In circumstances of exceptional necessity, Administrations, if in their opinion this does not cause danger to persons, property or the environment, may issue a dispensation permitting a specified seafarer to serve in a specified ship for a specified period...for which he does not hold the appropriate certificate, provided that the person to whom the dispensation is issued shall be adequately qualified to fill the vacant post in a safe manner, to the satisfaction of the Administration. Dispensation granted to allow 2AE to fill 1AE billet until 28FEB2026.

Night vision enhancement equipment shall be fitted. The installed HSC approved camera is inoperable. Flag state dispensation is granted due to delay in receiving camera replacement. Vessel is permitted to utilize hand-held night vision devices in lieu of fixed system. Flag dispensation will expire 23JUL2025. 74 SOLAS (24) X/3.1.2 HSC Code 13.10.1

All automatically or remotely controlled or monitored vital systems addressed by 46 CFR part 62 must be subject to tests and inspections to evaluate the operation and reliability of controls, alarms safety features, and interlocks. Test procedures must be submitted to the Coast Guard for approval. Persons designated by the vessel shall conduct all tests and the Periodic Safety tests shall be witnessed by the Coast Guard. Periodic Safety Test Procedure Documents approved by the Coast Guard must be retained aboard the vessel. Coast Guard approved Periodic Safety Test Procedures were not available during the inspection. Provide approved Periodic Safety test procedures that include the equipment requiring testing outlined in 46 CFR 61.40-6 (Periodic Safety Tests). The test procedure details are required to meet 46 CFR 61-40-10 (Test Procedure Details) for the equipment being tested. 46cfr 61.40-1

The main inlets and outlets of all ventilation systems shall be capable of being closed from outside the spaces being ventilated. Fire dampers SD 434 and SD 431 failed to close. 2000 HSC Code Ch. 7.6.1

Oil filtering equipment shall be of a design approved by the the administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 PPM. A T-fitting with a ball valve was installed on the discharge line to overboard between the OWS overboard valve and the skin valve. MARPOL Annex I Reg. 14.6

Each davit and winch must be marked with a plate or label permanently affixed to a conspicuous pace readily accessible for inspection and sufficiently durable to withstand continuous exposure to environmental conditions. Plate or label must contain: Name and address of manufacturer, manufacturers model identification, name of independent laboratory that witnessed prototype or production tests, serial number, U.S.C.G. approval number, month and year of manufacture, safe working load, the word. “SOLAS”. Port side rescue boat missing data plates for davit and winch. Additionally, rescue boat data plate missing condition A and condition B weight.46 CFR 160.132-17, 115-17

Any required fixed fire-detection and fire alarm system with manually operated call points shall be capable of immediate operation at all times. Three faults found standing on fire detection system panel (faults 128, 129, 156). HSC Code 7.7.1.1.1

Areas of major and moderate fire hazard should be enclosed by fire-resisting divisions complying with the requirements in the code. B-Class roller doors are inoperable/not fully closing between passenger spaces. SOLAS (2009 CONS) CH.X HSC Code 2000 7.4.2.1

Vessel's Continuous Synopsis Record (CSR) must be updated. Incorrect classification society listed on CSR for Document of Compliance and Safety Management Certificate issuance. SOLAS (2009 CONS) CH. XI-1/5.1.12(.13)

Engine safety devices shall be capable of being tested IAW on-board automation procedures. Vessel's automation procedures shall be revised to incorporate changes made in procedures during periodic testing. SOLAS (2009 CONS) CH.X HSC Code 2000 9.2.2

All exits should be adequately marked. Exit signage should be placed in messdeck areas IWO lockers. SOLAS (2009 CONS) CH.X HSC Code 2000 4.7.10

Make permanent repairs to the port fire pump. A hole was discovered on the discharge outlet piping of the port fire pump. Repairs will be made to the satisfaction of the attending marine inspector.

Identify root cause analysis of failure of the #2 Marine Evacuation System resulting in the rupture of portions if the evacuation slide.

Make permanent repairs to damaged area located on vessels port quarter. Priovide a detailed repair plan for review and approval before making repairs. Repairs are to be made to the satisfaction of the attending marine inspector or RO acting on behalf of USCG.

Verify arrangement of hydro release units on all life rafts.

Three life raft/MES are not onboard for servicing. Vessel is limited to 727 total persons allowed including crew until all MES and liferafts are serviced and on-board.

Rescue Boat is inoperable. Vessel is restricted to 450 passengers until repaired.

"Q" Board inverter does not operate properly. Repqir to allow transitional power to all emergency circuits. Vessel is permitted to operate without inverter under either of the following options: Option A: Operate the electric plant in a split bus configuration to separate Switchboard A and Switchboard B; ensuring power supply remains available to 5Q via the ABT. Option B: Operate a closed bus configuration with three parallel generators online – taking operational safety precautions. If a black out occurs, an operational check once power is brought back online to verify the loads from 5Q are available shall be conducted. Additionally, a verification checklist and process to confirm power supply checks after a failure shall be submitted electronically to ABS and USCG.

Structural Fire Protection insulation missing from forward mezzanine level structure must be installed.

Make temporary repair to breached starboard aft compartment utilizing an appropriate epoxy and water test the same after repairs are affected.

Make permanent repairs to starboard aft compartment at next scheduled dry dock date. 01) Crop and renew four tripped tripping brackets. 02) Crop and renew approximately 4' X 4' of damaged stbd. aft transom hull plate. 03) Crop and renew approximately 4' X 6' of damaged stbd. aft side shell hull plate. 04) Crop and renew approximately 6' of #1, 2, and 3 damaged side longitudinal frames IWO

Appropriately repair twisted deck beam damage caused by a vehicle located between frame 21 and 22 on the stbd side mezzanine car deck.

Make STBD Quarter, in way of damaged area, available to USCG for internal examination by CG Marine Inspector.

Port and Stbd quick releasing life rings were not of proper weight for intended quick release operation

Vessel is limited to total of 545 total person aboard until additional life rafts are provided. Only six are currently onboard. Must adhere to 110% required liferafts.

The automation test procedures for the ship's service diesel generators do not include specific alarm set points per 46 CFR 61.40-10(a). submit to the OCMI at Sector Hampton Roads updated test procedures that include specific alarm set points

Complete the remaining requirements of USCG Marine Safety Center Letter 16710/P013651 dated Nov 20, 2009 concerning the machinery space water mist system water supply arrangements.. Specific requirements in the letter pertain to the fresh water tank piping suction arrangements, additional sea water supply to the system, and the control arrangement for the sea water supply.

Provide Officer's certificates, licenses, type rating certificates, and crew documents as required by HSC Code 18.3, STCW 95 I & VI, and ILO 147 Art II.

Provide FCC Radio Operator Licesnse(s).

CG Marine Inspector to verify that safe manning for the vessel is IAW HSC Code Chapter 18, and 46 CFR Subchapter B.

Provide muster lists and emergency instructions as required by HSC Code 18.2.3, HSC Code 8.4.

Demonstrate proper operation of propulsion system including required independent means of propulsion for Category B Craft by HSC Code 9.7. The most likely casualty conditions must be simulated to the satisfaction of the attending CG Marine Inspector for delivery crew training and to check equipment response; e.g. loss of ships service generator, loss of lube oil etc

Provide USCG Certificate of Documentation.

Demonstrate proper operation of sound reception system to enable the officer in charge of the navigational watch to hear sound signals and determine their direction per HSC Code 13.14.

Provide approved Training Manual to include all the information required by HSC Code 18.2.3 and place in locations required under HSC Code 8.4.5.

Provide waste management plan to include all the information required by 33 CFR 151.57.

Provide designation of persons in charge of oil transfers per 33 CFR 155.700-715.

Demonstrate that a qualified person will be assigned only to radio communication duties during distress incidents per HSC Code 14.16.1.2.

Demonstrate that the crew is able to perform necessary and pollution prevention duties to include personal survival techniques, firefighting emergencies, and elementary first aid as required by STCW 95 VI/1

Demonstrate compliance with MARPOL Annex V and all of the requirements for shipboard control of garbage as required by 33 CFR 151.63.

Complete fire drill in accordance with HSC Code 18.5, MSM Vol II/22.C.7 and NVIC 6-91 to the satisfaction of attending CG Marine Inspector.

Complete damage control drill in accordance with HSC Code 18.5.10 to the satisfaction of attending CG Marine Inspector.

Complete evacuation drill in accordance with HSC Code 4.8 to the satisfaction of attending CG Marine Inspector.

Provide USCG Approved Vessel/Coast Guard SAR Plan in accordance with SOLAS 74/78 V/15.

Provide documentation and procedures that demonstrate compliance for the information on passengers as per HSC Code 18.2.5.

Provide Route Operation Manual as required by HSC Code 18.2.2 to local OCMI where vessel is to be operated.

Submit plans to install a 2655-gallon fresh water supply to the MSC. These plans shall be submitted no later then May 21, 2009. Upon MSC approval of your submitted plans, you are to install the fresh water supply in accordance with the approved plans no later then July 21, 2009.

Provide fuel oil transfer procedures that meet the requirements of 33 CFR 155.750.

Provide approved Shipboard Oil Pollution Emergency Plan in accordance with 33 CFR 151.26.

Install non-return valve in fire main system piping in way of generator and tunnel bulkhead as per approved drawing 615-652-000 Rev B, Detail 1 for both port and starboard hulls. To be completed by April 12, 2009 to satisfaction of attending Marine Inspector.

The Hi-Fog MIST System sea water pump electrical supply cable must be approved Fire Resistant cable that complies with IEC 60331.

Insulate fire main piping all the way up to hydrant valve with A60 insulation.

Insulate MIST System supply piping located in generator room.
