No marine employer shall engage or employ any individual to serve as a crew member unless the individual passes a chemical test for dangerous drugs to that employer. Drug testing programs required by this part must be conducted in accordance with 49 CFR 40, Procedures for Transportation Workplace Testing Programs. Proof of pre-employment testing could not be verified by owner. Vessel may not operate until proof is provided that crew members passed chemical testing (as per 46 CFR 16.210) or proof is provided as per 46 CFR 16.210(b).
