All ships of 300 gross tonnage and upwards irrespective of size shall be fitted with: a 9ghz radar, or other means, to determine and display the range and bearing of radar transponders and of other surface craft, obstructions, buoys, shorelines and navigational marks to assist in navigation and in collision avoidance. Vessels 9ghz radar was unable to operate as designed, radar is not transmitting and in standby mode. US Coast Guard Sector LA-LB granted a deviation of the Navigation Safety Regulations for an inbound/outbound transit of U.S. waters in and out of the Port of Los Angeles – Long Beach with an inoperable X-Band Radar, codified in 33 CFR 164.37(b): On each tanker of 10,000 gross tons or more that is subject to 46 U.S.C. 3708, the dual radar system required by this part must have a short range capability and a long range capability.
