The owner and managing operator must ensure that the towing vessel is in compliance with this subchapter and other applicable laws and regulations at all times. Due to the totality of below deficiencies regarding active fire hazards, machinery function, life saving, fire fighting, drills, training, and records, vessel is unfit for route and service in its present condition. Deficiencies suggests company is not proactively managing vessel with regards to the implementation and sustainment of Subchapter M compliance. Provide repair and sustainment plan to the satisfaction of the OCMI. 46 CFR 137.120 (a)

Each towing vessel must be maintained and operated so as to minimize fire hazards. Starboard online generator had active oil leaks coming from head and valve cover gaskets leaking onto uncovered exhaust manifold. Repair starboard generator oil leaks. 46 CFR 142.220

Each towing vessel must be maintained and operated so as to minimize fire hazards. Port generator has oil leaking from a hole in the exhaust pipe above manifold mounting flange. Oil accumulation has hardened and saturated the bottom of the exhaust blanket. Repair oil leak and hole in exhaust piping and replace exhaust blanket. 46 CFR 142.220

Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. During man overboard drill, port main engine high jacket water and low oil pressure alarm sounded and remained on. Repair port engine and prove proper operation prior to movement.46 CFR 143.205 (a)

To stop the flow of fuel in the event of a fire or break in the fuel line, a remote fuel shutoff valve must be fitted on any fuel line that supplies fuel directly to a propulsion engine or generator prime mover. The valve must be installed in the fuel piping directly outside of the fuel oil supply tank. The valve must be operable from a safe place outside the space where the valve is installed. Each remote valve control must be marked in clearly legible letters, at least 25 millimeters (1 inch) high, indicating the purpose of the valve and the way to operate it. The remote fuel valve shut off cable would only close the pipe 50%. Pull cable activation point is not labeled properly with purpose or how to activate. Prove proper operation of fuel shut off valve and proper station marking to the satisfaction of the marine inspector.46 CFR 143.260 (b)-(e)

Each towing vessel must carry at least one appropriately-sized lifejacket, approved under approval series 160.002, 160.005, 160.055, 160.155, or 160.176, for each person on board. Vessel had no approved lifejackets onboard. All lifejackets were approved under 160.064 and not for use on an inspected commercial vessel. Renew all 6 lifejackets with the appropriate type approval.46 CFR 141.340 (a)

At least two lifebuoys on a towing vessel greater than 26 feet must be fitted with a floating electric water light approved under approval series 161.010 or 161.110, unless the towing vessel is limited to daytime operation, in which case no floating electric water light is required. Batteries installed in the electronic floating lights were not of the appropriate type as approved by the manufacture. Replace batteries with approved type as marked on the floating electric light.46 CFR 141.360 (b)(2)

Each life float and rigid buoyant apparatus must be fitted with a lifeline, pendants, a painter, and floating electric water light approved under approval series 161.010. Batteries installed in the electronic floating lights were not of the appropriate type as approved by the manufacture. Replace batteries with approved type as marked on the floating electric light.46 CFR 141.325 (C)

A towing vessel of 26 feet or more in length and more than 600 horsepower, engaged in commercial service must have an operational Coast Guard type-approved AIS Class A device. Vessel crew was not updating their AIS message broadcast appropriately. The vessel was moored to a dock at the time of inspection the vessels AIS was broadcasting that they were at anchor.33 CFR 164.46 (b)

Fuel systems for towing vessel main engines and generators must have a documented maintenance plan to ensure proper operation of the system. No evidence of maintenance plan for engine fuel filters and systems. 46 CFR 143.255(a)

If a dedicated storage cabinet is provided it must be secured to the vessel so that it does not move and must be either: (1) A flammable liquid storage cabinet that satisfies UL 1275 (incorporated by reference, see §136.112 of this subchapter); or (2) A flammable liquid storage cabinet that satisfies FM Approvals Standard 6050 (incorporated by reference, see §136.112 of this subchapter); or (3) Another suitable steel container that provides an equivalent level of protection. The front door and frame of the paint locker are caved in leaving a gap in the top side and unable to fully close. Renew paint locker. 46 CFR 142.225(c)(1)-(3)

No person may operate any vessel equipped with installed toilet facilities unless it is equipped with an operable Type II or III device that has a label on it under §159.16 or that is certified under §159.12 or §159.12a. The MSD approval label is missing. Provide approval label from manufacturer attesting to MSD approval standard. 33 CFR 159.7(a)

The owner or managing operator must implement procedures to identify and mitigate health and safety hazards, including but not limited to biological hazards. There are holes in the sewage overboard pipe in the overhead near the port main engine allowing sewage and associated biological hazards/gases to leak into the engine room. Replace piping to prevent leakage into engine room. 46 CFR 140.510 (a)(6)

Survival craft and stowage locations must be marked in accordance with the requirements of §§199.176 and 199.178 of this chapter. Each life float should be marked with the capacity of the life float stowed there. Life float was not marked with capacity. Mark life float with 2” block lettering of life floats carrying capacity as approved by manufacture. 46 CFR 141.315

Prior to assuming duties related to the safe operation of a towing vessel, each crewmember must receive navigation safety training. The training must be recorded in the towing vessel record book. 02 deckhands did not receive navigation safety training. Conduct navigation safety training for the 02 deckhands and document training in the towing vessel record book. 46 CFR 140.645

Crew member training required by 46 CFR 140.515 must be conducted as soon as practicable, but no later than 5 days after employment and must be documented in the owner and managing records. 01 deckhand did not receive the training required (health and safety training) by 46 CFR 140.515. Conduct training required by 46 CFR 140.515 and document training in the owner and managing records. 46 CFR 140.515

The officer in charge of a navigation watch must conduct a navigation assessment for the intended route and operations prior to getting underway. Navigation assessments are not being conducted prior to getting underway. Conduct navigation assessment prior to getting underway and record the navigation assessment in the towing vessel record.

The master of a towing vessel must ensure that drills are conducted and instructions are given to ensure that all crew members are capable of performing the duties expected of them during emergencies. The master has not conducted the emergency drill and trainings required in 46 CFR 140.420. Conduct emergency drills and training. 46 CFR 140.420 Record the emergency drills and training in the towing vessel record.

Emergency procedures related to the tow must be developed and appropriate training must be provided to the crew for carrying out their emergency duties. Develop emergency procedures related to the tow and provide training for the crew for carrying out their emergency duties. Document training of emergency procedures related to the tow in the the towing vessel record book.46 CFR 140.801(c)

All lifesaving equipment must be tested and maintained in accordance with the minimum requirements of 46 CFR 199.190, and inspections and tests of lifesaving equipment must be recorded in the towing vessel record book. Lifesaving equipment has not being tested and maintained in accordance with 46 CFR 199.190. Conduct inspections and tests of lifesaving equipment in accordance with 46 CFR 199.190 and record lifesaving equipment in the towing vessel record book.46 CFR 141.235

A crew accommodation space and a work space must be of sufficient size, adequate construction, and with suitable equipment to provide for the safe operation of the vessel and the protection and accommodation of the crew in a manner practicable for the size, facilities, service, route, and modes of operation of the vessel. Vessel has steel wastage in the overhead of the engine room separating it from the 01 deck head. Wasted steel appears to have a steel plate, epoxy and paint over it. Provide report of previously repaired steel and repair proposal to the satisfaction of the attending marine inspector. 46 CFR 144.700 (a)

Portable watertight containers for pyrotechnic distress must be clearly marked with "DISTRESS SIGNALS". The portable watertight container was not marked in accordance with 46 CFR 141.375(c)(1). Mark portable watertight container in accordance with 46 CFR 141.375(c)(1).

A towing vessel subject to Subchapter M, under the Coast Guard option, must undergo an annual inspection within 3 months before or after the COI anniversary date. The vessel's COI was issued on 16AUG2019 with an anniversary date of August 16. No annual inspection was scheduled or completed within 3 months of the anniversary date in 2020. At this time, the COI issued to the DEAN on 16AUG19 is considered invalid. A new COI inspection shall be scheduled with the cognizant OCMI prior to conducting movement to ensure the vessel is in compliance with 46 CFR Subchapter M. If an inspection is desired in another port, a cursory safety exam shall be conducted by the cognizant OCMI prior to movement.
