The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. The deficiency issued on 01MAR2026 under MISLE activity #8318126 for expired pyrotechnics located in all 18 lifeboats and bridge provide evidence of a failure of the implementation of the vessels' SMS IAW Chapter 1, Marine Procurement, section 1.02 Emergency Purchase Procedure that describes as an emergency requisition any "good and services needed to avert a potential immediate and direct negative impact to: safe, reliable and compliant ship operation". The purchase order for pyrotechnics was placed 13NOV2025, but not processed until 07JAN2026; and not identified as an emergency requisition. An internal ISM audit and record of corrective actions, including actions to prevent recurrence IAW ISM 9, is required. 74 SOLAS (20) IX/3.1 ISM Code 10.1

Fire doors in main vertical zone bulkheads, galley boundaries and stairway enclosures, the approximate time of closure for hinged fire doors shall be no more than 40 s and no less than 10 s from the beginning of their movement. The uniform rate of closure for sliding fire doors shall be of no more than 0.2 m/s and no less than 0.1 m/s. PSCO found the fire door number FSD-03-7-018 located in the crew galley not closing (latching) and the hose port inoperable. 74SOLAS(01)II-2/30.4.2/ Code 17C.

Cylinders must always be secured and, when not in use, they must be stowed in a rack in an upright position, with the valve protection cap in place. PSCO found empty gas cylinders stowed flat in horizontal position, on top of a wood pallet. 46 CFR 147.60(b)(1)/ Code 16C.

Doorways and corridors and intermediate landings included in the means of escape shall be sized in the same manner as stairways. Shall not be less than 900 mm in clear width, the minimum clear width shall be increased by 10 mm for every one person provided for in excess of 90 persons. PSCO found the way, leading to an emergency escape in the engine room blocked by oil drums and machinery parts. 74 SOLAS 01 II-2/28.1.5.3.

Before the ship leaves port and at all times during the voyage, all lifesaving appliances shall be in working order and ready for immediate use. All pyrotechics in 18 lifeboats, the bridge, and 01 bridge wing were expired.

Every crew member with assigned duties shall be famliar with these duties before the voyage begins. PSCO observed multiple members of 05 starboard lifeboat crews that were unable to demonstrate operation of the lifeboat emergency steering. 74 SOLAS 20 III/19.2.1, 16ac

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Vessel reported a hole caused by wastage in a void space below the waterline, causing the void space to floor. Prior to departure, Coast Guard will attend to conduct a satisfactory inspection. Vessel is cleared to depart, deficiency to be rectified at next port for further repair. 74 SOLS (20) I/11(a)

Structural fire protection, including fire-resisting divisions, and protection of openings and penetrations in these divisions, shall be kept in good order so as to ensure their required performance if a fire occurs. FSD 05-07-009 was not closing. SOLAS 74 (81 Amend.) II-2/14.2.1.1.1

A fixed fire detection and fire alarm system shall be so installed and arranged as to provide smoke detection in service spaces, control and accomodation spaces, including corridors, stairways and escape routes within accomodation spaces. 3 Smoke detectors were not operational. Repaired on site. 74 Solas 20 II-2/7.5.2

STEERING GEAR CONTROL SHALL BE PROVIDED FROM THE NAVIGATION BRIDGE. THE STBD AZIPOD FAILED TO MAINTAIN POSITION THREE SEPARATE TIMES DURING OUTBOUND TRANSIT FROM THE BRIDGE. SOLAS Cons. (20) II-1/29.7.1

Within the perimeter of such stairway enclosures only public toilets, lockers of non-combustible material providing storage for safety equipment and open information counters are permitted. PSCOs witnessed medical stretchers and laundry carts stored throughout various crew and passenger stairways.

Fire protection systems and fire-fighting systems and appliances shall be maintained ready for use. PSCO found a fire-extinguisher on deck 6 completely blocked by a couch, extinguisher number 06-3-03. Additionally a manual call point, number 04-04-2 on deck 4 was blocked by various items being stored IN front of it.

All waste-receptacles shall be constructed of non-combustible materials with no openings in the sides of bottom. At least 03 plastic garbage cans were observed by PSCOs in the Solarium on deck 11 and were used to collect linens and plastics.

Doors and door frames in "b" class divisions and means of securing them shall provide a method of closure which shall have resistance to fire equivalent to that of the divisions. The B-15 class door, 01-06-02 in the engine changing room has broken hinges and will not latch.

Crew members shall be trained to be familiar with the arrangements of the ship as well as the location and operation of any fire-fighting systems and appliances that they may be called upon to use. Crew members working in the hair salon and spa identified a flammable storage locker as the primary location for storage of flammable products and chemicals. PSCOs observed a separate closet in the spa "shipshape center" directly outside the male changing area with 17 bottles of flammable products including hairspray and other flammable hair products, not stored in a flammable storage locker.

Crew members shall be trained to be familiar with the arrangements of the ship as well as the location and operation of any fire-fighting systems and appliances that they may be called upon to use. All crew members found to be working in the galley behind the Wind Jammer restaurant were not able to tell the PSCO hot to shut off ventilation for the galley.

Before the ship leaves port and at all times during the voyage all life-saving appliances shall be in working order and ready for immediate use. PSCOS observed lifeboat embarkation light forward of lifeboat number 08 was extinguished.

Every system party member shall, as far as practicable, be further trained by participation in a full deployment of similar system into water either on board a ship or ashore, at intervals of not longer than two years, but in no case longer than three years. PSCO discovered that none of the MES members had been part of a full deployment. Vessel was able to find enough crew members that had participated in a deployment to replace each required member of the MES system. 74SOLAS20 III/19.3.4.8 17C

Every crew member with assigned emergency duties shall be familiar with these duties before the voyage begins. PSCO observed lifeboat crews lacked sufficient knowledge of emergency fuel shutoff locations, emergency steering procedures, and life boat operations. 74SOLAS20 III/19.2.1 17C

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed fractured radiator cap on lifeboat #14 engine preventing radiator from properly operating. 74SOLAS20 III/20.2 16C

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed lifeboat #12 radiator cap on starboard engine was fractured preventing proper closure, starboard engine exhaust sensor was missing, and a temporary unapproved repair to port engine sea pickup piping. 74SOLAS20 III/20.2 16AC

Remote-controlled sliding or power-operated doors shall be equipped with an alarm that sounds at least 5 seconds but no more than 10 seconds before the door is completely closed. A door designed to re-open upon contacting an object in its path shall re-open sufficiently to allow a clear passage of at least 0.75 meters but no more than 1 meter. PSCO observed the following sliding doors reopening more than one meter upon contact: 03-5-005, 05-5-001, 05-7-004, 6-5-012. 74SOLAS9 II-2/30.4.2 50AC

The doors shall be self-closing and be capable of closing with an angle of inclination of up to 3.5 degrees opposing closure, and shall have an approximately uniform rate of closure of no more than 40 seconds and no less than 10 seconds with the ship in the upright position. PSCO observed fire door 4-7-05 did not close during operational test. PSCO also observed the following fire screen doors closing too fast: 02-2-14, 02-2-006, 02-3-008, 02-3-003, 02-4-002, 02-5-001, 03-7-018, 04-3-001, 05-1-007, and 04-7-003. 74SOLAS97 II-2/30.4.1 50AC

The minimum fire integrity of all bulkheads and decks shall be prescribed in tables 26.1 and 26.4. PSCO observed a 1/2" hole surrounded by corrosion in the A-60 boundary between a corridor (Category 3 space) and the embarkation deck between lifeboats #1 and #3 (Category 4 space). 74SOLAS97 II-2/26.1 40AC

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed non-operational self-igniting lifebuoy light on the forward mooring deck. 74SOLAS20 III/20.2 40AC

A fixed fire detection and fire alarm system of an approved type and complying with the requirements of regulation 13 and so installed and arranged as to detect the pretense of fire in such spaces. PSCO observed multiple smoke and heat detectors not operational. The inoperable smoke detectors were (05.07.69.26) and (06.06.58.022). The inoperable heat detector was (06.06) in CHOPS grille. 74SOLAS97 II-2/36 40AC

Before the ship leaves port and at al time during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed wasted bilge piping in lifeboats #4 and #14. 74SOLAS20 III/20.2 40AC

Manually operated call points shall be installed throughout the accommodation spaces, service spaces and control stations. One manually operated call point shall be located at each exit. PSCO observed inoperable call point in the main galley, deck 5. 74SOLAS97 II-2/13.2.2.1 40AC

Furniture shall not be permitted in passenger and crew corridors forming escape routes. PSCO discovered multiple hand sanitation stations in the middle of escare routes. SOLAS 01 II-2/41-2.4.10

The minimum for integrity of all bulkheads and decks shall be as prescribed in tables 26.1 and 26.2. PSCO discovered flammable liquids in a fan room (cat. 10) on deck 3. SOLAS 01 II-2/26

Automatic sprinkler, fire detection and fire alarm systems shall be capable of immediate operation at all times and no action by the crew shall be necessary to set it in operation. PSCO discovered a clogged sprinkler head in the aft mooring deck. SOLAS 01 II-2/12

Fixed fire detection, fire alarm systems, automatic sprinkler, fire detection and fire alarm systems. PSCO discovered multiple fire detectors from deck 7 through deck 13 were inoperable. SOLAS 01 II-2/36

A vessel equipped with ballast tanks that operates in the waters of the us must install and operate a ballast water treatment system installed in accordance with 33 CFR 151.2035(b). Vessel reported that BWTS was not in compliance with US BWTS ultraviolet intensity requirements. Vessel will follow plan submitted by operator which will allow treatment to IMO standard until all piping is replaced in order to meet US standard.

14614- WHILE SHIPS ARE OPERATING WITHIN AN EMISSION CONTROL AREA, THE SULPHUR CONTENT OF FUEL OIL USED ON BOARD SHIPS SHALL NOT EXCEED 0.10% M/M AFTER 1 JANUARY 2015. ON 20 APRIL 2019, FROM 0153 TO 0202, 0225 TO 0226, 0228 AND 0931 TO 1159 (EASTERN STANDARD TIME) THE VESSEL WAS OUT OF COMPLIANCE WITH ECA SULPHER CONTENT OF FUEL OIL USED ON BOARD. MARPOL 73/78 ANNEX VI REG 14.4.3

0799- Furniture shall not be permitted in passenger and crew corridors foarming escape routes. A table with liquor display on deck 11 was located in a passenger corridor. 74 SOLAS (97) II-2/41-2.4.10

Above the bulkhead deck there shall be at least two means of escape from each group of spaces. The B-15 door between the ship's bar & crew mess on deck 3 was taped shut with masking tape on both sides and was also blocked with a decorative plant. The crew could not open the door without cutting the tape. SOLAS (97), Ch. II-2/28.2.

The construction of all doors "A" class divisions shall provide resistance to fire as well as the passage of smoke and flame. The hose port springs in FSD 06-7-001 & 06-05-017 were wasted and not keeping the hose ports closed. SOLAS (97), Ch. II-2/30.2.

Means of initiating the transmission of ship to shore distress alerts by a radio service operating through the Inmarsat geostationary satellite service by an additional ship-earth station. The ship's INMARSAT-C radio service became inoperable during its fire and abandon ship drills.

Above the bulkhead deck, there shall be at least two means of escape from each group of spaces. A cleaning locker in the galley on deck 04, starboard side has been turned into an office: a room in a room. SOLAS (97), Ch. II-2/28.2.

The minimum fire integrity of all bulkheads and decks shall be as prescribed in tables 26.1 to 26.4. The ventilation duct in the 95 Garbage / Ash Room has damaged insulation. SOLAS (97), Ch. II-2/26.1.

Fire fighting systems shall be kept in good working order and readily available for immediate use. One water mist fire extinguishing system spray head in the EDG room and in the port side steering gear room were covered with paint. SOLAS 74 (2001 Con. Ed) II-2/28.1.2

Above the bulkhead deck there shall be at least 2 means of escape from each main vertical zone. Emergency escape watertight door portside on the 4th deck aft mooring was locked allowing only one exit for escape.
