The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. Objective evidence indicates that the company has failed to ensure proper reporting procedures and preventative maintenance including, but not limited to, failure to follow NTVRP reporting procedures, failure to document unapproved modification to OWS, excessive oil accumulation in the engine room, multiple lifebuoy lights extinguished, and cargo securing procedures not being followed. An external audit shall be carried out by the administration or the RO prior to the ship being released from detention. SOLAS (20)IX/3.1 ISM CODE 10.1

Except as specified in paragraph 3 of this regulation, any ship of 10,000 gross tonnage and above shall be fitted with oil filtering equipment complying with paragraph 7 of this regulation. PSCO observed a manual three way valve fitted after the automatic three way valve, allowing bypass of automatic 3 way valve. MARPOL 1/14.2

In the event of such discharge of oil or oily mixture[...] or in the event of accidental or other exceptional discharge of oil not excepted by that regulation, a statement shall be made in the Oil Record Book Part 1 of the circumstances of, and the reasons for, the discharge. PSCO observed missing ORB entries pertaining to a fuel oil leak in cargo hold 3, bay 26, row 8 and subsequent cleanup activities. MARPOL 1/17.3

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. PSCO observed excessive oil in the engine room, oil in catch basins in the purifier room, dripping from overhead piping and others. SOLAS (01)II-2/15.2

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed multiple self-lighting life buoys unable to turn on. SOLAS (2020) III/20.2

All cargoes...shall be loaded, stowed, and secured throughout the voyage in accordance with the cargo securing manual approved by the administration. PSCO observed minimum of 01 container not properly lashed. 74 SOLAS (2020) VI/5.6

The function of the detection system shall be periodically tested to the satisfaction of the Administration by means of equipment producing hot air at the appropriate temperature or smoke or aerosol particles having the appropriate range of density or particle size. PSCO observed crew member use an open flame for testing the flame detection system. 74 SOLAS (01) 11-2 reg. 13.1.13

The position of the load line of the ship corresponds with the certificate. The PSCO observed the load line did not match the load line certificate (ICLL 88 Article 21(1)(b))

74SOLAS(14)V/19.2.1.4 An electronic chart display and information system (ECDIS) is also accepted as meeting the chart carriage requirements of this subparagraph. Ships to which paragraph 2.10 applies shall comply with the carriage requirements for ECDIS detailed therein; back-up arrangements to meet the functional requirements of subparagraph .4, if this function is partly or fully fulfilled by electronic means. PSCO observed the ship was unable to bring the #2 ECDIS online and did not have paper charts on board to supplement the requirements of having back-up means for navigation.

10(c); 74SOLAS(04) II-1/29.12.2: Hydraulic Power-operated steering gear shall be provided with the following: A low-level alarm for each hydraulic fluid reservoir to give the earliest practicable indication of hydraulic fluid leakage. Low-level alarm in NO. 3 steering motor was inoperable.

13MAR14: VESSEL WAS ISSUED AN IN-BOUND LETTER OF DEVIATION FOR AN INOPERABLE S-BAND RADAR.

Vessels main machinery for propulsion not operable.

Vessel did not have a copy of approved NTVRP on board to reference during pollution incident. Vessel only had approval letter for plan. 33 CFR 155

Modifications were made to the hydro flow (hydro pneumatic potable water) tank for PMS reasons by the ships crew. Original modifications were approved by classification society. However mild steel was used instead of stainless steel or galvanized steel as required by class. Class is to verify repairs. ILO/SOLAS I-11
