A towing vessel that is certificated for lakes bays and sounds route must have an approved 160-B semi portable OR fire extinguishing system installed to protect the engine room. The vessel did not have a 160-B semi- portable extinguisher on board as required by the COI. Install onboard.

Portable and semi portable fire extinguishers must be inspected, maintained and tested in accordance with NFPA 10 to include monthly and annual inspections. Vessel had not completed monthly or annual inspections on the portable fire extinguishers since 2021.

A towing vessel of at least 26 feet, but less than 79 feet, in length must carry a minimum of two lifebuoys located on opposite sides of the vessel where personnel are normally present. To include applicable lifelines and operational floating electric water light(s). Onboard lifebuoys were deteriorated. Replace lifebuoys and lifebuoy attachments.

Each life float and rigid buoyant apparatus must be fitted with a lifeline, pendants, a painter, and floating electric water light approved under approval series 161.010. Life float was missing the required floating electric water light and attached lines were deteriorated. Install light and replace attached lines.

When operating a vessel on a body of water where the discharge of untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods of securing the device include — (1) Closing each valve leading to an overboard discharge and removing the handle; (2) Padlocking each valve leading to an overboard discharge in the closed position; or (3) Using a non-releasable wire-tie to hold each valve leading to an overboard discharge in the closed position. MI observed sewage valve open which would allow for a discharge of sewage into the water. Secure MSD valves.

The owner or managing operator must provide and implement a health and safety plan. Vessel did not have a health and safety plan on board. Provide for Marine Inspector review.

Fire-detection systems must be inspected or tested at least once every 12 months to include all smoke-and fire detection systems including detectors and alarms. Marine Inspectors witnessed operational test of smoke detector in accommodation space but were unable to witness testing of any heat detectors installed onboard. Vessel crew stated they did not know how to test heat detectors. Provide annual servicing/testing records for Marine Inspector review.

The design of the fire detection system and its installation on a towing vessel must be certified and inspected by a registered professional engineer with experience in fire-detection system design, by a technician with qualifications as a National Institute for Certification in Engineering Technologies (NICET) level IV fire alarm engineering technician, or by an authorized classification society with equivalent experience. Marine Inspectors could not identify system certification while onboard. Provide proof of system certification and proper installation.

The master must ensure that all hatches, doors, and other openings designed to be watertight or weathertight function properly. MIs identified multiple deteriorated hatches and sealing gaskets. Complete repairs.

Each towing vessel must carry on board and maintain the following: Charts or maps. Marine charts or maps of the areas to be transited, published by the National Ocean Service (NOS), the ACOE, or a river authority that satisfy the following requirements: The charts or maps must be of a large enough scale and have enough detail to make safe navigation of the areas possible. In addition, the charts must be either - Current editions or currently corrected editions, if the vessel engages in towing exclusively on navigable waters of the U.S., including Western Rivers. Vessel did not have updated paper charts. Provide current nautical charts or complete all applicable updates to make charts current.

Each towing vessel must be equipped with navigation lights, shapes, and sound signals in accordance with the International Regulations for Prevention of Collisions at Sea (COLREGS) or 33 CFR part 84 as appropriate to its area of operation. Vessel did not have day shapes onboard. Provide day shapes for applicable scope of work.

The towing vessel record (TVR) must include all items required from 46 CFR 140.915. Numerous records were missing from the TVR.

FCC Station documents must be readily available to the licensed operator(s) on duty during the hours of service of the station and to authorized Commission employees upon request. FCC Station license was not found onboard. Provide for Marine Inspector review. Cite: 47 CFR 80.403

All marine employers must provide and implement a drug and alcohol program which includes the required information from 46 CFR 16. Vessel did not have any documentation on board for their Drug and Alcohol program. Provide documentation for required program.

The employer shall provide an Employee Assistance Program (EAP) for all crew members. Master could not provide any documentation for an EAP. Provide required documentation.

The master or person in charge of a ship to which this section applies shall ensure that one or more garbage placards are displayed in prominent locations and in sufficient numbers so that they can be read by the crew. Vessel missing required garbage placards. Cite: 33 CFR 151.59

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. Marine Inspector observed the door of an electrical panel in the galley that would not stay secured in the closed position. Repair securing latch.

An exposed hazard such as gears and rotating machinery, must be protected by a cover, guard or rail. Marine Inspector found port and starboard ventilation fans in top level of engine room to have no protection to coming into contact with rotating fan blades. Provide fan guards.

Windows and other openings at the operating station must be of sufficient size and properly located to provide a clear field of vision for safe operation in any condition. Marine Inspector found aft pilot house windows covered and blocked. Remove covering.

The original COI must be framed under glass or other transparent material and posted in a conspicuous place onboard the towing vessel. If posting is impracticable, the COI must be kept on board in a weathertight container and must be readily available. Vessel captain was not able to locate expired COI. Once newly issued COI is available, post as appropriate.

A towing vessel subject to this subchapter and choosing the Coast Guard inspection option, or required to have the Coast Guard inspection option, must undergo an annual inspection within 3 months before or after the COI anniversary date. Vessel did not conduct an annual inspection. Successfully complete a renewal COI to the satisfaction of the attending CG Marine Inspector. Vessel is authorized to transit to have the COI conducted.

All owners and operators of an existing towing vessel must have a valid COI prior to the specified phase-in period. This vessel is one of the associated fleet that has not obtained a valid COI. The vessel shall be made available for a Coast Guard COI inspection within 90 days. If an inspection is not completed prior to this date, the action for this deficiency shall be changed to a 60 (Rectify deficiencies prior to movement) and the vessel may no long be permitted to operate.

All bilges and void spaces are kept free from accumulation of combustible and flammable materials and liquids insofar as practicable. Identified excessive amounts of oil throughout the engine room bilge, up to 4 inches, beneath the port & stbd engines & generators, fuel manifold, & the other portions of the engine room, posing an imminent hazard to the crew & environment, a serious substandard condition not being pro-actively managed. 46 CFR 142.220(a)

Each towing vessel must be maintained and operated so as to minimize fire hazards. Lagging around the generator is soaked in oil posing an imminent hazard to the crew & environment. Replace lagging & clean generators of oil. 46 CFR 142.220(a)

Each towing vessel must be fitted with a general alarm. The general alarm was inoperable, not displaying audio signals nor red visual indicator in the engine room, crew unable to identify the cause and duration. 46 CFR 143.235

Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. The following alarms must be provided: High bilge alarm. Bilge alarm not functioning, crew unable to identify the cause and duration. 46 CFR 143.230

The fire detection systems onboard the vessel must be inspected or tested at least once every 12 months, The records of inspections and tests of fire-detection systems and fixed fire-extinguishing systems must be recorded in the TVR, official logbook, or in accordance with any TSMS applicable to the vessel. No records were found of current servicing, exceeded the 12 month servicing interval. 46 CFR 142.240

A B–II portable fire extinguisher must be located near the storage room or cabinet. Fire locker was missing a B-II portable extinguisher. 46 CFR 142.225(d)

To stop the flow of fuel in the event of a fire or break in the fuel line, a remote fuel shutoff valve must be fitted on any fuel line that supplies fuel directly to a propulsion engine or generator prime mover. The valve must be operable from a safe place outside the space where the valve is installed. The remote shutoff valve was frozen, & unable to be closed in the event of an emergency, posing an imminent hazard to the crew & environment, a serious substandard condition not being pro-actively managed. 46 CFR 143.260(d)

Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. The port main engine has large residue on it indicating repeated exhaust leaks, identify the cause and address, also creates an unsafe breathing condition during operations, to be fixed prior to movement of the vessel. 46 CFR 143.205(a)

Rails or equivalent protection must be installed near the periphery of all decks accessible to crew. Equivalent protection may include lifelines, wire rope, chains, and bulwarks that provide strength and support equivalent to fixed rails. In areas where space limitations make deck rails impractical, such as at narrow catwalks in way of deckhouse sides, hand grabs may be substituted. No railing or hand grabs alongside the side deck superstructure, creating an unsafe condition for crew members to fall overboard. Due in 14 days. 46 CFR 144.800

A towing vessel must be maintained and operated so the watertight integrity and stability of the vessel are not compromised. The port and stbd weather/watertight doors do no properly seal when closed, and have corrosion holes in frame, crop and renew with good material, or replace as necessary. Engine room doors are missing gaskets. Due in 14 days. 46 CFR 140.605(b)
