The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. Vessel failed to comply with SMS Chapter F Section 1.0 - Defect and Damage Reporting & Monitoring which states it is the master's responsibility to inform Port State Control of all defects. The operational nature of the deficiency provides objective evidence of a failure of the implementation of the ISM code. An internal ISM audit report satisfactory to the OCMI must be conducted within 90 days.
