Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. This subpart summarizes the responsibilities of credentialed mariners, marine employers, MRO, SAP and other chemical testing service providers in 49 CFR part 40. The regulations in 49 CFR part 40 should be consulted to determine the specific procedures which must be established and utilized. Sea Eagle Diving Adventure Corporation drug testing program is not in compliance with Title 49, CFR Part 40 based on the company Drug and Alcohol Program audit on December 8, 2025. Bring program into compliance to satisfaction of attending marine inspector. 46 CFR 16.113(a)

No marine employer may engage or employ any individual to serve as a crew member unless the individual passes a chemical test for dangerous drugs for that employer. Breeze Hawaii dive masters and snorkel guides serve as crew members in a safety sensitive position that directly affect the safe operation of the vessel without a negative pre-employment test and enrollment in a random drug testing program as described by 46 CFR 16.230. (1) Ensure Breeze Hawaii dive or snorkel employees do not serve in a safety sensitive position as a crew member; or (2) Provide Breeze Hawaii employees pre-employment drug test and provide results from a qualified Medical Review Officer (MRO) to the attending marine inspector; and (3) Enroll Breeze Hawaii employees in a chemical testing program that meets the requirements of 46 CFR 16.230 and provide objective evidence of enrollment to the satisfaction of the attending marine inspector by December 15, 2025. 46 CFR 16.203(a)(1)

A vessel must carry one floating water light, unless it is limited to daytime operation, in which case no floating water light is required. The life ring on board did not have a floating water light. The vessel is restricted to day light operations until the required floating water light is provided to the satisfaction of the attending CG marine inspector. 46 CFR 180.70(d)

Each life ring buoy on a vessel must: be approved in accordance with 160.050 in sub chapter Q of this chapter, or other specified by the Commandant, including, but not limited to, approval series 160.150. Vessel had one SOLAS approved life ring on board. Replace life ring with USCG approved life ring, in accordance with 160.050 in sub chapter Q to the satisfaction of the attending CG marine inspector. 46 CFR 180.70(b)(1)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. First aid kit on board was missing 24 doses of aspirin. Replace required quantities of medication to the satisfaction of the attending CG marine inspector. 46 CFR 184.710

Acid batteries shall be located in a tray of lead or other suitable material resistant to deteriorating action by the electrolyte. 8D lead acid battery located in the aft starboard portion of the engine room was not located in a tray. Provide suitable tray to the satisfaction of the attending CG marine inspector. 46 CFR 183.05-20(d) "Old T"

Each circuit breaker must meet UL 489 or other standard specified by the Commandant. Breaker in engine room, mounted on aft most bulkhead, was not UL 489. Replace breaker meeting UL 489 standard to the satisfaction of the attending CG marine inspector. 46 CFR 183.380(m)

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 65 feet in length carrying not more than 49 passengers, provided that: the pump is listed by an independent laboratory as meeting the requirements of UL 1113. The three submersible electric bilge pumps on board did not meet the requirements of UL 1113. Replace all three bilge pumps on board, to meet the requirements of UL 1113, to the satisfaction of the attending CG marine inspector. 46 CFR 182.520(e)(1)

A flexible tube or hose may be used instead of a fixed pipe for the discharge line of a submersible electric bilge pump provided the hose or tube is of good quality and of substantial construction, suitable for the intended use. The flexible hose utilized as the discharge line of the submersible electric bilge pump located in the engine space of the vessel is wasted. Replace with manufacturer approved hose and operationally test this bilge pump in the presence of the attending CG marine inspector. 46 CFR 182.520(f)(1)

The intent of this part is to insure that the main propulsion machinery installed on each vessel is suitable for the vessel and its operation and that the auxiliary machinery is suitable for the purpose intended. Main engine has a faulty fuel pump and is not operable. 46 CFR 182.01-5

The following spaces must be equipped with a fixed gas fire extinguishing system in compliance with 181.410: A space containing propulsion machinery. Complete a satisfactory test of the Fireboy once main engine is operable. 46 CFR 181.400 (a)(1)

Provision shall be made by means of plugs, covers, etc. to percent admission of air into the space. Engine room ventilation open allowing passage of air. Close engine room ventilation installations. 46 CFR 181.20-35(a) (Old T)

The OCMI may require the vessel to get underway. Get underway in presence of marine inspector to conduct drills. 46 CFR 176.404(a)

Portable fire extinguishers shall be installed and located to the satisfaction of the Officer in Charge, Marine Inspection. Brackets for 02 fire extinguishers at the operating station are broken. Repair brackets to original state and mount extinguishers properly. 46 CFR 30-1 (Old T)

A visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces. Engine compartment high level bilge alarm light is not operational. 46 CFR 182.530(a)

Firefighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: Date of the drill and training; and general description of the drill scenario and training topics. Vessel did not have logs meeting content requirements. For future drills, include these requirements. 46 CFR 185.524(d)

The marine inspector may require any part or all of the propeller shafting to be drawn for examination of the shafting and stern bearing of a vessel whenever the condition of the shafting and bearings are in question. Draw shaft for further inspection of the cutlass bearing (water lubricated rubber bearing) by the attending [name withheld] the rubber bearing material of any water groove is outside the manufactures tolerance or half the original depth, replace the cutless bearing to the satisfaction of the attending MI. 46 CFR 176.607 (a)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant [name withheld] damage exposing fiberglass on port side bow. Grind back fiberglass to good glass for re-inspection. 46 CFR 176.700 (a)

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Rub rail damaged on port quarter of vessel, creating opening in hull. Grind back fiberglass for re-inspection. 46 CFR 176.800 (a)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant [name withheld] under aft side of hatch in engine space is rotting. Wood under hatch in compartment just forward of engine space is rotting. Remove degraded wood for re-inspection. 46 CFR 176.700 (a)

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Bolt on swim deck platform sheared off on the second bracket from starboard side. Install new bolt. 46 CFR 176.800 (a)

This part is intended to provide a minimum standard of regulations for electrical installations and equipment that will result in a vessel that is reasonably safe from fire caused by and/or originating in electrical equipment, and reasonably safe from electrical shock of personnel. Dead end wires found in engine room and port navigation light wiring. Remove equipment or properly terminate wires. Old T 46 CFR 183.01-5

Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replaced. Life ring was deteriorated to the point that the foam was visible in multiple location. Replace life ring. 46 CFR 176.808(b)

A vessel on a limited coastwise route must carry at least 12 approved distress signals. Only 8 distress signals were provided. Provide the proper number and type of required distress signals. 46 CFR 180.68(a)

Valves for removing water from diesel fuel in water traps must be provided with caps or plugs to prevent fuel leakage. The provided valve was not equipped with the required plug. Provide a plug or a cap. 46 CFR 182.455(b)(9)

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have the following equipment at the operating station: An audible alarm that sounds upon discharge. No audible alarm heard during test of Fireboy system. 46 CFR 181.420(b)(2)

The master shall conduct sufficient fire drills to make sure that each crew member is familiar with his or her duties in case of a fire. Crew was unfamiliar with fire drill procedures. Crew needs to become proficient and demonstrate their ability to sufficiently conduct fire drills. Fire drill must address steps prior to manual activation of fireboy, manual activation of fireboy, and follow up actions to activation of fireboy IAW manufacturers instructions.

A pre-engineered fixed gas fire extinguishing system must: Be installed in accordance with the manufacturer's instructions. Opening between engine space and mid compartment allows fixed fire extinguishing medium to communicate through bulkhead. Make vapor tight to ensure quantity of extinguisher is sufficient.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. The main engine is leaking diesel fuel IVO the fuel injectors. Properly repair main engine diesel fuel leak.

Shutoff valves, installed so as to close against the fuel flow, shall be fitted in the fuel supply lines at the tank connection. The vessel's fuel shutoff valve was not operable due to tab stops being bent. Service and prove proper operation of the fuel shutoff valve to the attending USCG marine inspector.

Vessel must be provided with satisfactory arrangement for draining any watertight compartment. The overboard discharge piping leading to the bilge pump in the engine compartment and to the bilge pump in the space forward of the engine room are not secured to the bilge pump adequately. These hoses shall be secured firmly with two hose clamps.

A suitable hull strainer shall be installed in the circulating water intake line. No hull strainer is installed. Properly install suitable hull strainer in the circulating water intake line.

The discharge ends of vent pipes shall be fitted with removable flame screens or flame arresters. The flame screen shall consist of a single screen of corrosion resistant wire of at least 30x30 mesh. The vessels installed flame screen has been painted over. Repair or replace flame screen.

Circuit breakers, of the proper voltage rating, shall be of the manually reset type designed for inverse time delay, instantaneous short circuit protection, and capable of readily opening the circuit in which it is to be used without damage to the circuit breaker. The vessel has three broken circuit breakers that lead to each electric bilge pump and are no longer able to be manually reset. Replace broken circuit breakers to the satisfaction of the attending USCG marine inspector.

An adult life jacket must be provided for each person carried on board a vessel. Vessel is restricted to 21 persons total due to lack of properly outfitted lifejackets.

Electrical equipment must be installed to protect from electrical hazards. Electrical wiring in engine space has several unsecured and dead end wires. Properly remove or cover to prevent potential shock or fire hazards. Bilge pump wiring is not properly grounded. Ground securely.

Battery installations must be mounted to protect against shifting of the vessel and free from exposure to water splash or spray. Vessel's battery installation is not securely mounted. Securely mount battery installation.

Engine exhaust pipe installations built in accordance with the requirements of ABYC P-1 (incorporated by reference; see 46CFR 175.600), will be considered as meeting the requirements of this section. PVC piping is not a suitable arrangement for wet exhaust piping. Replace with a suitable material installation, ABYC acceptable materials attached for reference.

All cable and wire must be installed with metal supports spaced not more than 24 inches apart. Multiple wires unsupported in engine and mid section compartments.

If batteries are not adjacent to a distribution panel or switchboard that distributes power to the lighting, motor, and appliance circuits, the battery lead must have a fuse in series as close as practicable to the battery. Provide fuse in series as close as practicable to battery on the main house conductor and bilge pump conductor. Conductors must be protected in accordance with their current carrying capacities.

The owner or operator shall make a vessel available for drydock examinations. In accordance with U.S. Coast Guard Marine Safety Information Bulletin 09-20 "Vessel Inspections, Exams, and Documentation", the vessel's required drydock inspection has been deferred 45 days based on objective evidence provided by the owner and/or operator attesting to the vessel being fit for its intended route and service. The vessel's owner or operator shall ensure that the vessel completes a USCG Marine Inspector drydock inspection within 45 days of the drydock due date listed on the its COI. Failure to complete a USCG Marine Inspector attended drydock inspection may result in the vessel being restricted from carrying passengers.

Portable fuel systems, including portable tanks and related fuel lines and accessories, are prohibited except where used for portable dewatering pumps or outboard motor installation. Vessel has what appears to be diesel fuel return line or drain line on main engine draining to portable fuel tank in the same space. Fuel tank was 3/4 fuel of diesel. Provide manufacturer's manual/ installations instructions and return to original condition. 46 CFR 182.458

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have the following equipment at the operating station: (3) A means to reset devices used to automatically shut down ventilation systems and engines. Vessel did not have override switch installed on fixed fire extinguishing system. 46 CFR 181.420 (b) (3)

All vessels must have operable navigation lights in accordance with the Navigation Rules. Stbd running light and masthead light inoperable. 46 CFR 183.420

All electrical installations shall be to the satisfaction of the [name withheld] terminal block in engine space unsupported causing electrical hazard. 46 CFR 183.01-15

Vessels operated solely within 20 nautical miles of land must be equipped with a VHF-DSC radiotelephone installation meeting the requirements of § 80.1101(c)(2). VHF radio missing LAT/LONG for DSC operation. Vessel restricted to 1000 feet from shore. 47 CFR 80.905

Each ship transporting more that six passengers for hire equipped with a radiotelephone station must carry a radio operator who: holds a marine radio operator permit or higher class license. Neither of the two masters onboard had a valid radio operator permit. 47 CFR 80.158 (e)

Each vessel must be equipment with at least two operable portable battery lights. Vessels second portable battery light inoperable. 46 CFR 183.430

A vessel not required to have a power driven fire pump by 181.300 must have at least three 2 1/2 gallon buckets, with an attached lanyard satisfactory to the cognizant [name withheld] of vessels fire buckets had a capacity of 5 gallons and missing lanyard. 46 CFR 181.610

A hatch exposed to the weather must be watertight except the following may be weathertight: (2) a hatch on a cabin top. Fwd hatch no longer weather tight. 46 CFR 171.130 (3)

Each floating waterlight installed on a vessel carrying only on ring buoy, must be attached to the lanyard with a corrosion resistant clip. Vessels floating waterlight was tied off to the vessel, not attached to the life buoy with corrosion resistant clip. Vessel restricted to daylight operations. 46 CFR 180.70 (d) (3)

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018. The arrangement must be as specified by IMO Resolution A.658(16). Vessel missing Type II retroreflective material on ring life buoy. Must be applied around or on both sides of the body of the lifebuoy at four evenly-spaced points. Vessel restricted to daylight operations. 46 CFR 185.604 (h)

The name of the vessel must be marked on some clearly visible exterior part of the port/ starboard bow and the stern of the vessel. No name on port and starboard bow. 46 CFR 185.602 (a) 46 CFR 67.123 (a)

Remote fuel shutoff stations must be marked in clearly legible letters at least 1 inch high indicating purpose of valve and direction of operation. Fuel shutoff not labeled on main deck.

Abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. Fire fighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The EPIRB test required by paragraph (a) shall be logged or otherwise documented. Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. Emergency Instructions must be designed to address the particular equipment, arrangement, and operation of each individual vessel. Written policies and response procedures for recovery of diver/snorkeler in distress as required by Sector Honolulu Work Instruction 31 were not available. Provide written plan and emergency response procedures.

The owner or manager shall provide satisfactory evidence of required servicing of portable fire extinguishers. 10-B:C portable fire extinguisher was last serviced in 2018 and no records of annual servicing or maintenance provided. Provide proof of current records of by a qualified servicing facility.
