In meeting these requirements, the company should ensure that: inspections are held at appropriate intervals; any non conformity is reported, with its possible cause, if known; appropriate corrective action is taken; and records of these activities are maintained. The company should establish procedures to ensure that ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The technical and operational nature of deficiencies 2-10, 12, and 14 provide objective evidence of a serious failure of the implementation of the ISM Code. An external audit report satisfactory to the OCMI must be submitted prior to clearance of this deficiency. 74SOLAS (20) IX/ 3.1 , ISM CODE 10.2

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the fuel oil shall be such as to ensure the safety of the ship and persons on board and shall at least comply with the following provisions. PSCO was notified by ships crew that fuel oil is contaminated with water. Video evidence was provided and showed large amounts of water being separated from fuel oil tanks. This led to vessel experience a loss of power/ propulsion on 31JAN2024. 74SOLAS (04) II-2/4.2.2

In addition to the requirements contained elsewhere in the presents regulations, ships shall be designed, constructed, and maintained in compliance with the structural, mechanical and electrical requirements of a classification society recognized by the administration. Crew was unable to provide evidence of monitoring or a risk analysis of insets on hull as instructed on BV Condition of Class. BV Nr: 37677F 74SOLAS (04) II-1/3-1

Fire-fighting systems and appliances shall be kept in good workings order and readily available for immediate use. PSCO observed pins in C02 bottles rendering the fixed CO2 system inoperable. 74SOLAS (04) II-2/14.2.1.2

Bilge wells in periodically unattended machinery spaces shall be located and maintained in such a way that the accumulation of liquids is detected at normal angels of trim and heel. PSCO observed inoperable bilge alarms in engine room. 74SOLAS (04) II-1/48.1

The function of fixed fire detection and fire alarm systems shall be periodically tested to the satisfaction of the Administration. PSCO observed missing testing equipment to properly test heat detectors and manually operated call points. 74SOLAS (04) II-2/7.3.2

Means of control shall be provided for opening and closure of skylights, closure of openings in funnels which normally allow exhaust ventilation and closure of ventilation dampers. PSCO observed multiple ventilation dampers unable to be closed due to being stuck in the open position, missing the handle for manual operation, or missing the flapper. 74SOLAS (04) II-2/5.2.2.1

The condition of the ship and its equipment shall be maintained to conform with provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO identified generator 2 is inoperable. Crew made no notification to flag, class, or company. 74SOLAS (20) I/11(a)

PSCO observed AMS PCC cabinet located in main switchboard space with panel cover open and a fan blowing on it due to overheating. 74SOLAS(2020) 1/11 (a)

The purpose of this regulation is to prevent the ignition of combustible materials or flammable liquids. For this purpose, the following functional requirements shall be met: Means shall be provided to control leaks of flammable liquids. PSCO observed pooled oil around fuel pumps and recesses on cylinders 1, 2, 3, and 4. PSCO also observed pooled oil on top of exhaust manifold of cylinders 5 and 7 and an active fuel leak in cylinder 7’s fuel pump. 74SOLAS (04) II-2/4.1.1

Electrical installations shall be such that: the safety of the passengers, crew, and ship from electrical hazards will be ensured. PSCO observed stuffing tube on port lube oil motor for main engine not properly packed causing chafing on wires. 74SOLAS (2004) II-1/ 40.1.3

The fire resistance of doors shall be equivalent to that of the division in which they are fitted... Doors and door frames in “A” class divisions shall be constructed of steel. Doors fitted in boundary bulkheads of machinery spaces of category A shall be reasonably gas tight and self closing. PSCO observed a hole in A-15 Stairway door in main passageway. Additionally, PSCO observed hold back on self-closing A-60 door to engine room and self-closing "A" Class door to escape trunk behind main switchboard. 74SOLAS (04) 11-2/ 9.4.2.1

For this purpose, the following functional requirements shall be met: means shall be provided to control leaks of flammable liquids. PSCO observed pooled fuel oil in containment underneath the incinerator burner. 74SOLAS (04) II-2/ 4.1.1

Additionally, PSCO observed hole in deck plating on starboard aft lashing platform.

Whenever there is a hazardous condition either on board a vessel or caused by a vessel or its operation, the owner, agent, master, operator, or person in charge must immediately notify the nearest Coast Guard Sector Office, and in addition submit any report required by 46 CFR 4.05-10. Sector Houston-Galveston received an inaccurate attestation from the Master via email stating that the vessel did not experience any loss of power or propulsion and all equipment was in fully operational condition. 33CFR 160.216

Under all sailing conditions, including maneuvering, the speed, direction of thrust and, if applicable, the pitch of the propellor shall be found controllable from the navigation bridge. Bridge maneuvering system "BMS 40M" is not operational requiring the main engine to be controlled from the ECR or locally. 74 SOLAS 2004 II-1/49.1

Except where otherwise stated, the normal equipment of every lifeboat shall consist of watertight receptacles containing a total of 3L of fresh water as described in paragraph 4.1.5.1.19 for each person. PSCO observed that the lifeboat contained only half the required water on board. 74 SOLAS (20) III/34 LSA Code 4.4.8.9 16bc

Except in the vicinity of the rudder and propellor, suitable hand hold shall be provided or a bouyant lifeline shall be fitted around the outside of the lifeboat above the waterline and within reach of a person in the water. PSCO observed that the grab line was not orientated in such a way that a person in the water could reach the line. 74 SOLAS (20) III/34 LSA Code 4.4.7.3 16bc

Ship shall carry at least two fire-fighter's outfits. PSCO observed that the heat-reflective material on 02 fire suits is deteriorated and compromising the integrity of the fire-fighter's outfits.

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. In meeting these requirements, the company should ensure that inspections are held at appropriate intervals and appropriate corrective actions are taken. Vessel SMS Section 5 of Chapter 10 states that ‘the master, in consultation with the person identifying the deficiency shall undertake all efforts in order for the deficiency to be rectified with the vessel's self-contained capacity”. As observed in deficiencies 02, 04, 07, and 08, the crew is not utilizing appropriate corrective actions when they are needed. An internal safety audit and corrective action is required within 90 days. 74 SOLAS (20) IX/3.1 ISM 10.2.1 ISM 10.2.3

The following fire protection systems shall be kept in good working order so as to ensure their required performance if a fire occurs: Fire detections and fire alarm systems. The vessel’s hypermist system is inoperable rendering the vessel’s flame detectors inoperable. PSCO observed crew attempt to test multiple flame detectors without activating the fire alarm system. Vessel has flag dispensation for the hypermist, however, it does not address flame detectors not working. 74 SOLAS(04) II-2/14.2.1.1.2

Fire fighting system and appliance shall be kept in good working order and readily available for immediate use. Per vessels flag dispensation letter for inoperable hypermist system, the vessel is required to have a two additional portable fire extinguishers at each entrance to the engine room. PSCO observed additional required portable extinguishers missing at each engine room entrance. 74 SOLAS(04) II-2/14.2.1.2

The purpose of this regulation is to prevent the ignition of combustible materials or flammable liquids. For this purpose, the following functional requirements shall be met. Means shall be provided to limit the accumulation of flammable vapors. PSCO observed fabricated fuel oil catch with accumulated fuel oil under piping for fuel oil purifier. 74 SOLAS(04) II-2/4.1.2

Doors fitted in boundary bulkhead of machinery spaces of category A shall be reasonably gastight and self-closing. PSCO observed a self-closing door leading to the engine control room did not fully shut on its own. The latch on the side of the door was broken. 74 SOLAS(04)II-2/9.4.2.1

Fire doors in galley boundaries shall be self-closing and be capable of closing with an angle of inclination of up to 3.5 degrees opposing closure. PSCO observed that the door to the galley would not shut on its own when opened. 74 SOLAS (04) II-2/9.4.1.1.4.2

Terminations and joints in all conductors shall be so made as to retain the original electrical, mechanical, flame-retarding, and where necessary, fire resisting properties of the cable. PSCO observed two deck lighting junction boxes at the embarkation station to be missing the face plate and covers for two exposed holes in the side. 74 SOLAS (04) II-1/45.5.6

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. PSCO observed cracked housing on many of the lights in the engine room and a missing housing on the light adjacent to the engine. 74 SOLAS (04) II-2/45.1.3

Cylinders must always be secured and, when not in use, they must be stowed in a rack in an upright position, with the valve protection cap in place. PSCO observed oxygen and acetylene cylinders not capped and improperly stowed on a dolly secured to the port side rail on the main deck. 46 CFR 147.60 (b) (1)

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: fire detection and fire alarm systems. The smoke detector in the Engine Control Room was inoperable. 74 SOLAS (04) II-2/14.2.1.1.2

After any survey of the ship under regulations 7, 8, 9, or 10 has been completed, no change shall be made in the structural arrangements, machinery, equipment and other items covered by the survey, without the sanction of the Administration. PSCO observed vessel’s number 4 generator inoperable without notifying or receiving sanction of thir Flag State. 74 SOLAS (20) I/11 (b)

Doors required to be self-closing shall not be fitted with hold-back hooks. However, hold-back arrangements fitted with remote release devices of the fail-safe type may be utilized. PSCO observed the self-closing door leading to the incinerator room was held open with rope. 74 SOLAS (04) II-2/9.4.2.2 10c

Doors fitted in boundary bulkheads of machinery spaces of category A shall be reasonable gastight and self-closing. PSCO observed 02 self-closing doors leading to the engine control room did not fully shut on their own. 74 SOLAS (04) II-2/9.4.2.1 10c

The steering gear compartments shall be provided with suitable arrangements to ensure working access to steering gear machinery and controls. These arrangements shall include handrails and gratings or other nonslip surfaces to ensure suitable working conditions in the event of hydraulic fluid leakage. PSCO observed hydraulic fluid on the deck around the steering gear flat with no nonslip surface present. 74 SOLAS (04) II-1/29.13.2 40ac

Hyrdaulic power-operated steering gear shall be provided with a fixed storage tank...and shall be provided with a contents gauge. PSCO observed the fixed hydraulic storage tank did not contain a contents gauge. 74 SOLAS (04) II-1/29.12.3 40ac

Bilge wells in periodically unattended machinery spaces shall be located and monitored in such a way that the accumulation of liquids is detected at normal angles of trim and heel, and shall be large enough to accommodate easily the normal drainage during the unattended period. PSCO observed oily water accumulated in bilge. Bilge alarms for starboard and aft locations were inoperable. 74 SOLAS(04)II-1/48.1 30ac

In meeting these requirements, the company should ensure that inspections are held at appropriate intervals and any non-conformity is reported, with its possible cause, if known. Vessel SMS Section E.1.3.3 states Engineer of the Watch must make regular and frequent inspections of all machinery... All temperatures, pressures, levels, flows, loading, etc. are to be kept under observation and within normal operating limits and where alarm conditions occur, he is to investigate the cause and initiate remedial action immediately. [10.2.2,10.2.1] Vessel SMS Section E.1.3.9 states "... that bilges are examined and that oil leaks and spillages are stopped and contiained where possible. Bilges are to be kept well lit and clean at all times..."[10.2.1,10.2.2} As observed in deficiencies 02 and 03, there were no reports or corrective actions for permanent repairs made. An external audit of the ship's SMS is required to be released from detention. While subject to this detention, if movement of the vessel is required to facilitate corrective actions or surveys, you must first seek concurrence from your Liberia Flag representative prior to contacting the Sector Houston-Glaveston Inspections staff to coordinate Captain of the Port authorization. 74 SOLAS(20)IX/3.1 ISM 10.2.1 ISM 10.2.2 30ac

Means shall be provided to control leaks of flammable liquids. PSCO observed accumulations of oil throughout purifier space, including under deck plates, around number 1 and 2 service generators, and underneath the freshwater generator. 74SOLAS(04)II-2/4.1.1 30ac

A fixed fire detection and fire alarm system shall be provided in accordance with the provisions of this regulation. PSCO observed a plastic bag over the smoke detector in the incinerator room. PSCO requested the bag be removed and detector tested. Upon testing, PSCO observed indicator panel display 9.1, the legend for the system should be 9.9 as the correct alarm that should display for the detector that should be displayed. Ship's electrician stated that the smoke detector failed two weeks prior, and did not make any notification of the issue. On 22FEB23, the Chief Engineer stated the Second Engineer placed a bag over the detector due to an irregularity of the detector causing the system to continually alarm. Request clarification from Class on the zoning for the detector that should be displayed. 74SOLAS (am) II-2/7.2.1, Code 17AC

The company and the ship shall comply with the requirements of the International Safety Management Code. In meeting these requirements the company should ensure that: any non-conformity is reported with its possible cause. Ship's electrician failed to notify the smoke detector in the engine room incinerator space was inoperative. Provide corrective action plan by Company with concurrence from Administration within 90 days. 74SOLAS IX/3.1. ISM CODE 10.2 BC

Where a fixed fire detection and fire alarm system is required for the protection of spaces other than those specified in paragraph 5.1, at least one detector complying with FSS Code shall be installed in each such space. PSCO observed a fault in the cargo hold smoke extraction panel in the CO2 room display unit. Ship's electrician stated the sensor was broken. Chief Engineer communicated the sensor issue was reported to the Company on 28DEC22. 74SOLAS II-2/7.2.2, Code 17AC

A means of communication shall be provided between the navigational bridge and the steering gear compartment. PSCO observed both of the installed means of communication were not operational. 74SOLAS II-2/29.10, Code 40AC

Each NOA must contain all of the information items specified in Table 160.206...(6) Operational condition of equipment required by 33 CFR part 164 of this chapter. PSCO observed non operational speed log that vessel failed to report on NOA.

Ships shall be designed, constructed, and maintained in compliance with the structural requirements of a classification society or with applicable national standards of the Administration which provide an equivalent level of safety. PSCO observed port and starboard anchor chain with multiple links above the kenter shackle showing signs of fatigue (excessive stud gap as per IACS No. 79). PSCO observed port anchor chain has one fractured stud. Provide corrective action plan. 74 SOLAS (04) II-1/3-1

Every ship shall be provided, with subject to the provisions of regulation 8.3, a satellite emergency position-indicating radio beacon (EPIRB) which shall be capable of floating free if the ship sinks. EPIRB is located under a fixed covering on the bridge wing that would prevent from floating free. 74 SOLAS (20) IV/7.1.6.4 17AC

Flammable liquid lockers shall be protected by an appropriate fire-extinguishing arrangement approved by the Administration. Paint cans stored in the paint locker are located above the sprinkler heads for the sprinkler system. 74 SOLAS (04) II-2/ 10.6.3.2 17AC

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in a normal manner. A 220V outlet is not properly mounted exposing electrical wires on the back of the outlet near the SSDGS. Crew stated they actively use this outlet. 74 SOLAS (04)II-1/45.1.3; 17ac

No change shall be made in structural arrangements, machinery, equipment, and other items covered by the survey, without the sanction of the Administration. Multiple soft patches were on pipes in the following locations: Fresh water pipe in overhead on bottom deck of the E/R forward of MDE, the pipe just before the cargo hold bilge educator on the bottom deck of E/R on the forward bulkhead, and a F/W pipe for jacket water for L/O on 3rd deck of E/R above the thermal control valve. In addition to soft patches, the E/R Alarm horn for the space were attached to a metal support bracket with zip ties in front of MDE. 74 SOLAS(04)I/11(b); 50ac

Every steam pipe and every fitting connected thereto through which steam may pass shall be so designed, constructed, and installed as to withstand the maximum working stress to which it may be subjected. A condensate pipe forward of the bilge tank was steadily discharging water through a hole. Gallons of water accumulated by the purifier flat from the leak. 74 SOLAS(04)II-1/33.1; 17ac

All hatchways in position 1 and 2 shall be fitted with hatch covers of steel or other equivalent material except as described in regulation 14(2) such covers shall be weathertight and fitted with gaskets and clamping devices. The bottom left knife edge on the CO2 Room Door is wasted away. Hatch in escape route behind engine control room is wasted away and light can be seen through the steel. ICLL 88 I/16(1); 50ac

Means shall be provided to control leaks of flammable liquids. Fuel and oil leaks were found in the following locations of the engine room: -Approximately 2 gallons of oil under the deck plates on the outboard side of No. 4 Ship Service Diesel Generator (SSDG) -Steady fuel leak on No.2 SSDG behind the governor -Lube oil sump for Main Diesel Engine (MDE) cylinder oil was covered in oil with rags underneath it and approximately an inch of oil -Approximately half a gallon of fuel was pooled on top of No.3 MDE cylinder. 74 SOLAS (04) II-2/4.1.1; 30ac

Additional aids for escape shall be provided as necessary to ensure accessibility, clear marking, and adequate design for emergency situations. Escape route signs in the main switchboard room do not match as indicated on the Fire Control Plan. 74SOLAS(04)II-2/13.1.3; 17ac

Maintenance, testing and inspections shall be carried out based on the guidelines developed by the Organization. Ship's crew does not have records of testing the manual call points. Ship's weekly and monthly checklist Form D-12 and Form D-07 does not include manual call points. 74SOLAS(04)II-2/14.2.2.1; 17ac

In meeting these requirements, the company should ensure that inspections are held at appropriate intervals and any non-conformity is reported, with its possible cause, if know. Ships policies and procedures manual 10.6 (p 7 of 10) refers to Form D-12 and D-07 for monthly and weekly inspections and testing. [10.2.1] Chapter 9.3.b (p 3 of 7) requires a report to appropriate department head any non-conformity. [10.2.2] Deficiency 10 shows ships procedures does not address required testing intervals for manual call points. Deficiencies #2, 4, 5, 6, and 8 shows that non-conformities were found but there were no reports or corrective actions for permanent repairs. An external audit of the ship's SMS is required to be released from detention. 74SOLAS(20)IX/3.1 ISM 10.2.1 ISM 10.2.2 30ac

OIL FUEL PIPES, WHICH, IF DAMAGED WOULD ALLOW OIL TO ESCAPE FROM A STORAGE, SETTELING, OR DAILY SERVICE TANK HAVING A CAPACITY OF 500 L AND ABOVE SITUATED ABOVE THE DOUBLE BOTTOM, SHALL BE FITTED WITH A COCK OR VALVE DIRECTLY ON THE TANK CAPABLE OF BEING CLOSED FROM A SAFE POSITION OUTSIDE OF THE SPACE CONCERED IN THE EVENT OF A FIRE OCCURING IN THE SPACE WHICH SUCH TANKS ARE SITUATED. PSCO OBSERVED NO MEANS OF EMERGENCY GENERATOR FULE SHUT OFF OUTSIDE THE EMERGENCY GENERATOR SPACE. CREW WAS UNFAMILIAR WITH ALTERNATE MEANS OF SECURING FULE TO EMERGENCY GENERATOR. SOLAS(20)II-2 4.2.2.3.4

The condition of the ship and it's equipment shall be maintained to conform with the provisions of the present regulation to ensure the ship in all respects will remain fit to proceed to sea without danger to the ship or persons onboard. The vessel experienced a loss of propulsion while departing Dock #5 located at Barbour's Cut Container Terminal. Vessel is to submit Classification Society Report detailing the cause of the failure as well as attesting to the seaworthiness of the vessel.
