After any survey of the ship under article 14 has been completed, no change shall be made in the structure, equipment, arrangements, material, or scantlings covered by this survey, without sanction of the administration. Crew discovered crack in hull at STBD frame 30-31 on22DEC2023 and notified company on the same day. On 28DEC2023 the company arranged to have a temporary concrete patch applied over the observed crack. PSCO observed concrete patch to be leaking sea water into the engine room. Vessel completed additional temporary repairs to the satisfaction of the attending Class surveyor. Permanent repairs remain outstanding and must be completed to the satisfaction of the attending Class surveyor, and the Coast Guard. ICLL (88 Proto) Article 15 15 A,C

The company continued to operate the vessel without making permanent repairs to a 5-foot fracture in the starboard side shell of the engine room below the waterline and lower deck plates since 22 Dec 2023. Vessel Captain confirmed that the installed temporary concrete patch allowed the ingress of water at 100 liters per hour. The company failed to notify and receive authorization for temporary repairs from class or administration, despite a class survey of the vessel on 26 Jan 2024. The company and vessel failed to notify the port state, U.S. Coast Guard, over four U.S. port calls including a port state control examination completed in Houston, TX. International Load Line Certificate invalidated due to alterations made after survey with no approvals from class or administration. ICLL (88 Protocol) Article 15 30 A,C

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. In meeting these requirements, the company should ensure that: a non-conformity is reported. After discovery of a 5-foot crack in the side of the vessel the company failed to report the structural failure to class. Recommend external audit. 74 SOLAS (20) IX/3.1 ISM CODE PART A/10.2.2 30 A,C

Means shall be provided to control leaks of flammable liquids. PSCO observed multiple oil leaks on generators 1, 2, and 3, including multiple oil-soaked rags creating additional fire hazards. 74 SOLAS (20) II-2/4.1.1 30AC

5. Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. PSCO observed A fire hose station and fire extinguisher inaccessible due to storage of boxes impeding access to the fire-fighting equipment. Additionally, the PSCO observed portable fire extinguisher #28 was missing a pin and the nozzle bracket was detached from the extinguisher. PSCO could not verify the extinguisher was in good working order. 74 SOLAS (20) II-2/ 14.2.1.2 17AC

Escape routes shall be maintained in a safe condition, clear of obstacles. PSCO observed an escape trunk access hatch blocked by boxes rendering it inaccessible in an emergency. 74 SOLAS (20) II-2/12.1.2 17AC

FIRE FIGHTING SYSTEMS AND APPLIANCES SHALL BE KEPT IN GOOD WORKING ORDER AND READILY AVAILABLE FOR IMMEDIATE USE. PSCO OBSERVED ONE FIRE SUIT HELMET WITH A BROKEN VISOR AND AN ADDITIONAL HELMET MISSING FLASH HOOD/NECK COVERING.

THE FOLLOWING FIRE PROTECTION SYSTEMS SHALL BE KEPT IN GOOD ORDER SO AS TO ENSURE THEIR REQUIRED PERFORMANCE IF A FIRE OCCURS: STRUCTURAL FIRE PROTECTION, INCLUDING FIRE-RESISTING DIVISIONS AND PROTECTION OF OPENINGS AND PENETRATIONS IN THESE DIVISIONS. PSCO OBSERVED FIRE BOUNDARY DOORS IN LAUNDRY, A/C ROOM, AND THE WORK SHOP TO E/R STORES DOOR MARKED AS SELF-CLOSING ON FIRE CONTROL PLAN, BUT MISSING SELF-CLOSING DEVICES. ADDITIONALLY FOUND THE A-0 DOOR LEADING FROM WATER CLOSET TO MAIN STAIRWELL MISSING SELF-CLOSING DEVICE.

DOORS REQUIRED TO BE SELF-CLOSING SHALL NOT BE FITTED WITH HOLD-BACK HOOKS. PSCO OBSERVED HOLD-BACK DEVICES ON THE FOLLOWING DOORS: DRY STORES, FWD A CLASS DOOR IN GEN SPACE, AND PAINT LOCKER.

PSCO OBSERVED INOPERABLE BWMS. FLAG STATE DISPENSATION STATES VESSEL MUST REPORT TO COASTAL STATES PRIOR TO ARRIVAL SECTOR HOUSTON RECIEVED NO PRIOR COMMUNICATION REGARDING BWMS.

15106 - Shipboard operations - The company should establish procedures plans, and instructions, including checklists as appropriate for key sipboard operations concerning the safety of the personnel, ship, and protection of the environment. safety management system manual does not address fire-fighting equipment maintenance, tests, or inspections to include high pressure CO2, portable extinguishers, foam applicators, ect. In addition, enclosed space entry procedures were vague regarding entry permits and air monitoring, as demonstrated by crew. Recommend internal audit be conducted within 90 days.74Solas(20)IX/6 ISM Code 7

14503 - Garbage management plan - Every ship of 100 gross tonnage and above, and every ship which is certified to carry 15 or more persons, and or floating platforms shall carry a garbage managment plan which the crew shall follow. While in Houston for 14 days, garbage was stored in refer to combat decomposition. Garbage managment plan does not indicate this as an approved storage location.MARPOL Annex V/10.2

09113 - Access/structure - No change shall be made in the structural arrangments, machinery, equipment, and other items covered by the survey, without the sanction of the administration. PSCO observed a portable reefer strapepd to a mooring winch fluid tank in the main deck passageway.74SOLAS(04)1/11

09209 - Electrical - Electrical installations shall be such that the safety of passengers, crew, and ship from electrical hazards will be ensured. PSCO identified broken ground strap on crane winch motor and exposed wire on incinerator.74SOLAS(04)II-1/40.1.3

07124 - Maintenance of fire protection systems - Fire fighting systems and appliances shall be in good working order and available for imediate use. PSCO observed a hose for a foam applicator in the upper engine room with a hole, a ratchet strap impeding a firehose box near the incinerator from opening properly, and a portable extinguisher with extreme wear on deck.74SOLAS(04)II-2/14.2.1.2

Doors fitted in boundary bulkheads of machinery spaces of category A shall be reasonably gas-tight and self closing. PSCO observed 2 self closing A class doors to upper engine room unable to close properly as well as the A class self closing door to the emergency diesel generator space.74SOLAS(04)II-2/9.4.2.2

07103- DIVISIONS-DECKS,BULKHEADS AND PENETRATIONS- WHERE "A" CLASS DIVISIONS ARE PENETRATED, SUCH PENETRATIONS SHALL BE SUITABLY INSULATED BY EXTENSION OF THE INSULATION AT THE SAME LEVEL OF THE DIVISION.
