A ship except a ship of less than 26 feet in length, must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space or at the bilge and ballast pump control station. PSCOs did not observe an oil discharge placard in the machinery space or at the bilge and ballast station. 33 CFR 155.450(a) Code 10c

The regulations of chapter V of the 1974 SOLAS Convention apply, as appropriate, to all ships to which this code applies, in particular: .16 regulation 20 Nautical Publications: All ships shall carry adequate and up-to-date charts. PSCOs observed 03 years of missing chart corrections on chart 11468. CCSSC (97) Ch 6 Reg. 6.1.2.16 74 SOLAS Ch 5 Reg. 20

Every ship of 100 gross tonnage... shally carry a garbage management plan... this plan shall provide written procedures for minimizing, collecting, storing, processing, and disposing of garbage. PSCO's observed no procedures specific to the ship or how they intend to be in compliance. 2017 MARPOL ANNEX V/10.2

Ships intended for the carriage of dangerous goods shall comply with the special requirements as specified in Chapter II-2 of the 1974 SOLAS Convention...Arrangements shall be made to ensure immediate availability of a supply of water from the fire main at the required pressure...by suitably placed remote arrangements for the fire pumps. Emergency fire pump has no remote start up arrangements. CCSSC 3.25.1 74 SOLAS 20 cons. II-2/19.3.1

All fire protection systems and appliances shall at all times be in good order. PSCO observed significant wastage on the time delay cylinder , and hose connections were found with significant rust built up. CCSC 3.6.12

All fire protection systems and appliances shall at all times be in good order and available for immediate use while the ship is in service.. Fire detection panel on the bridge has a fault in the system. 02 detectors failed to indicate or alarm locally and in bridge when tested. CCSS Code 3.6.12

The table requires a minimum of 06 lifebuoy's that shall comply with the code... 02 lifebuoys maintained a permanent knot in the unapproved buoyant lifeline. CCSS Code 4.12.1

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book Part I so that all entries in the book appropriate to that operation are completed...Sludge receipts dated 06FEB2020, 27FEB2020, and 05MARCH2020 have no corresponding entries in the oil record book. MARPOL I/17.4

The oil residues which cannot be discharged into the sea in compliance with this regulation shall be retained on board for subsequent discharge to reception facilities... Oil Record Book entries for discharge ashore dated 12AUG2020 and 19AUG2020 have no corresponding sludge receipts. MARPOL I/15.9

Ships shall comply with the following requirements of SOLAS Chapter V as they apply in relation to a ship of its description. All ships officers concerned with the operation and/or maintenance of steering gear shall be familiar with the operation of the steering systems fitted on the ship...Vessel's Chief Engineer was not familiar with the operational controls for emergency steering and could not operate it in a timely manner. CCSSC Ch 6/Reg 6.5 74 SOLAS (14) V/26.3.2

Every liferaft shall be stowed with its painter permanently attached to the ship and with a flat-free arrangement so that the liferaft floats free and, if inflatable, inflates automatically when the ship sinks. PSCO's observed the painter on the port side liferaft was not properly connected to the weak link. CSCCS (2018) 4.9.5

The owner of or the master of every ship to which this code applies shall ensure that the condition of the ship and its equipment is maintained to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship, persons on board or the environment. Fixed emergency fire pump space filled with smoke upon starting and continued to do so until personnel entered the space by donning breathing device to stop the motor. representing a danger to the ship and persons on board. CCSSC CH 1.11.1 17BC

All ships shall be proved with a fire control plan to the satisfaction of the Administration. The exhibited fire control plan is not approved by the Administration and is not indicated as being issued for this vessel. Fire control plan does not have "A" Class fire boundaries indicated around machinery space. CCSSC Ch.3.13 16ac

Vessels shall conduct qualified individual notification exercises which must be conducted quarterly. Ship had no record of qualified individual drills. Crew did not recognize or know the Q.I. number. 33CFR155.1060(a)(1) 10c

EACH ADMINISTRATION SHALL...HOLD COMPANIES FOR THE ASSIGNMENT OF SEAFARERES FOR SERVICE ON THEIR SHIPS....TO ENSURE THAT....ITS SHIPS ARE MANNED IN COMPLIANCE WITH THE APPLICABLE SAFE MANNING REQUIREMENTS OF THE ADMINISTRATION. THE VESSEL IS PROVIDED A MINIMUM SAFE MANNING DOCUMENT FROM THE REPUBLIC OF PANAMA THAT REQUIRES THE VESSEL TO OPERATE WITH A CHIEF AND SECOND ENGINEER, BOTH CERTIFIED IN ACCORDANCE WITH THE MINIMUM REQUIREMENTS OF CHAPTER III/3 OF STCW. THE SECOND ENGINEER ONBOARD COULD PRODUCE A CERTIFICATE ATTESTING TO THE MINIMUM REQUIREMENTS OF III/I. THE VESSEL ENTERED COTP ZONE MIAMI ON 18OCT19 WITH ONLY ONE MARINER POSESSING THE CORRECT CERTIFICATION FOR III/3. WHILE IN PORT, THE VESSEL OBTAINED A NEW SECOND ENGINEER MEETING THE REQUIREMENTS OF III/3 AS SPECIFIED ON THE MANNING REQUIREMENT. 78 STCW (2017 CONS.) REG 1/14.1.2

14101 - Pollution Prevention - Oil residue may be disposed of directly from oil residue tanks through the standard discharge connection or any other approved means of disposal. Ships IOPP Supplement Form "A" stated that the ship was fitted with a standard discharge connection; however, the ship could not provide the standard discharge connection for inspection. - MARPOL (2014) Annex I Reg. 12.2.

01199 - Certificates & Documentation - Vessels greater than or equal to 300 GT must submit a signed and certified, complete and accurate Notice of Intent (NOI) in accordance with the requirements of appendix E. Ship could not provide electronic or paper copy of NOI and the ship has not submitted annual reports. - 2013 VGP 1.5.1.1

04112 - Emergency Systems - Vessels shall conduct qualified individual notification exercises which must be conducted quarterly. Ship could not provide evidence of qualified individual notification drills being conducted.

0740- The main fire pump shall be capable of delivering for internal firefighting purposes on board. Main fire pump has a ruptured bleed valve rendering the fire pump inoperable-ccssc (2015) ch.3.3.2

0725- In every ship, one of the fixed fire extinguishing systems referred to in 3.10.1 shall be provided for the protection of any space containing internal combustion type machinery. CO2 system on board is not operational due to repair. CCSSC (2015) ch. 3.10.3

CCSSC (2015 rev.) 4/4.17.5 - Each crew member shall be familiar with the use of the ship's lifesaving appliances, including survival craft equipment, fire-fighting equipment, and emergency procedures before a voyage begins. Crew was not familiar with firefighting equipment used on board.

74 SOLAS (14 consolidated)V/26.3.1 - Simple operating instructions with a block diagram showing the change over procedures for remote steering gear control systems and steering gear power units shall be permanently displayed on the navigation bridge and in the steering compartment. Vessel did not have a block diagram of steering gear arrangement.

CCSSC (2015 Rev.) The Master shall ensure that the frequency of enclosed space drills shall not exceed quarterly. Crew has not done drills.

0640-Distress Flares- Every ship shall be provided with no less than six hand held red flare signals. Vessel had only recreational use hand held red flare signals on board. CCSSC Ch 4.14

EVERY SHIP OF 100 GROSS TONS AND ABOVE SHALL CARRY A GARBAGE MANAGEMENT PLAN WHICH THE CREW SHALL FOLLOW. THE CREW IS NOT FOLLOWING THE PLAN. FOOD WASTE NOT COMMUTED OR GROUND IS BEING DISCHARGED BETWEEN 3-12 NAUTICAL MILES FROM NEAREST LAND ACCORDING TO DESIGNATED PERSON IN CHARGE. VESSEL DOES NOT HAVE A GRINDER, THEREFORE PER VESSEL'S PLAN, ALL FOOD WILL BE STORED AND DISCHARGED AT NEXT PORT.

EVERY SHIP OF 400 GROSS TONS AND ABOVE SHALL BE PROVIDED WITH A GARBAGE RECORD BOOK. EACH DISCHARGE TO THE SEA OR TO A RECEPTION FACILITY SHALL BE PROMPTLY RECORDED, SIGNED BY THE MASTER, AND INCLUDE POSITION OF THE SHIP. VESSEL IS NOT COMPLETING RECORD BOOK ENTRIES PROPERLY-NO SHIP POSITION IS LISTED FOR DISCHARGE OF FOOD SINCE 4MAR2015, RECEPTION FACILITY RECEIPTS DO NOT MATCH RECORD BOOK, MASTE

CCSSC CH 2 / REG 2.30.2.1.3: MEANS SHOULD BE PROVIDED WHEREBY NORMAL OPERATIONS OF PROPULSION MACHINERY CAN BE SUSTAINED OR RESTORED EVEN THOUGH ONE OF THE ESSENTIAL AUXILIARIES BECOMES INOPERATIVE. SPECIAL CONSIDERATIONS SHOULD BE GIVEN TO THE MALFUNCTIONING OF SOURCES OF WATER PRESSURE. COOLING LINES ON THREE PRIME MOVERS FOUND LEAKING AND IMPROPERLY REPAIRED.

CCSSC CH 2 / REG 2.16.2: MOVING PARTS OF MACHINERY WHICH ARE SO EXPOSED AS TO CAUSE ACCIDENTS SHOULD BE PROPERLY GUARDED. EXPOSED PORTIONS OF BOTH PORT AND STARBOARD SIDE PRIME MOVERS FOUND UNGUARDED.

THE MASTER, OWNER, OPERATOR, AGENT OR PERSON IN CHARGE OF A VESSEL MUST PROVIDE BALLAST WATER REPORTING FORMS TO THE NATIONAL BALLAST INFORMATION CLEARINGHOUSE AT LEAST 24 HOURS PRIOR TO ARRIVAL AT U.S. PORTS OR PLACE OF DESTINATION. PERSON IN CHARGE OF SUBMITTING REPORTS DID NOT SUBMIT REPORTS AS REQUIRED.
