Objective evidence discovered during an expanded ISM exam revealed the following non-conformities: the vessel failed to fully implement the requirements of the ISM Code through their SMS procedures as evident by the following deficiencies indicating that the ship and/or company are not meeting the SMS requirements. Recommend an external audit. The company is responsible for ensuring that adequate resources and shore-based support are provided to enable persons to carry out their functions. On 23 July 2018, the vessel sent an e-mail to vessel's superintendent notifying the company of a severe leak in the fire main. Vessel did not receive service for the deficiency in over 20 port calls to Miami COTP Zone over 3.5 months while on dedicated route between Miami and the Bahamas. The safety management system should include procedures ensuring that nonconformities and hazardous situations are reported to the company. The vessel master did not utilize non-conformity form and tracking system established by the company when reporting the leaking fire main in July 2018, instead sending only an e-mail to the vessel's superintendent. 74 SOLAS (2014)IX/3.1 ISM Code Part A ISM Code 10.2.3 ISM Code 9.1

Fire extinguishing systems shall be maintained ready for use. During testing of the starboard side fire pump, PSCO observed excessive leakage from the cracked fire main located on Deck 2 above the starboard side fire pump. Leakage was approx. 20 gallons per minute. 74 SOLAS (14 CONS) II-1/14.1.1

"A" class divisions shall be so constructed as to be capable of preventing the passage of smoke and flame. Fire insulation between passenger area and cargo space, which forms "A" class boundary, is rendered ineffective due to water damage from the leaking fire main. 74 SOLAS (1997) II-2/3.3

All cargoes shall be loaded, stowed, and secured throughout the voyage in accordance with the Cargo Securing Manual. Over 50% of the pad-eyes and D-rings on the cargo decks are missing or broken. 74 SOLAS (2014) VI/5.6

Each completed page of the Oil Record Book shall be signed by the master of the ship. PSCO observed 04 pages, ranging from 31OCT18 to 12DEC18, unsigned by master. MARPOL (2017) Annex I/17.4

In passenger ships at least one person qualified shall be assigned to perform only radio communication duties during distress incidents. Vessel did not designate a crewmember only assigned to GMDSS duties during distress incidents. 74 SOLAS(14 Cons.)CH IV/ reg 16.2. action taken 50ac

HSC Code 7.7.1 - Areas of major and moderate fire hazard should be provided with an approved automatic smoke detection system. Multiple fire detectors were found inoperable throughout the ship. In addition, 02 faults were noted in the fire detection system control panel.

HSC Code 7.4.1.1 - The structural fire protection times for seperating and decks should be in accordance with the tables 7.4.1 and 7.4.2. Duty free store contains flammable liquids in excess of daily use, increasing fire risk.

HSC Code 7.4.2.2 - Fire resisting bulkheads and decks should be constructed to resist exposure to the standard fire tests for a period of 60 minutes for areas of major fire hazard. Multiple penetrations were found through A60 boundary located on the bridge.

Main propulsion machinery essential to the propulsion and the safety of the ship shal, as fitted in the ship, be designed to operate when the ship is upright. The vessel's starboard inner main engine is not fully operational. 74 SOLAS (04 CONS.) Ch. II-1/ Reg. 26.6. action taken 40ac.

0925 - The following principles underlie the provisions as appropriate having regard to the category of craft and the potential fire hazard involved: detection, containment, and extinction of any fire in the space of origin. Crew was unable to demonstrate adequate fire fighting procedures - HSC(94)CH 7.1.1.5 - 10c

0660 - Lifejackets should be so placed as to be readily accessible and their positions should be clearly indicated. Lifejacket locker located port side at MES station does not have required amount of lifejackets as indicated - HSC(94)CH 8.3.6 - 16ac

0120 - the ring, lines and letters shall be painted in black on a light ground. Starboard side load line mark was not painted black. 66ICLL Annex I/ Ch.1 Reg.8

Manuals shall be in language understood by the crew. Vessel's working language is english, but manual mounts/instructions are previded only Spanish. HSC Ch.2/Reg 1.12.2

0945- All passenger public spaces and alleys shall be provided with supplementary electric lighting that can operate for at least 3 hours when all other sources of electrical power have failed. Vessel does not have any supplemental lighting installed. HSC(1994) Ch.12/Reg 12.7.9

0720- All fire hoses in interior locations shall be connected to the hydrants at all times. Interior fire hoses are not connected to hydrants. HSC (94) Ch.7/Reg.7.7.5.5

0915- Public spaces, evacuation routes, exits shall be clearly marked. Exit on second deck leading to FWD cargo area is marked improperly: as part of evacuation route. HSC (94) Ch.4/Reg 4.7.3

Life Jacket stowage shall be clearly and permanently marked. Stowage boxes and lockers for lifejackets do not reflect amounts stored inside. HSC(94) CH.4/Reg 4.7.7

0660- Lifejackets complying with requirements of paragraph 2.2.1 or 2.2.2 of the LSA code shall be provided for every person on board. Several adult and child sixe lifejackets are missing required lights. HSC(94) Ch.8/Reg 8.3.5

0920- Life-saving appliances and arrangements shall enable abandonment of the craft in accordance with requirements of 4.7. The information on the safety plan and the equipment found onboard are not the same; missing equipment listed on safety plan, location of equipment not in accordance with plan. HSC(94) Ch.8/Reg 8.1.1

2120 - vessel does not have MARPOL Garbage placards posted. MARPOL Annex V/Reg 9.1(a)

0750- Fire resisting divisions should be constructed as to be capable of preventing the passage of smoke and up to the end of the appropriate fire protection time. Open penetration identify in port and STBD switchboard rooms. HSC Code (94) CH.7/Reg7.2.1.3

0445- Emergency light on stairway starboard side aft escape route is inoperable. Lighting is not 7.4.1.2on port and starboard side switchboard rooms. HSC (94) CH12/ Reg

1720- A ship must have a placard at least 5x8 inches at each machinery space stating the following: Discharging of oil prohibited... No placard posted. 33CFR155.450

2055-Manual should contain at least the information specified in chapter 18 and should be in a language understood by the crew. Multiple publications on bridge are not in working language of the ship which is english. HSC (94) Ch.1.12.2

The Administration may waive the requirements of oil filtering equipment for a ship certified under the International Code of Safety for High-Speed Craft on vessels engaged on a scheduled service with a turn-around time not exceeding 24 hours. Vessel does not have a schedule service route annoted. 17ac

3. Arrangements shall be provided to permit a rapid shut down and effective closure of the ventilation system in case of fire. Fire dampers S15, S16, S17, S18, and S20 do not fully close as intended and have a gap. 17ac

4. Simple operating instructions with a block diagram showing the change over procedures for remote steering gear power unit shall be permanently displayed on navigational bridge and steering gear compartment. Instructions are missing in the bridge and block diagrams are missing in bridge and steering gear compartment. 17ac

5. The condition of the craft and its equipment shall be maintained to conform with the provisions of the HSC Code to ensure craft in all respects will remain fit to operate without danger to craft or person onboard. Port outer main engine is inoperable due to a broken cylinder head stud. 17ac

6. Port side external protective support for water jets is missing and there is a small crack (10-20 cm long) on the vessel’s protection flooding line in the bow hull knock. 17ac

There is a significant amount of water, unable to determine the source, in the spaces in the aft portion of the port steering compartments. 17ac

9. The steering gear compartment shall be provided with suitable arrangements to ensure working access to steering gear machinery and controls to include handrails and grating or other non-slip surfaces to ensure suitable working conditions in the event of hydraulic fluid leakage. The decks in the vessel’s port and stbd steering gear rooms are slippery due to residual oil 17ac

10. At least one search and rescue locating device shall be carried on each side of every passenger and cargo ship 500 GT and upward. Vessel starboard SART is expired. 17ac

11. Fire fighting appliances shall be kept in good order at all times. The last annual inspection for all EEBDs, fire extinguishers, SCBA, and CO2 bottles for fixed gas fire extinguishing systems was on 17MAR2015. 17ac

12. One half of the total number of lifebuoys shall be provided with self-igniting lights. Self igniting light of multiple lifebuoys (as assigned) are inoperable. 17ac
