On a merchant vessel of the United States the construction of which began after March 4th, 1915..(5) each crew berthing area shall be equipped with information regarding-(A) vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage; and (B) procedures and resources to report crimes, including sexual assault and sexual harassment, including information-(i) on the telephone number, website address, and email address for reporting allegations of sexual assault and sexual harassment to the Coast Guard;(ii) on vessel owner or company procedures to report violations of company policy and access resources; (iii) on resources provided by outside organizations such as sexual assault hotlines and counseling;(iv) on the retention period for surveillance video recording after an incident of sexual harassment or sexual assault is reported; and (v) additional items specified in regulations issued by, and at the discretion of, the Secretary of the department in which the Coast Guard is operating. (d) In each washing space in a visible location there shall be information regarding procedures and resources to report crimes upon the vessel, including sexual assault and sexual harassment, and vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage. The purpose of this part is to ensure a dependable, independent, and dedicated emergency power source with sufficient capacity to supply those services that are necessary for the safety of the passengers, crew, and other persons in an emergency. Emergency light/exit sign on the stbd side museum is inoperable. 46 CFR 112.05-1(a)

Suitable hand covers, guards, or rails shall be installed in way of all exposed and dangerous places… Deck is wasted on stbd side of the flying bridge. Close off space to passengers until repairs are made. 46 CFR 92.25-15

(a) In General.-The owner of a vessel subject to inspection under section 3301 shall- (1) ensure that such vessel is equipped with a vessel master key control system, manual or electronic, which provides controlled access to all copies of the vessel's master key of which access shall only be available to the individuals described in paragraph (2); (2) establish a list of all crew, identified by position, allowed to access and use the master key and maintain such list upon the vessel, within owner records and included in the vessel safety management system; (3) record in a log book information on all access and use of the vessel's master key, including- (A) dates and times of access;(B) the room or location accessed; and (C) the name and rank of the crew member that used the master key; and(4) make the list under paragraph (2) and the log book under paragraph (3) available upon request to any agent of the Federal Bureau of Investigation, any member of the Coast Guard, and any law enforcement officer performing official duties in the course and scope of an investigation. Existing structure previously approved will be considered satisfactory so long as it is maintained in good condition to the satisfaction of the Officer in Charge, Marine Inspection. Minor repairs and alterations may be made to the same standard as the original construction. Vessel was found to have 20+ holes in the side shell below the deepest loaded waterline. Temporary, unapproved repairs, were attempted by the crew. Make permanent repairs to the satisfaction of the OCMI prior to movement. 46 CFR 92.01-90

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: (a) Spaces storing carbon dioxide—“CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. VENTILATE THE AREA BEFORE ENTERING. A HIGH CONCENTRATION CAN OCCUR IN THIS AREA AND CAN CAUSE SUFFOCATION.”. (b) Spaces protected by carbon dioxide—“CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. WHEN ALARM OPERATES OR WINTERGREEN SCENT IS DETECTED, DO NOT ENTER UNTIL VENTILATED. LOCK OUT SYSTEM WHEN SERVICING.” The reference to wintergreen scent may be omitted for carbon dioxide systems not required to have odorizing units and not equipped with such units. Paint locker was found to not have required signage. Affix signage in all appropriate areas. 46 CFR 97.37-11

Under the authority if 46 U.S.C. 3313 and 46 U.S.C. 3710, a certificate of inspection issued to a vessel may be suspended or revoked if a vessel is found not to comply with the terms of its certificate or fails to meet a standard required by this chapter. During the COI renewal inspection, Marine Inspector found that the vessel was not complying with all the terms listed on the COI. The vessel is required to comply with its own operations manual and the terms listed on the COI. The following are required by the manual and are were not being completed by the crew: Man Overboard and Abandon ship drills that are required monthly were not being conducted. Specific crewmembers and staff are required to be certified in CPR and First Aid by Red Cross or equivalent. None of the crew/staff were current. USCG Approved life-rings are required to on board at locations listed on COI, but the life-rings were damaged and beyond service life. COI requires USCG approved portable fire extinguishers, but two were found not in their required brackets. Make corrections to the satisfaction of the attending Marine Inspector within 30 days. 46 CFR 2.01-20

It shall be the duty of the owner, master, or person in charge to see that the vessel's firefighting equipment is at all times ready for use and that all such equipment required by the regulations in this subchapter is provided, maintained, and replaced as indicated. Four required portable extinguishers onboard had servicing tags showing they were overdue for inspection as of Aug. 2022.

Except as noted in this subpart or subpart 91.05, no vessel subject to inspection and certification shall be operated without a valid certificate of inspection. Vessel's COI expired on 05OCT2022 and passengers were carried after this date.

Where natural ventilation is provided for spaces protected by carbon dioxide extinguishing system, provisions shall be made for easily and effectively closing off the ventilation. Paint locker on starboard forward main deck has CO2 protection with no way to secure natural ventilation pipe.

Fire pumps, hydrants, hose and nozzles shall be installed on all self-propelled vessels. Numerous fire station cutout valves appear to be seized in the closed position. Prove proper operation of each fire station cutout supply valve. 46CFR95.05-5(a)(1)

Fires axes shall be distributed throughout the spaces available to persons on board so as to be most readily available in the event of emergency. Fire axes were discovered to be ziptied to there brackets making them not readily available. Remove the zipties on all fire axes. 46CFR95.60-10

Where natural ventilation is provided for spaces protected by a carbon dioxide extinguishing system, provisions shall be made for easily and effectively closing off the ventilation. The emergency diesel generator ventilation closure was missing the required gasket. Install gasket to make closure air tight. 46CFR95.15-35

Any vessel using the navigable waters of the United States or any port subject to the jurisdiction of the United States must have a Certificate of Financial Responsibility. Vessel's COFR was expired. Renew COFR. 33CFR138.15

All firehose must be subjected to a test pressure equivalent to the maximum pressure to which they may be subjected in service, but not less than 100 psi. Fire hoses were not ready for hydrostatic test. Complete hydro test in presence of CG within 30 days. 46 CFR 91.25-20(a)(4)

At each inspection for certification and at other times necessary, the inspector will determine that all fire-extinguishing equipment is in suitable condition. Annual servicing is overdue for all required portable and fixed fire fighting onboard. Conduct proper servicing and provide local OCMI with documentation for all overdue fire fighting equipment prior to allowing passengers onboard. 46 CFR 91.25-20

All dead-end lines shall extend at least 2 inches beyond the last orifice and shall be closed with cap or plug. CO2 piping in port and starboard paint lockers do not extend 2 inches at dead-end. Storage of flammable materials prohibited in both paint lockers until proper piping installed. 46 CFR 95.15-15(e)

Complete but simple instructions for the operation of the systems must be located in a conspicuous place at or near all pull boxes, stop valve controls and in the cylinder storage room. No instructions provided for operation of CO2 protecting paint lockers. Post instructions for operation of paint locker CO2 system. 46 CFR 95.15-10(h)

ISE was due 30NOV18. Complete ISE within 30 days.

Fire hoses were not ready for hydrostatic test. Complete hydro test in presence of CG within 30 days.

Install emergency escape/exit signage at the end of shaft alley within 30 days.

Rope off area to restrict passenger access on stack deck in engine room where insufficient rails protection is in place within 30 days.

Submit proposal to improve rails in boiler room flats intended to be accessible to passengers, install within 60 days of plan approval. Prevent passenger access to the identified areas until cleared.

Provide (1) new 50ft fire hose.

Provide federal COFR.

Provide transfer procedures.

Lock electric panel on bridge.
