A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements:(1) Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. Vessel's master did not have a Marine Radio Operator Permit or higher license at the time of inspection. Obtain a Marine Radio Operator Permit or higher license and provide proof to attending marine inspector.

On a vessel of not more than 19.8 meters (65 feet) in length carrying more than 49 passengers, and on a vessel of more than 19.8 meters (65 feet) in length, each hose must:(1) Be lined commercial fire hose that conforms to UL 19 (incorporated by reference, see 46 CFR 175.600) or hose that is listed and labeled by an independent laboratory recognized by the Commandant as being equivalent in performance. The fire hose burst from an approximate dime size hole during fire main test. Hose had some areas where the outer layer was completely worn. Fire hose was replaced on site with SAT test. Deficiency rectified.

On a vessel of not more than 19.8 meters (65 feet) in length carrying more than 49 passengers, and on a vessel of more than 19.8 meters (65 feet) in length, the minimum capacity of the fire pump must be 189 liters (50 gallons) per minute at a pressure of not less than 414 kPa (60 psi) at the pump outlet. The pump outlet must be fitted with a pressure gauge. During test of the fire main the pump was unable to produce more than 50 PSI at the pump outlet gauge. Diagose and repair and demonstrate adequate fire main system pressure.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel only had 2 testing devices and carried up to 6 crew.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; (2) U.S. Coast Pilot or similar publication; (3) Coast Guard Light List and (4) Tide tables. Current publictions were not available on board.

No person may transport a hazardous material in commerce unless the hazardous material is transported in accordance with applicable requirements of this subchapter, or an exemption or special permit, approval, or registration issued under this subchapter or subchapter A of this chapter. Vessel transports hazardous material in the form of camp sotve fuel brought on by passengers. Vessel must fully comply with the applicable requirements of 49 CFR 171-176 or apply for a special permit under 49 CFR 107.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. The hydraulic steering pump located in the port engine space was found with hydraulic oil soaked lagging in way of a valve, indicating a leak beneath. Repair leak and replace lagging.

Fill pipes and sounding pipes must be so arranged that overflow of liquid or vapor cannot escape to the inside of the vessel. Fuel tanks use a sight glass constructed of flexible tubing and fitted with shut-off valves which were found open. The open valves would not prevent discharge of fuel into the machinery space in the event of fire or mechanical damage. Reminded vessel that valves must remain closed when not actively sounding tanks and ensured valves were shut prior to completion of inspection.

A vessel must comply with the applicable requirements for any radio and EPIRB installations, including the requirements for a station license and installation certificates to be issued by the FCC. Vessel's FCC safety radiotelephony certificate was found expired. Upon survey of radio equipment vessel's single sideband (SSB) was found in need of repair and FCC SRC was endorsed only for a 20 mile route. Until SSB is repaired and a revised FCC SRC is issued, vessel is restricted to the following route: PACIFIC OCEAN, NOT ON AN INTERNATIONAL VOYAGE, BETWEEN THE SAN LUIS OBISPO / MONTEREY COUNTY LINE: 35–47.5 DEGREES NORTH LATITUDE AND 32 -15 DEGREES NORTH LATITUDE, NOT MORE THAN 20 MILES FROM THE MAINLAND SHORE. A VOYAGE FROM THE MAINLAND TO SANTA CRUZ ISLAND AND ANYWHERE WITHIN 2 MILES OF SANTA CRUZ ISLAND IS CONSIDERED TO BE WITHIN THE SCOPE OF THIS ROUTE.
