Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed port side rescue boat engine failure when testing the engine in astern. Engine died and thick black oil was observed leaking from exhaust. Engine was restarted after 15 minutes and thick white smoke with more oil came from exhaust. Engine RPMs were excessive and uncontrollable. 74 SOLAS (20) III/20.2 Code 17ac

To discharge ballast water into the waters of the United States, the master, owner, operator, agent or person in charge of a vesel subject to 151.2025 of this part must either ensure that the ballast water meets the ballast water discharge standard in 151.2030(a), usa an AMS as described in 151.2025(a)(3), or ballast with water from a U.S. public water system, acording to the schedule in paragraph (b) of this section.
Vessel is past its compliance dater per the implementaiton schedule in 33 CFR 151.2035(b). The vessel's installed BWMS system is inoperable.
The vessel is not authorized to discharge untreated ballast into the waters of the U.S. without prior written authorization from the local COTP under the provisions of 33 CFR 151.2040(b).
