To discharge ballast water into the waters of the United States, the master, owner, operator, agent, or person in charge of a vessel subject to 151.2025 of this subpart must either ensure that the ballast water meets the ballast water discharge standard in 151.2030(a), use an AMS, or ballast with water from a US public water system. Subject vessel, of keel laid date 2006 and ballast water capacity of 43185 m3, is past its compliance date per the implementation schedule in 33 CFR 151.2035(b). Currently, vessel's installed BWTS is inoperative. Vessel authorized one time discharge under extraordinary circumstance clause.
