The SMS should ensure the compliance with mandatory rules and regulations. Vessels fire detection system was determined to be faulty on 08AUG2024. No notifications to the RO, Bureau Veritas, the issuing authority of the Cargo Ship Safety Construction certificate were made. 74 SOLAS (20) IX/3 ISM code 1.2.3.1

Any required fixed fire detection & fire alarm system with manually operated call points shall be capable of immediate operations at all times. PSCOs found faulty fire detection in fire zones 4 & 6. rendering alarms inactive. 74 SOLAS(01) II-2/13.1.1

Each survival craft shall be stowed in a state of continuous readiness so that two crew members can carry out preparations for embarkation & launching in less than 5 min. PSCOs determined the vessel has no means to secure embarkation for port & starboard aft life rafts & FWD port life raft. 74 SOLAS (20) III/13.1.3

Where the emergency source of electrical power is a generator, it shall be started automatically upon failure of the main source of electrical power supply. PSCO observed non-approved battery charger for emergency generator. SOLAS (Cons 04) II-1/43.3.1.2

Every oil fuel pipe, which, if damaged, would allow oil to escape from a storage, settling or daily servce tank, shall be fitted with a cock or valve directly on the tank capable of being closed from a safe position outside the space concerned in the event of a fire occuring in a space in which such tanks are situated. PSCO observed zone 2 fuel shut off valves in engine room were inoperable. SOLAS (Cons 01) II-2/15.2.5

Ships shall be designed, constructed and maintained in compliance with the structural, mechanical, and electrical requirements. PSCO found a temporary patch on the engine housing of auxiliary generator #1, not approved by class. 74 SOLAS (2004) CH II-1, Part A-1, Reg. 3-1

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present conventions. Vessel does not have proper bottle brush per OWS manufacturer specifications for weekly testing. MARPOL 73/78 Annex I, Reg 6, 4.1

All lifesaving appliances and arrangements shall comply with the applicable requirements of the Code. Hydrostatic release unit didn't have proper expiration date and serial no. didn't match maintenance certification. 74 SOLAS (2014) III/34. LSA Code 4.1.6.3

General Arrangement Plans shall be permanently exhibited for guidance of the ship's officers showing clearly for each deck the control stations and the various fire sections enclosed by "A" Class division. In accordance with the vessel's fire control plan, the stairway to the bridge was required to have "A" boundaries. The Port State Control officer observed a door in this stairway not closing properly and failing to maintain the "A" boundary.

IN A SHIP IN WHICH OIL FUEL IS USED, THE ARRANGEMENTS FOR THE STORAGE, DISTRIBUTION AND UTILIZATION OF THE OIL FUEL SHALL BE SUCH AS TO ENSURE THE SAFETY OF THE SHIP AND PERSONS ON BOARD. PSCO OBSERVED NUMEROUS AND EXCESSIVE FUEL LEAKS FROM MAIN ENGINE CONSTITUTING AN ONGOING, IMMEDIATE, AND EXTREME FIRE HAZARD. 74SOLAS(2001 Cons ed.) II-2/15.2

WHERE THERE ARE CLEAR GROUNDS FOR BELIEVING THAT THE MASTER OR THE CREW ARE NOT FAMILIAR WITH ESSENTIAL SHIPBOARD PROCEDURES RELATING TO THE PREVENTION OF POLLUTION BY OIL. PSCO OBSERVED 3.37 CUBIC METERS OF OIL UNACCOUNTED FOR AND ADDITIONALLY FOUND FUEL TRANSFER BETWEEN TANKS HAD BEEN LOGGED USING INCORRECT CODES BY EVERY ENGINEER WHO HAS SERVED ONBOARD FOR AT LEAST THE PAST YEAR. MARPOL 2017 Cons Annex 1/11.1

OIL RECORD BOOK SHOULD BE COMPLETED ON EACH OCCASION, ON A TANK TO TANK BASIS IF APPROPRIATE, WHENEVER ANY OF THE FOLLOWING MACHINERY OPERATIONS TAKES PLACE IN THE SHIP; COLLECTION AND DISPOSAL OF OIL RESIDUES. PSCO OBSERVED 3.37 CUBIC METERS OF OIL UNACCOUNTED FOR. MARPOL 2017 Cons ed. Annex 1 Reg 17/2.3

1420 – (Cleanliness of engine room) - The condition of the ship and its equipment shall be maintained after survey to conform with the provisions of the present regulations to ensure the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. The PSCO observed main fuel line on MDE had a fuel oil leak dripping at a constant rate. – SOLAS 1974 (2001 Cons) Chapt. I, Reg. 11 (a) 60a

0620 – (Inflatable liferafts) – Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed that starboard liferaft painter line was in poor material condition. – SOLAS 1974 (2014 Cons) Chapt. III, Reg. 20 17a

1675 – (Ships Radar Transponder) – Every ship shall be provided with a search and rescue locating device capable of operating either in the 9GHz band or an frequencies dedicated for AIS. PSCO observed that the batteries for both search and radar transponders on board expired on May 2018. – SOLAS 1974 (2014 Cons) Chapt. IV, Reg. 7.1.3 17a

0750 – (Fire prevention) – The fire resistance of the doors shall, as far as practicable, be equivalent to that of the division in which they are fitted. PSCO observed that all fire resistant doors in the accommodation stairwell had no gasket material with air gaps at the bottom allowing light to protrude. – SOLAS 1974 (2001 Cons) Chapt. II-2, Reg. 47 17a

9900 – (Other (not clearly hazardous) ) – The termination of the sounding pipes are fitted with self-closing blanking devices and with a small-diameter self-closing control cock located below the blanking device for the purpose of ascertaining before the blanking device is opened that oil fuel is not present. Provision shall be made so as to ensure that any spillage of oil fuel through the control cock involves no ignition hazard. PSCO observed DOT missing self-closing device weight. Sludge oil and bilge water collecting tank devices would not self-close. – SOLAS 1974 (2001 Cons) Chapt. II-2, Reg. 15.6.1.3 16a

1710 – (Oil Record Book) – Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book Part I, so that all entries in the book appropriate to that operation re completed. PSCO observed multiple entries in the ORB that list discharge of sludge and DOT not using proper codes. Provide corrective action plan with concurrence of Administration.. – MARPOL (2011 Cons. Ed.) Annex I, Reg. 17.4 16a

0715 – (Detection) – The following fire protection system shall be kept in good order so as to ensure their required performance if a fire occurs; fire detection and alarm systems. PSCO observed a smoke detector covered in the fuel oil purifier room. – SOLAS 1974 (2014 Cons) Chapt. II-2, Reg. 14.2.1 10c

9900 – (Other (not clearly hazardous) ) – Each ANOA must contain all of the information items specified in Table 106.206. PSCO observed that the Nationality of the vessel’s Master was provided incorrectly on the ANOA. – 33CFR Part 260.206(a)(4)(iii) 10c

PSCOs noticed two large dents in hull of starboard quarter that were not addressed during last hull survey. Cite: SOLAS(14) I/11(a); 40a

The crew was not ale to provide a proper test of the OWS. The valves were found to be rusted & could not provide efluent to the system. MARPOL Annex 1 Reg. 14.1; 40a

0720-Paint lockers shall be protected by a water spraying or sprinkler system. Vessel ahd numerous cans of paint stored in the f'ocsle. SOLAS04 Ch. II-2/ 10.6.3.1.3- 17c

0750- The construction of doors in "A" class divisions shall provide resistance to fire as well as to the passage of smoke and flame equivalent to that of the bulkheads in wich the doors are situated. Paint locker door was unable to close. SOLAS(04) Ch. II-2 9.4.1.1.2

0750-Fire Prevention- Means shall be provided to control leaks of flammable liquids. PSCO observed an excess of fuel oil that had leaked from the fuel rail on the ships main engines into the bilge.-74 SOLAS am II-2/4

1410- Propulsion Main Engine- After survey of ship no change shall be made in the structural arrangements, machinery, equipment and other items covered by the survey without sanction of the administration. PSCO observed repair on the fuel rail of ships main engine.-74 SOLAS am. I/11 (a)

0750- Fire Prevention- No electrical equipment shall be installed in any space where flammable mixtures are able to collect or in paint lockers or similar spaces. PSCO observed an electrically driven ventilation fan located in the paint locker. 74 SOLAS am. II-1/45.10

0830- Pipes wires (insulat) - All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. PSCO observed exposed wires on the cargo hatch crane emergency stop switch. 74 SOLAS am. II-1/45.1.3

0611 - The administration shall ensure that such life saving appliances and arrangements shall comply with the requirement of this chapter and the code. The equipment of every lifeboat shall consist of food rations and be kept in an airtight packaging and stowed in a water tight container. Food rations in the freefall lifeboat are not in airtight packages. 74SOLAS(09) III reg 4.2, LSA CH IV 4.1.5.

Prior to entering the Port of Beaumont, TX the owner submitted a NOA for the vessel with multiple discrepancies. Specifically 1 position/duties of the master, 2 country of registry, 3 date of issuance of the company's DOC, 4 date of issuance of vessel's SMC, 5 the date of issuance of the ISSC and 6 & 7 two persons were listed as persons in addition to the crew that were no longer onboard.
