The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States ... must properly maintain the BWMS in accordance with all manufacturer specifications. Ballast water management system is currently inoperable due to a failure in the units filter scanner motor. The vessel is required to conduct a mid-ocean exchange of untreated ballast water at least 12 NM offshore prior to discharging ballast water within the Sector Delaware Bay COTP zone. Additionally, vessel is required to repair the ballast water treatment system prior to further ballast operations to the satisfaction of class. 33 CFR 151.2025 705a

The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the following ballast water management methods: Install and operate a ballast water management system (BWMS) that has been approved by the Coast Guard under 46 CFR part 162. The BWMS must be installed in accordance with § 151.2035(b) of this subpart. Following installation, the master, owner, operator, agent, or person in charge of the vessel subject to this subpart must properly maintain the BWMS in accordance with all manufacturer specifications. Ballast water management system is currently inoperable due to a cracked fitting on the discharge side of the ballast pump. Deficiency shall be rectified prior to operation of ballast water management system.
