AMERICAN INDEPENDENCE

Rails or equivalent protection must be installed near the periphery of all decks of a vessel accessible to passengers or crew. The deck rail on the aft embarkation deck was damaged due to an allision with a pier. Affect proper repairs to rail prior to passengers accessing the deck.

Each window, port hole, and its means of attachment to the hull or deck house, must be capable of with standing the maximum load from wave and wind conditions expected due to its location on the vessel and the authorized route of the vessel. Two windows on the staeboard side in the dining room were shattered. Repair windows to the satisfaction of the attending marine inspector.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection. Vessel suffered damage to superstructure during a marine casualty. Affect repairs to the satifcation of the attending marine inspection prior to next dry dock credit.

Electrical equipment on a vessel must be installed and maintained to provide services necessary for safety under normal and emergency conditions. Starboard side generator lost power due to low oil pressure from an oil leak in the pump. Centerline generator was found to be smoking on previous inspection. Provide third party technical report and conduct full operational test to the satisfaction of the attending marine inspector.

Electrical equipment installed and maintained on a vessel must provide services necessary for safety under normal and emergency situations. Vessel sustained a loss of their center generator which is 1 of 3 main generators. Vessel is required to only have 2 generator sets. Spoke with the Port Engineer and the Master to determine that the gen-set portion of the generator needs to be replaced. The watch stander saw smoke coming from the generator-set and he secured it while the generator was in parallel and this singled up the machine plant to one generator. This is not a reportable casualty considering they have 3 total main generators and they did not lose power or maneuverability. Vessel is to provide tech report and have CG come onboard and clear the CG-835V within 30 days of repair.

Machinery and equipment installed on each vessel must be suitable for the vessel and its operation and for the purpose intended. After new shaft installation and alignment, STBD engine transmission cooler improperly aligned with fixed piping resulting in cooler required to be temporarily ratchet strapped in place to maintain connection. 46 CFR 119.100

Vessel had to shut down stbd engine due to high crankcase pressure.

07107 - Vessels described by 46 CFR 114.110 (f) must submit plans to the cognizant OCMI for the installation and use of monitoring device(s) to ensure the wakefulness of the watchmen required by paragraph (a) of this section. The monitoring device(s) must ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive. ACL’s plan to comply with the SPV Fire Safety IFR requirements for monitoring devices as required by this regulation, entitled “Fire Watchkeeping Plan, Revision 1”, dated 30 January 2023, calls for the night watchman to carry a Motorola handheld radio with Lone Worker-Emergency function programmed, which will trigger an alarm if not keyed by the night watchman every <15 minutes. The only Motorola handheld radio with the Lone Worker-Emergency function available onboard has been inoperable for at least the past two weeks. 46 CFR 122.410(b) 705c: correct prior to 5/12/2023

07105 - Doors in A-Class fire control boundaries must meet the following additional requirements: A door must be of the self-closing type, capable of closing against a 3.5 degree list of the vessel. The following A class fire doors did not fully close and latch when tested: stairwell from deck 1 leading down to crew quarters, entry to dining room, port stabilizer room, and entry to laundry compartment. 46 CFR 116.435(c)(1) & (c)(6) 705c: correct prior to 5/12/2023 Update 12May23: the deck 1 stairwell and entry to dining room doors have been corrected to the satisfaction of the attending MIs. Partial repairs have been made to the laundry room and port stabilizer doors, with full repairs to follow. The due date for full repairs of these two remaining doors has been extended to 6/9/23. The vessel may carry passengers between now and 6/9/23. Update 22May23: laundry room door has been corrected, only the port stabilizer door repairs pend to date.

07115 - A duct penetrating an A-Class fire control boundary and opening into a space formed by that boundary must be equipped with a fire damper. Fire dampers in the engine room did not close when activated. 46 CFR 116.610(f)(4) 705c: correct prior to 5/12/2023

04103 - Each vessel must have adequate emergency lighting fitted along the line of escape to the main deck from all passenger and crew accommodation spaces located below the main deck. The emergency lights were inoperable in the dry food stores and forward passageway. 46 CFR 122.432 705c: correct by 5/12/2023

11117 - At least one ring buoy must be fitted with a floating waterlight. Each floating waterlight must be approved in accordance with 161.010. The waterlight for the ring lifebuoy is a model ACR SM-3. The relevant CG type approval certificate, 161.010/30/0, states that it is to be “powered by two removable AA lithium batteries to be replaced in accordance with the manufacturer's instructions. Not approved for use with alkaline batteries." The manufacturer’s instructions call for 2 AA lithium L91 batteries, to be replaced on an annual basis. At least one ring buoy must be fitted with a floating waterlight. The batteries currently in the waterlight onboard appear to be of the alkaline type. 46 CFR 117.70(d) 705c: correct by 5/12/2023

11108 - Every vessel equipped with an inflatable survival craft must have approved placards or other cards containing instructions for launching and inflating inflatable survival craft for the information of persons on board posted in conspicuous places by each inflatable survival craft. There are no instruction placards posted by each IBA. 46 CFR 122.518(a) 705c: correct by 5/12/2023

11199 - Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child and adult lifejackets are not segregated currently. 46 CFR 117.78(a)(5) 705c: correct by 5/12/2023

07105 - Doors in A-Class fire control boundaries must meet the following additional requirements: A-Class bulkheads or decks must be constructed that, if subjected to the standard fire test, they are capable of preventing the passage of smoke and flame for 1 hour. The boundaries surrounding the port and starboard stabilizer rooms are listed as A-60 on the current version of the fire control plan. On both doors there is a gap, large enough for a pen to fit in, between the door frame and the bulkhead so that it does not seat flush. The stabilizers may not be used until the doors have been fixed. 46 CFR 116.435(c)(1) 46 CFR 116.415(a)(2)(i) 50c

13199 - Unless it otherwise complies with this subpart, each self-propelled vessel must be provided with a main steering gear and an auxiliary steering gear. These gear must be arranged so that: transfer from the main to the auxiliary can be effected quickly. The port side cleat for the emergency steering was broken. 46 CFR 119.600 46 CFR 58.25-5(b)(2) 50c

11135 - Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. The vessel had no record of monthly EPIRB tests. The EPIRB was tested and the test logged while marine inspectors were on board. 46 CFR 122.728(a) 10c

Piping, including valves, pipe fittings and flanges, conveying vapor, gas, or liquid, the temperature of which exceeds 65.5°C (150 °F), must be insulated where necessary to prevent injuries. Exhaust lagging on port engine and middle generator missing or not fully covering exhaust piping. 46CFR116.970

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Wasted insulation and deadend wires observed on battery and battery charging cables. 46CFR120.200(b)

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child and adult life jackets are stowed together without adequate separation on upper weather deck. 46CFR117.78(a)(5)

Each life jacket, immersion suit, and ring life buoy must be marked in clearly legible block capital letters with the vessel’s name. Vessel name has not been updated on life jackets and ring life buoys. 46CFR122.604(b)

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with §80.59 once every five years. If the ship passes the inspection, the technician will issue a Communications Act Safety Radiotelephony Certificate. Vessel did not have a current Communications Act Safety Radiotelephony Certificate. 46CFR121.502 47CFR80.903

The Bridge-to-Bridge Act and the regulations of this part apply to [every power-driven vessel of 20 meters or over in length while navigating] in the navigable waters of the United States. Each vessel must carry a certificate with a valid endorsement while subject to the Bridge-to-Bridge Act. Vessel did not have a current Vessel Bridge-to-Bridge Radiotelephony Certificate. 46CFR121.502 47CFR80.1001

Where the general emergency alarm signal cannot be heard over the background noise, there must be a red-flashing light or rotating beacon, in addition to the general emergency alarm signal. Visual indicator was inoperable at time of inspection. 46 CFR 120.550(b) 46 CFR 113.25-10(a)

All audible and visual alarms must be audible and visible throughout the spaces they are intended to alert. Visual and audible alarms in engine room were inoperable at time of inspection. 46 CFR 118.400(c) 46 CFR 76.27-20(c)

Deck rails must be designed and constructed to withstand a point load of 91 kilograms (200 pounds) applied at any point in any direction. Railing at vessel's "aft swim platform" was not of suitable strength to withstand required load. 46 CFR 116.900(b)

The general construction of the vessel must be such as to minimize fire hazards insofar as it is reasonable and practicable. Overheads in electronics locker adjacent to second deck "Powder Room" and stores locker forward second deck ship's office were missing required structural fire protection at time of inspection. 46 CFR 116.405(a)

Suitable means, such as a manual damper, automatic damper, or vent cover, must be provided in an accessible location outside the space served by the ventilation duct for shutting off the passage of air through the ventilation duct in the event of fire. Dampers on vessel's bow leading to crew laundry did not fully close at time of inspection. 46 CFR 116.610(d)

Each door, hatch, or scuttle, used as a means of escape, must be capable of being opened by one person, from either side, in both light and dark conditions. Emergency escape from passageway adjacent forward crew laundry was unable to be opened from interior by one person. 46 CFR 116.500(i)

The installed ring life buoys were found unserviceable. Vessel is required three buoys, the outer coverings and grab lines were sun damaged on all of the installed buoys.

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of machinery including operation of the main propulsion machinery both ahead and astern. Vessel's port main propulsion engine was found to be not operational after blown piston rods during a sea trial. Vessel shall make repairs and notify the Coast Guard prior to getting underway with passengers.

Table 118.500(a) of this section indicates the minimum required number and type of extinguisher for each space listed. Vessel's port main engine suffered piston rod failures resulting in a fire on the engine. Vessel shall replace the portable fire extinguishers used to extinguish the fire.

The fire dampers in the engine room are not marked with red letters of at least 12.7 mm (0.5 in) in height stating "VENTILATION FIRE DAMPER".

Battery chargers are over 2KW and the vessel does not comply with the requirements of a large battery installation.
