An adult life jacket must be provided for each person carried on board a vessel. 15 of 23 adult life jackets were wasted and unserviceable. Persons onboard reduced to 08 (07 passengers and 01 crew) until new jackets are placed onboard. 46 CFR 180.71(a)

Anchor light was inoperable. Vessel restricted to day light operations only until rectified.

A suitable marine metal strainer, meeting the requirements of the engine manufacturer, must be fitted in the fuel supply line. Fuel filter for propulsion engine is fitted with plastic bottom. Replace with metal filter. 46 CFR 182.455(b)(6)

In a vessel of less than 12 meters in length, A sidelight must be visible for 1 mile. Port sidelight was not illuminating. Make port sidelight illuminate as per regulation and to satisfaction of attending Marine Inspector. Vessel is not to operate from sunset to sunrise until deficiency is cleared.

All alcohol testing devices used to meet the requirements of this part must be currently listed on either the Conforming Products List (CPL) titled “Modal Specifications for Devices To Measure Breath Alcohol” or “Conforming Products List of Screening Devices To Measure Alcohol in Bodily Fluids,” which are published periodically in the Federal Register by National Highway Traffic Safety Administration (NHTSA). Device owner/ operator made available was not calibrated or on list. Either provide proof that this product conforms, or provide conforming product. Until vessel has adequate testing devices on-board,vessel must stay within 2 hours of a location to perform the required alcohol tests from the time of occurrence of the SMI.

A vessel must carry either a first-aid kit that meets the requirements in ISO 18813:2006(E) paragraph 4.12, or a kit with equivalent contents and instructions. Kit was not available for inspection. Supply first-aid kit in compliance with regulations.

A vessel must comply with the applicable requirements for any radio installation as set forth in 47 CFR Part 80. Small passenger vessels that sail in bays, harbors, rivers and sounds adjacent to the open ocean always within communication of a VHF coast station that maintains a continuous watch on VHF Channel 16 (156.8 MHz) must carry a VHF radio installation specified in 80.1085(c). Vessel's radio was not able to broadcast. Vessel must stay within 1000' of shore until radio station is repaired and inspected by FCC Technician. Vessel may also request to have route reduced permanently to within 1000' of nearest land at mean low tide to become exempt from the provisions of title III, part III of the Communications Act.

The owner, charterer, master or managing operator shall instruct each crew member, at least once every three months, as to the duties that the crew member is expected to perform in an emergency, such as actions to be taken in the event of fire, heavy weather, or man overboard conditions. Begin logging drills as required. The drill entry shall include the date of the drill and training; and general description of the drill scenario and training topics.

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a dry-dock examination and an internal structural examination at least once every two years. As per her COI, vessel is currently outside compliance and can no longer operate under the conditions of her COI. Vessel must undergo a satisfactory dry-docking in compliance with 46 CFR Sub-chapter T, in the presence of a USCG Marine Inspector, in order to clear this deficiency.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from machinery failure. Vessel's outboard engine was inoperable. Vessel must rectify deficiency prior to departure and conduct underway test with attending Marine Inspector.

At each initial and subsequent inspection for certification, the marine inspector may require that an abandon ship or man overboard drill be held under simulated emergency conditions specified by the inspector. Due to the propulsion failure, the attending marine inspector was not able to observe an abandon ship or man overboard drill under simulated emergency conditions while underway. Vessel must rectify deficiency prior to departure and conduct underway drills with attending Marine Inspector.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel's testing device was unavailable. Until such time that valid testing devices are available onboard,vessel must stay within 2 hours of a location to perform the required alcohol tests from the time of occurrence of the SMI. Vessel will need to replace testing devices as required and or show written policy attesting to how the vessel will obtain the devices and conduct the required alcohol tests within 2 hours from the time of occurrence of the SMI.

Employers must ensure that they and their crew members meet the requirements of Part 16 - Chemical Testing. Employees were not able to provide any proof of enrollment in the vessel's chemical testing program. Provide proof of crew members enrollment in chemical testing program with confirmation from consortium that vessel is in current good standing to attending Marine Inspector.

The lights prescribed in the Rules (Subpart C) shall have an intensity as specified so as to be visible at the minimum ranges prescribed. Navigation lights were blocked in areas by vessels canopy. Make navigation lights as prescribed in 33 CFR 83.22 to the satisfaction of attending Marine Inspector.

A life buoy must be fitted with a lifeline. Each lifeline on a ring life buoy must: have a breaking strength of at least 1,124 pounds. Lifeline on life buoy and waterlight were wasted. Repair/replace line top manufacturer specs meeting this regulation to the satisfaction of attending Marine Inspector.
