To discharge ballast water into the waters of the United States, the master, owner, operator, agent or person in charge of a vessel subject to 151.2025 of this subpart must either ensure that the ballast water meets the ballast water discharge standard in 151.2030(a), use an AMS as described in 151.2025(a)(3), or ballast with water from a U.S. public water system, according to the schedule in paragraph (b) of this section. Subject vessel, of keel laid date 17NOV1999 and ballast water capacity of 19654 m3, is past its compliance date per the implementation schedule in 33 CFR 151.2035 (b). Vessel’s current ballast water management method is exchange and discharge, which is not authorized. Vessel has no BWTS installed.Vessel is not authorized to discharge untreated ballast into U.S. waters. This deficiency will not be cleared until CG examiners receive documentation that the vessel has installed a BWTS, has decided to use on public water from the U.S. public water system, or has updated its ballast water management plan to state that the vessel’s ballast water management method in U.S. waters is no discharge.

A vessel equipped with ballast water tanks that operates in the waters of the United States must maintain a ballast water management plan that has been developed specifically for the vessel and that will allow those responsible for the plans implementation to understand and follow the vessel's ballast water management strategy and comply with the requirements of this subpart.Vessel’s ballast water management plan does not reference the must up-to-date version of 33CFR151 Subpart D.

07126 -The porpuse of this regulation is to limit the growth potential in every space. means of control for flammable liquid tranfer pipe form pump to purifing room has leak. Crew had 2 drip pan caughting oil that was leaking form a flang. SOLAS 2004 11-2 reg 5.1.2

13197-After survey of the ship under this regulation has been completed no changes shall be made in structual arrangement. Tank locaed in purifiing room quick closing valve was no connected. Solas 2004 1/11.a

1420- 74 SOLAS (04) II-1/ 26.7- Provisions shall be made to facilitate cleaning inspection and maintenance of main propulsion and auxilary machinery. PSCO observed oily rags and containers with oil scattered throughout the engine room.

1410- 74 SOLAS (01) II-2/ 15.2- The arrangements for the distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. PSCO observed excesive fuel oil located on the vacinity of the #8 cylinder injector valve.

THE MACHINERY SYSTEMS AND FITTINGS SHALL BE ADEQUATE FOR THE SERVICE FOR WHICH THEY ARE INTENDED. THE DESIGN SHALL HAVE REGARD TO MATERIALS USED FOR THH PURPOSE FOR WHICH THE EQUIPMENT IS INTENDED. THE VESSEL COULD NOT MAINTAIN PROPULSION WHILE ATTEMPTING TO GET UNDERWAY FROM BAYPORT CONTAINER TERMINAL. 74SOLAS(2001) II-1/26

1430-Auxiliary engines-The condition of the ship and its equipment shall be maintained to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed fuel oil leaking from the low pressure fuel rail on #1 and #4 generators. Generators shall not be used until proof of repair has been provided. SOLAS 14 I/11 16a

1410-Propulsion main eng-The condition of the ship and its equipment shall be maintained to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed what appears to be several exhaust leaks on the turbo on the vessels main engine. Provide clarification from class as to the integrity of the exhaust system SOLAS 14 I/11 16a

2120-Garbage-Every ship of 400 GT and above shall carry a garbage management plan which the crew shall follow. This plan shall provide written procedures for collecting, storing, processing and disposing of garbage. PSCO observed excessive storage of oily rags in plastic bags in the engine room. Garbage management plan does not provide instruction for the storage of excess oily rags. MARPOL V/9 16

0936-Steering Gear-The condition of the ship and its equipment shall be maintained to conform with the provisions of regulation to ensure the ship will remain fit to proceed to sea without danger to the ship or persons on board. Steering gear system No.1 follow up mode is not operational. '74 SOLAS ('14 Cons.) CH.I/Reg.11A; 17AC

1470 - The condition of the ship and its equipment shall be maintained to conform with the provisioons of the present regulations to ensure tha the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Oil soaked lagging was discovered in the purifier room, presenting a fire hazard to the vessel and its crew. 74 SOLAS (14) I/11a.

1499 - Every steam pipe and every fitting connected thereto through which steam may pass shall be so designed, constructed and installed as to withstand the max. working stresses to which it may be subjected. The valve leading from the boiler to heat the heavy oil fuel tank was found leaking steam into the engine room. 74 SOLAS (04 cons) II-1/33.1
