aft bulkhead in steering void has major deflection IVO center port & stbd 1st bays. Crop and renew as discussed. Submit a plan proposal for repair prior to starting.

Except as otherwise provided in this section, rails or equivalent protection shall be installed near the periphery of all weather decks accessible to passengers and crews... Rails of a sufficient height not present on fantail or bow.

After loading and prior to departure and at all other times necessary to assure the safety of the vessel, the master shall determine that the vessel complies with all applicable stability requirements in the vessel's ...stability letter, Certificate of Inspection...as the case may be. Operator explained that the vessel utilizes tow bit on main deck as well as periodically operates as a dive boat. Both operating conditions have different implications for the vessel's stability and limitations on either operation shall be addressed on the stability letter. Most recent stability letter from 15OCT2018 indicates "no deck cargo may be carried" and does not mention any variable loads from dive equipment or towing operations authorized.

(a) All vessels of 26 feet in length and over shall be provided with individual bilge lines and bilge suctions for each watertight compartment... except...the space forward the collision bulkhead... (b)...The bilge suctions shall be fitted with suitable strainers having an open area not less than three times the area of the bilge pipe. (c)The individual bilge suction lines shall be led to a central control point or manifold. Each line shall be provided with a stop valve at the control point or manifold and in addition shall be provided with a check valve at some accessible point in the bilge line... The vessel does not have a bilge system in compliance with Old Subchapter T regulations or new Subchapter T regulations. The bilge manifold system addresses the Engine Room and Compartment 3, however, the manifold does not run to the lazzarette or Compartment 2. The engine room suction does not have a strainer and Compartment 3's bilge suction was inaccessible to inspection. There is no installed means of dewatering Compartment 2 and they were multiple electric pumps being utilized without plan approval/OCMI verification.

At each initial and subsequent inspection for certification the marine inspector shall examine and test the... (7) Bilge and drainage systems. The means provided for pumping bilges shall be tested by operation... Bilge suction lines had evidence of oily waste. Operator was unable to test function of bilge system without causing a possible pollution incident.

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate... the recovery of persons who have fallen overboard. Observed crew member currently certified in CPR and 1st Aid unable to demonstrate necessary actions following a man overboard. Conduct sufficient training and familiarization.

...a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible... Vessel had neither printed charts within 6months of inspection or up-to-date electronic charts.

...insure that the main propulsion machinery installed on each vessel is suitable for the vessel and its operation... that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. USCG MI observed diesel fuel collected on top the port engine representing significant fire hazard.

(b) Each battery must be located as high above the bilge as practicable, secured to protect against shifting with the roll and pitch of the vessel, and free from exposure to water splash or spray. There is no battery cover on battery located on the port side of engine room.

Each hatch exposed to the weather must be watertight... Observed no gasket material on main deck hatch covers to engine room representing significant downflooding risk. Operator agreed to revisit an adequate test of watertight integrity after installation of gasket material.

An internal structural examination conducted in compliance with § 176.600 may be conducted while the vessel is afloat... and consists of a complete examination of the vessel's main strength members, including the major internal framing, the hull plating and planking, voids, and ballast, cargo, and fuel oil tanks. Where the internal framing, plating, or planking of the vessel is concealed, sections of the lining, ceiling or insulation may be removed or the parts otherwise probed or exposed so that the inspector may be satisfied as to the condition of the hull structure. The hull plating thickness is recorded as 1/4inch, USCG MI observed significant corrosion in compartment 2 and 3 with gauged pits [1/16,3/32]inch in several areas of compartment 2. Compartment 3 shall be made accessible to USCG MI at the next drydock availability to conduct an internal structures examination of the space.

A Certificate of Inspection is valid for 5 years for all other vessels. Vessel's Certificate of Inspection is expired. Complete a satisfactory COI renewal inspection and obtain a valid COI prior to carrying passengers.

Repair pinhole identified in aft starboard side of lazarette void. Prior to credit dry dock.

Bulkhead penetration between forward void and cabin void not watertight. Repair to make fitting watertight. Prior to Credit DDX.

Cracked deck welds identified in following locations: aft deck port and starboard side, port side middle cleat, starboard side forward cleat. Repair welds. Prior to Credit DDX.

Forepeak gasket worn. Replace gasket to make watertight. Repair prior to credit DDX

Vessel operator failed to provide monthly inspections and testing of vessel's EPIRB.

Vessel requires servicing of starboard fuel oil shut off valve.

Vessel has a cracked weld where deck stringer meats shear strake.

The vessel MILLER BOYS is a SPV T-S (OLD T), therefore not required a safety management system (SMS) per regulation. SECTOR NEW YORK has found the following deficiencies to be objective evidence that a serious substandard condition has not been pro-actively managed by the vessel's owner/operator, leading to a lack of safety culture onboard the vessel. 46 CFR 176.25 - OLD T 46 CFR 176.800

At each inspection for certification and re-inspection the Marine Inspector shall examine the bilges and other spaces to see that there is no accumulation of oil or other matter which might create a fire hazard. There was approximately 4" inches of water and emulsified oil in the engine space bilge, approximately 5" inches of water and fuel oil in the lazarette, and approximately 6" in the midships void space. Clean and dewater all bilge and void spaces. 46 CFR 176.25-50(b) OLD T

At each initial and subsequent inspection for certification, re-inspection and at every other vessel inspection the Marine Inspector shall require that all observed unsafe practices and hazardous situations be corrected. The starboard front window was previously logged as broken in May of 2019 and was found missing. Replace window prior to movement. 46 CFR 176.25-50(a) OLD T

It shall be the duty of the master of any vessel to assure that all exposed hatches are properly secured before getting underway for a voyage on other than protected waters. The forward watertight hatch does not properly secure due to the seized dogging T handle. Replace or repair locking device components. 46 CFR 185.20-15 OLD T

Where flexible nonmetallic hose is permitted for use in piping systems by this section, it must meet SAE J-1942 (incorporated by reference; see 46 CFR 175.600) or be specifically approved by the Commandant. Unapproved fuel hose in use on port and starboard fuel supply lines and on the port side fuel return line. Replaced with approved hose.

In systems and applications where flexible hoses are permitted to be clamped: (1) Double hose clamping is required where practicable. The shaft through hull hose was not double clamped. Double clamp hoses as required. 46 CFR 182.410(d)(1)

The master shall conduct drills and give instructions as necessary to ensure that all crew members are familiar with their duties. Man overboard drills have not been performed since May 2019. Crew must perform MOB drills prior to carrying passengers. 46 CFR 185.25-10 OLD T

The master of a vessel, except a vessel listed in § 185.502(a) of this part, shall keep a correct, written count of all passengers that embark on and disembark from the vessel. Prior to departing on a voyage, the passenger count must be communicated verbally or in writing, and available ashore at the vessel's normal berthing location or with a representative of the owner or managing operator of the vessel. The passenger count shall be available to the Coast Guard upon request. Vessel does not maintain a passenger count onboard and it is not communicated ashore as required. 46 CFR 185.504

Gauges to indicate engine revolutions per minute (RPM), jacket water discharge temperature, and lubricating oil pressure must be provided for all propulsion engines installed in the vessel. The gauges must be readily visible at the operating station. The starboard RPM gauge installed after 1996 is inoperable. Replace RPM gauge. 46 CFR 182.410

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. The vessel had 3 first aid kits missing items and numerous items were expired. Vessel must have a first aid kit with all required contents. 46 CFR 184.710

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (2 1/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Vessel was missing 01 fire bucket. Vessel must procure additional fire bucket. 46 CFR 181.610

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that (3) The pump is permanently mounted. The lazarette submersible electric bilge pump and switch was not permanently mounted. Vessel must permanantly mount bilge pump and switch. 46 CFR 182.520(e)(3)

Each connection to a conductor or terminal part of a conductor must be made within an enclosure. Wires for the forward bilge pump are not connected in an enclosure. Place wire in an enclosure as required. 46 CFR 183.340(g)

Electrical equipment on a vessel must be installed and maintained to: (c) Minimize accidental personnel contact with energized parts. Bridge light is inoperable and hanging from overhead. 46 CFR 183.200(c)

Receptacle outlets and attachment plugs for portable lamps, tools, and similar apparatus operating at 100 volts or more, must have a grounding pole and a grounding conductor in the portable cord. An ungrounded portable space heater was found in the main cabin. Crew immediately removed the space heater from the vessel. 46 CFR 183.370(b)

Alcohol-testing devices must be used according to the procedures specified by the manufacturer of the testing device and by this part. Vessel had 03 expired alcohol testing devices onboard. The crew replaced the exipred devices with new ones. 46 CFR 4.06-3(a)(2)

As appropriate for the intended voyage, all vessels must carry adequate and up-to-date- (a) Charts; (h) All other nautical publications necessary. Vessel had outdated charts and NAVRULES. Provide up to date charts and NARULES. 46 CFR 185.20-35 OLD T

ALL ELECTRICAL RECEPTACLES EXPOSED TO THE WEATHER SHALL BE WEATHERTIGHT. THE ELECTRICAL JUNCTION BOX ON TOP OF THE PILOT HOUSE WAS DAMAGED AND NOT WEATHERTIGHT. 46CFR183.05-35(b) OLD T

ALL NAVIGATION LIGHTS SHALL BE COMPLIANT WITH THE INLAND RULES OF NAVIGATION. THE STARBOARD SIDE NAVIGATION LIGHT WAS NOT SECURED TO THE MOUNTING PLATE, LIMITIN THE AFFECTIVE ARC OF VISIBILITY. VESSEL IS LIMITED TO DAYLIGHT TRANSIT UNTIL RECTIFICATION.

ELECTRICAL INSTALLATIONS SHALL BE MADE TO THE SATISFACTION OF THE [name withheld] WAS A DEAD END WIRE COMING OFF OF THE STARBOARD SIDE HORN INSTALLATION. 46CFR183.01-15(a)

Life floats were replaced with IBAs, this change resulted in known aggregate weight change of 471lbs. The vessel last underwent a stability test in 1995. Vessel must address stability to the satisfaction of [name withheld] count reduced to 13, and total persons reduced to 15.

Properly install DSC-capable VHF radio and program MMSI number.

Label high water alarm in operating station for lazarette.

Provide aspirin for first aid kit.

Enclose loose wires identified in engine room in a junction box.
