Each survival craft on a vessel must be in good working order and ready for immediate use before the vessel leaves port and at all times when the vessel is underway. Observed that both of the life floats' retroreflective tapes were faded and peeling. Replace with new tape to the satisfaction of the MI. (46 CFR 185.700(a))

A vessel must carry one floating waterlight, unless it it limited to daytime operation.. Observed that the ring life buoy's waterlight would not activate; battery is expired. Replace battery to enable proper illumination to the satisfaction of the MI. (46 CFR 180.70(d))

At least one ring life buoy must be fitted with a lifeline. Observed that the line was worn and deteriorating. Replace line to the satisfaction of the MI. (46 CFR 180.70(c))

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Observed dead-end wires in the void underneath the toilet head. Cap the dead-end wires to the satisfaction of the MI. (46 CFR 183.200(b))

Vapor barriers must be provided where insulation of any type is used in spaces where flammable and combustible liquids or vapors are present, such as machinery spaces and paint lockers. Observed wiring from the void underneath the toilet head extending towards fuel tank space missing a vapor barrier. Insulate the hole surrounding the wiring to become vapor-tight. (46 CFR 177.405(e)

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. The EPIRB battery is expired. Vessel is limited to within 3 miles from shore until replaced. 46 CFR 180.64

Oceans, coastwise, limited coastwise, and Great Lakes routes. A vessel on an oceans, coastwise, limited coastwise, or Great Lakes route must carry— (1) Six hand red flare distress signals approved in accordance with § 160.021 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.121; and (2) Six hand orange smoke distress signals approved in accordance with § 160.037 in subchapter Q of this chapter, or other standard specified by the Commandant. Vessel only has 4 valid red flare distress signals, all others have expired. Vessel is limited to 30 minute runs until all flares are onboard. 46 CFR 180.68(a)

Alcohol testing must be conducted on each individual engaged or employed on board the vessel who is directly involved in the SMI. The alcohol testing of each individual must be conducted within 2 hours of when the SMI occurred, unless precluded by safety concerns directly related to the incident. Vessel has one expired alcohol testing kit onboard. Vessel is restricted to transits within 2 hours of an approved alcohol testing facility until new kits are onboard. 46 CFR 4.06-3(a)(1)(i)

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that the pump is permanently mounted. The bilge pump sensor in the main accommodation space is not permanently mounted. 46 CFR 182.520(e)(3)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances, including the following inspection of all accessible parts of the exterior and interior of the hull, the watertight bulkheads, and weather decks. The space for the anchor line is not weathertight and is allowing water ingress. 46 CFR 176.802(a)(1)

A vessel is inspected for compliance with the standards required by this subchapter. The fresh water intake pipe is split at the connection to the tank. 46 CFR 176.800(a)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The first aid kit have expired medication. Vessel is to remove all expired medication and replace with current medication. 46 CFR 184.710

At each initial and subsequent inspection for certification, the marine inspector may require that an abandon ship or man overboard drill be held under simulated emergency conditions specified by the inspector. Vessel did not have enough crew to conduct drills. 46 CFR 176.808(g)

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. Vessel has not had drydock examination and has lapsed. Resolve prior to carriage of passengers. 46 CFR 176.600(c)(1)

A vessel must comply with the applicable requirements for any radio and EPIRB installations, including the requirements for a station license and installation certificates to be issued by the FCC, as set forth in 47 CFR part 80. Vessel's FCC Radio Telephony Certificate was not onboard.

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high. Fuel shutoff markings are partially peeled off.

Each survival craft required on a vessel by this part must meet one of the following: (4) For a buoyant apparatus - Approved under approval series 160.010 or other standard specified by the Commandant. Each buoyant apparatus must have Type II retroreflective material meeting subpart 164.018 of this chapter on each side and end. The material must be in strips at least 50 mm (2 in.) wide extending from top to bottom over the side or end and continuing over the top and bottom surfaces of the apparatus. Retroreflective material on the lifefloat is deteriorated. 46 CFR 180.200(a)(4) and 46 CFR 160.010-4(p).

Each disposable hyrdostatic release unit must be marked with an expiration date of two years after installation and replaced once expired. Hydrostatic release uniit on EPIRB is expired. Operations restricted to SF Bay.

Vessel did not complete annual inspection: Vessel must undergo an annual inspection within the 3 months before or after each anniversary date.

When, in accordance with §178.210 of this chapter, a vessel must be provided with a stability letter, the stability letter... Current stability letter invalid due to the vessel being repowered and none of the new installed equipment has been approved by OCMI.

A bilge suction must be fitted with a suitable strainer having an open area not less than three times the area of the bilge pipe. Forward void bilge suction is missing strainer. 46 CFR 182.510(b)

A hatch cover must be attached to the hatch frame or coaming by hinges, captive chains, or other devices of substantial strength to prevent its loss. Lazarette and engine room hatch covers do not have functioning captive chains. 46 CFR 179.360(b)(2)

A vessel on an oceans, coastwise, limited coastwise, or Great Lakes route must carry six hand red flare distress signals approved in accordance with §160.021 in subchapter Q of this chapter, and six hand orange smoke distress signals approved in accordance with §160.037 in subchapter Q of this chapter. A hand red flare distress signal approved in accordance with §160.021 in subchapter Q of this chapter may be substituted for any of the hand orange smoke distress signals. Vessel was missing one hand red flare or hand orange smoke distress signal. 46 CFR 180.68(a)(1), (2), and (c)(2)(ii).

The floating waterlight must be attached around the body of the life float. Light was attached to an open end line which would have disconnected during launch. 46 CFR 180.175(f)(4)

Each survival craft must be secured to the vessel by a painter with a float-free link permanently attached to the vessel. The float-free link must be secured to the painter at one end and to the vessel on the other end. Painter lines were not attached to either life float due to broken spring clips. 46 CFR 180.130(a)(1) and 180.137(b)(3).

Stencil incorrect one side and grab line deteriorated.

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicatingpurpose of the valve and direction of operation. Fuel shutoff valves were not marked.

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. The OCMI may also decrease the drydock examination intervals to monitor the vessel's structural condition. The HERON was found with the following areas of actual damage or suspect areas in need of further evaluation to be conducted at the next dry-dock. Bow Void: weeping from under internal strip plank in the port fwd upper corner & slight staining of the bilge Void 2: fractured transverse frame in need of repair & weeping section in the aft stbd corner above chine Void 3: fractured transverse frame in need of repair Engine Room: repair leaking shaft seals and wet exhausts & remove all coatings from bottom longitudinal frames which appeared fractured 12" forward of the after bulkhead for evaluation Lazarette: repair weeping rudder log and renewed rotted section of the deck above the fuel tank.
