Fixed fire detection and fire alarm systems for periodically unattended machinery spaces. PSCO found the vessels installed fixed fire detection system in the engine room was not operational. The vessel has installed two household style smoke detectors above each main engine. 74 SOLAS (1997)CH II-2 REG 14.1-.3

Machinery spaces of category A containing internal combustion machinery shall be provided with: One of the fire-extinguishing systems required by paragraph 1.1. After review of service certificates for the ships fixed fire extinguishing system PSCO discovered the findings from servicing companies 12SEP2024 report as follows: Cylinders 3 years overdue for hydrotest, Cylinders Low in CO2/Empty and are currently ineffective, hoses not replaced at 10 years and are showing damage and need replaced, alarm switch has been removed and should be reconnected, pin to hold center valve actuator in place is missing and needs to be replaced, blow through of manifold, distribution valve test not completed as no air compressor available on board. During visual inspection of system and piping PSCO observed heavy corrosion to system and piping. 74 SOLAS (1997)CH II-2 REG 7.2.1

Every oil fuel pipe, which, if damaged, would allow oil to escape from a storage, settling or daily service tank situated above the double bottom, shall be fitted with a cock or valve directly on the tank capable of being closed from a safe position outside the space concerned in the event of a fire occurring in the space in which such tanks are situated. PSCO observed crew attempting to operate all five remote fuel shut offs all five failed to operate. 74 SOLAS (1997)CH II-2 REG 15.2.5

The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. During inspection in the vessels engine room PSCO’s carbon monoxide detector alarmed alerting to detectable presence of Carbon Monoxide, additionally PSCO observed a cloudy haze in engine room, and identified the distinct smell of engine exhaust, suggesting a significant exhaust leak.

During inspection in the vessels engine room PSCO’s carbon monoxide detector alarmed alerting to detectable presence of Carbon Monoxide, additionally PSCO observed a cloudy haze in engine room, and identified the distinct smell of engine exhaust, suggesting a significant exhaust leak. 74 SOLAS (2004)CH I REG 11

Where necessary, oil fuel and lubricating oil pipelines shall be screeened or otherwise protected to avoid oil spray or oil leaks on to hot surfaces or into air intakes. The PSCO observed oil pooling on the flange of the turbo charger. 74 SOLAS (1997)CH II-2 REG 15.5.1

In spaces where penetration of oil products is possible, the surface of insulation shall be impervious to oil or oil vapours. Lagging was missing adjacent to pipe leading to turbo charger resulting in oil accumulation. 74 SOLAS (1997)CH II-2 REG 18.6

The following basic principles underlie the regulations in this chapter and are embodied in the regulations as appropriate, having regard to the type of ships and the potential fire hazard involved: restricted use of combustible material. The engine room was found to be housing active batteries in wood box fixtures. 74 SOLAS (1997)CH II-2 REG 2.2.3

Fire hoses shall be of non-perishable material approved by the Administration and shall be of sufficient in length to project a jet of water to any of the spaces in which they may be required to be used. During testing of ships main fire pump PSCO observed one of the two hoses to have 100s of pin hole leaks throughout the length of the hose. 74 SOLAS (1997) CH II-2 REG 4.7.1

For ships constructed on or after 1 October 1994, the alternative means to be provided in accordance with the provisions of paragraph 3.3.3 shall be an independently driven, power operated emergency fire pump with its source of power and sea connection located outside the machinery space. PSCO observed vessel has no emergency fire pump on board to test. 74 SOLAS (1997)CH II-2 REG 4.3.3.1

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in a normal manner. There was exposed electrical wiring present in the engine room. 74 SOLAS (2004)CH II-1 REG 45.1.3

Machinery spaces of category A shall be adequately ventilated so as to ensure that when machinery or boilers therein are operated at full power in all weather conditions including heavy weather , an adequate supply of air is maintained to the spaces for the safety and comfort of personal and the operation of machinery. PSCO observed a fan identified by crew as the engine room ventilation fan had been electrically disconnected and not operational. 74 SOLAS (2004)CH II-1 REG 35

The lights prescribed in these Rules (Subpart C) shall have an intensity as specified in Annex I to these Rules (33 CFR part 84). When directed to energize navigational lighting PSCO observed multiple navigation lights were not energized. 33 CFR 83.22(b)

Passenger ships of less than 500 gross tonnage where the total number of persons on board is less than 200 may comply with the following: They shall carry on each side of the ship inflatable or rigid liferafts of such aggregate capacity as to accommodate the total number of person on board. Unless arrangements allow for easy side to side transfer, additional liferafts shall be provided so that the total capacity available on each side shall accommodate 150% of total number of persons onboard. The PSCO observed that the vessel was issued a Passenger Ship Safety Certificate back in May of 2024 which authorized the carriage of 100 adult passengers and 20 child passengers, and a minimum safe manning document requiring a crew of 10 . However, the vessel only has two 25 person liferafts, one on port and one on starboard. 74 SOLAS (1997)CH III REG 20.1.5

Any required fire detectionshall be capable of immediate operation at all times. Smoke alarm shall be operational located on the bridge.

Bilge wells in periodically unattended machinery spaces shall be monitored in such a way that the accumulation of liquids is detected at normal angles of trim and heel. High water level float switch found to be inoperable.

A self-propelled vessel of 65 feet or more in length, engaged in commercial service must have on board a properly installed, operational Coast Guard type-approved AIS Class A device. An AIS is not installed on board. Clear NLT 60dayS 33CFR164.46(b)

Main and Emergency switchboards shall be so arranged as to give access without danger to personnel. Nonconducting mats or grating shall be provided at the front of the switchboard. vessel switchboard has missing plugs on front of switchboard that may expose crew to electrical shock. A nonconducting mat is not installed infront of the switchboard. 74SOLAS(04)II-1/45.2

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. The light cover in the galley is missing, causing exposed wires and light element. 74SOLAS(04)II-1/45.1.3

Each vessel must have Marine charts of the area to be transited, published by the National Ocean Service, U.S. Army Corps of Engineers, or a river authority that Are of a large enough scale and have enough detail to make safe navigation of the area possible and Are currently corrected. 33CFR164.33(a)

The fitting of effective screens, to prevent the oil fuel in the case of spillage through the terminations of the sounding pipes from coming into contact with a source of ignition. Starboard side fuel oil vent flame screen is functional due to corrosion. 74SOLAS(97)II-2/15.2.6.1.2

The machinery...shall be designed and constructed adequate for the service which they are intended and shall be installed and protected as to reduce to a minimum any danger to persons on board. #1 Ship Generator's temperature and oil gauges are not working; turbo intake hose to manifold is saturated with oil; and missing valve cover breather. 74SOLAS(04)II-1/26.1

Water tight decks, trunks, tunnels...shall be of the same strength, as watertight bulkheads. Port side deck trunk and Steering trunk's hatch gaskets are not properly sealing. 74SOLAS(04)II-1/19.1

Found vessels loadline painted over and not contrasting in color. The ring, lines and letters shall be painted in white or yellow on a dark background or in black on a light background. They shall also be permanently marked on the sides of the vessels to the satisfaction of the assigning authority.

Every part of the crew accommodation, except store rooms, shall be kept free from stores and other property not belonging to or provided for the use of persons for whom that part of the accommodation is appropriated, and in particular no cargo shall be kept in any part of the crew accommodation.

Main fuel shutoff operational remote shut offs require maintenance.

Control of oil discharge. Repair/replace sight glass valves for daily fuel tank. Engineer stated that vessel's sight glass valve is showing improper level due to faulty valve. Engineer used a wire-tie strap to keep valve open.

Remove fuel-oil from engine room bilge. Vessel's engine room bilge had approximately 10 gallons of oil/fuel.

Remove all fuel oil soaked contaminants from vessel.

Vessels wood planks located on main deck are soaked with fuel. Vessel need to remove oil soaked planks from vessel and replace.

The vessel's cargo loading door gasket is 4 inches short from top of the seal. Vessel must replace this missing edge of the gasket.

Satellite EPIRB must comply with performance standards. EPIRB is not registered with the vessel's admin and does not transmit vessel data when energized.

The master and chief mate shall have the minimum knowledge, understanding and proficiency, required for the certification they currently hold, listed in STCW code Part A, column 2 of table A-II/2. FOTU O SAMOA II crew members do not have appropriate STCW training for carriage of dangerous goods in packaged form.

A ship of 100 GT or more must have containment capacity around each fuel vent or fuel fill pipe that has a capacity of at least 21 gallons; or equip each fuel vent or fuel fill pipe with a portable container of at least 5 U.S. gallon capacity when fueling.

Every ship shall be provided with fire hoses complying with applicable requirements in SOLAS Ch. II-2. One fire hose on the upper deck is missing a spray nozzle.

The cargo loading ramp gasket was found in a wasted condition. A four inch long section of gasket was found severed and a ten inch section of gasket is warped which prevents a weathertight seal.

At least two self contained breathing apparatuses additional to those required by SOLAS Ch. II-2 regulation 17 shall be provided for carriage of dangerous goods. FOTU O SAMOA only maintains two SCBAs onboard for fire fighting purposes.

A life jacket complying with the requirements of the Code shall be provided for every person on board the ship. There were no adequate life jackets for all crew members on board. 74 SOLAS 09 III/2.1

Rescue boat shall be in a state of continuous readiness for launching and in a position suitable for launching and recovery. Rescue boat launching arrangements unable to maneuver freely making the launching of the rescue boat inefficient and dangerous to crew members. 74 SOLAS 01 III/14

Not less than 12 rocket parachute flares shall be carried and stowed on or near the bridge. Vessel only had 02 smoke signal, 04 hand flares, and 03 parachute flares on board. 74 SOLAS 09 III/6.3

A line-throwing appliance complying with the requirement of section 7.1 of the Code shall be provided. It should include no less than 4 projectiles and four lines. There are no line-throwing appliances on board the vessel. 74 SOLAS 09 III / 18

Emergency fire pump shall be independent riven with its source of power and sea connection located outside the machinery space. Portable fire pump serving as emergency fire pump of vessel could not provide satisfactory water pressure. 74 SOLAS 01 II-2 / 4.3.3.3.1

Ships shall carry at least two fireman's outfits complying with the requirements of paragraph one. All fireman outfits on board the vessel were in a state of disrepair. 74 SOLAS 01 II-2 / 17.3

Any required automatic fire detection and fire alarm system shall be capable of immediate operation at all times. All smoke detectors in bridge area were inoperable. 74 SOLAS 01 II-2 / 12.1.1

Vessel must have a fixed containment under or around tank vent overflow and fill pipe to comply with regulation 33 CFR 155.320 (b)

The administration shall provide the ship with appropriate document as evidence of compliance of construction and equipment with the requirements of this regulation. Vessel does not have a Document of Compliance for the Carriage of Dangerous Goods. 74 SOLAS 09 II-2 / 54.3

Vessels carrying dangerous goods shall comply with table 54.1 of Reg. 54. 74 SOLAS 01 II-2 / 54.3

To ensure the safe operation of each ship and to provide a link between the Company and those on board, every company should designate a person or persons ashore having direct access to the highest level of management. There is no one designated as a DPA or contact information for that person in the vessel's SMS manual. 74 SOLAS 09 IX/3.1, ISM Code 4

The company should ensure that the master is: fully conversant with the Company's safety management system. The master stated that he was familiar with the ISM Code and SMS principles; however, when asked questions pertaining to the SMS, he was not competent with critical sections and was unable to clearly articulate the requirements of the vessel's SMS. ISM Code 6.1.2

The Company should ensure that all personnel involved in the Compay's safety management system have an adequate understanding .... Vessel's officers were not familiar with SMS procedures and guidelines to include unfamiliarity of submission of Non-Conformity reports, lack of knowledge of monthly maintenance inspections, and critical sections of he vessel's SMS. ISM Code 6.4

Non-Conformities, accidents and HAzardous conditions: Vessel does not have any adequate life jackets for crew on board, all smoke detectors in bridge area are inoperable, portable emergency fire pump cannot provide adequate pressure, and all fireman outfits on board the vessel are in state of disrepair, ; however, no non-conformity reports were made to the company. ISM Code 9.1

Procedures, to ensure that the ship is maintained in conformity with relevant rules and regulations: The ship’s maintenance checklists do not include weekly tests and inspections of survival craft and launching appliances, an inspection required by SOLAS, and there is no record of any lifesaving appliance inspections having taken place. Also, last monthly inspection was conducted on 28AUG14

The company should establish procedures, to ensure that the ship is maintained in conformity with relevant rules and regulations. In meeting these requirements, the company should ensure that any non-conformity is reported with its possible cause. Vessel's crew have not submitted any non-conformity reports to the company for action to be taken. ISM Code 10.2.2

Establish procedures, to ensure that the ship is maintained in conformity with relevant rules and regulations.There are no records on board the vessels of non-conformity reports being submitted, of quarterly inspection conducted by Maritime surveyor as per SMS manual, of yearly inspections by ACEO Maritime as per SMS manual, and last record of monthly inspection is from 20AUG14. ISM Code 10.2.4

The company should carry out internal safety audits on board and ashore at intervals not exceeding 12 month to verify whether safety and pollution-prevention activities comply with the safety management system. Upon request, the vessel captain could not provide proof of when the last company internal audit was completed. ISM Code 12.1

Company shall ensure that seafarers, on being assigned to any of their ships, are familiarized with their specific duties. No crew members on board received crew familiarization training upon reporting on board vessel. STCW 2010 Amend Reg I/4.2.4 and I/14.5

The Passenger Ship Safety Certificate (PSSC), the Cargo Ship Safety Equipment Certificate (CSSEC), and the Cargo Ship Safety Radio Certificate (CSSRC) shall be supplemented by a Record of Equipment. Vessel's PSSC, CSSEC, and CSSRC are not supplemented by a Record of Equipment. 74 SOLAS 09 I/12 (a)(vi)

The certificates and records of equipment shall be drawn up in the form corresponding to the models given in the appendix to the present Convention. Vessel's PSSC, CSSEC, and CSSRC are not drawn up in accordance with corresponding models. 74 SOLAS 09 I/15

The International Oil Pollution Prevention (IOPP) Certificate shall be drawn up in the form corresponding to the model given in appendix II. Vessel's IOPP Certificate not drawn up in accordance with corresponding model and missing required supplemented Record of Equipment. MARPOL ANNEX I Ch. 2 / Reg. 9

The International Air Pollution Prevention (IAPP) Certificate shall be drawn up in a form corresponding to the model given in appendix I. Vessel's IAPP Certificate not drawn up in accordance with corresponding model and missing required supplemented Record of Equipment. MARPOL ANNEX VI Ch. 2 / reg. 8

The form of the International Tonnage Certificate shall correspond to that of the model given in Annex II. Vessel's International Tonnage Certificate is missing reverse of certificate. ITC, 1969 Article 9

The International Load Line Certificate (ILLC) shall be drawn up in the form corresponding to the models given in Annex III to the present Convention. The vessels ILLC in accordance with the corresponding form It is missing the "Date of initial or periodical survey" and pages for endorsement of surveys. LOAD LINES Article 18

Discharge of oil prohibited placards are not posted as required.

Port side anchor ladder railing is wasted at top.

No waste management plan on board.

Vessels nav lights are in need of repair as indicated by a missing globe and a garbage bag used to protect light from rain and several spare bulbs failed to illuminate.

Navigation light indicator pannel is not fully operational as indicated when lamp test failed to illuminate all lamps.

Hydrostatic release is not marked for expiration on 25 man liferaft.

Vessel is not equiped with a sewage treatment tank/holding tank. Remove toilets or install type I, II, III sanitation device.
