0940 - In order to discharge ballast water in the waters of the United States, the vessel must use a Ballast Water Management System (BWMS) type approved by the US Coast Guard, use an Alternate Management System (AMS), or use ballast with water from the US Public Water System (PWS) according to the schedule in paragraph (b) of this section.This existing vessel, keel laid in 2004, with a ballast capacity of 37664 cubic meters, dry-docked in DECEMBER 2016 has passed its compliance date and has not installed a BWMS or AMS. Prior to discharging untreated ballast water in the waters of the United States, the vessel must comply with one of the approved ballast water management methods listed in 33 CFR 151.2035(a).
