On a merchant vessel of the United States the construction of which began after March 4th, 1915..(5) each crew berthing area shall be equipped with information regarding-(A) vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage; and(B) procedures and resources to report crimes, including sexual assault and sexual harassment, including information-(i) on the telephone number, website address, and email address for reporting allegations of sexual assault and sexual harassment to the Coast Guard;(ii) on vessel owner or company procedures to report violations of company policy and access resources; (iii) on resources provided by outside organizations such as sexual assault hotlines and counseling;(iv) on the retention period for surveillance video recording after an incident of sexual harassment or sexual assault is reported; and (v) additional items specified in regulations issued by, and at the discretion of, the Secretary of the department in which the Coast Guard is operating. 46 U.S.C. 11011(a)(5)

In each washing space in a visible location there shall be information regarding procedures and resources to report crimes upon the vessel, including sexual assault and sexual harassment, and vessel owner or company policies prohibiting sexual assault and sexual harassment, retaliation, and drug and alcohol usage. (a) In General.-The owner of a vessel subject to inspection under section 3301 shall- (1) ensure that such vessel is equipped with a vessel master key control system, manual or electronic, which provides controlled access to all copies of the vessel's master key of which access shall only be available to the individuals described in paragraph (2); (2) establish a list of all crew, identified by position, allowed to access and use the master key and maintain such list upon the vessel, within owner records and included in the vessel safety management system; (3) record in a log book information on all access and use of the vessel's master key, including- (A) dates and times of access; (B) the room or location accessed; and (C) the name and rank of the crew member that used the master key; and (4) make the list under paragraph (2) and the log book under paragraph (3) available upon request to any agent of the Federal Bureau of Investigation, any member of the Coast Guard, and any law enforcement officer performing official duties in the course and scope of an investigation. 46 U.S.C. 3106

Vessel is to maintain feedwater chemistry in accordance with the boiler manufacture’s technical manual. Prove proper feedwater chemistry to the satisfaction of the attending USCG Marine Inspector.

At each inspection for certification and periodic inspection, the inspector shall examine the tank tops and bilges in the machinery spaces to see that there is no accumulation of oil which might create a fire hazard. Vessel has accumulated an excessive amount of oily water and oily build up in the engine room. 46 CFR 91.25-40

Each boiler, including superheater, reheater, economizer, auxiliary boiler, low-pressure heating boiler, and unfired steam boiler, must be available for examination by the marine inspector at intervals specified by Table 61.05–10, and more often if necessary, to determine that the complete unit is in a safe and satisfactory condition. When a hydrostatic test is required, the marine inspector may examine all accessible parts of the boiler while it is under pressure. Port boiler is overdue for required inspections. 46 CFR 61.05-10

Except as provided in paragraphs (b) through (g) of this section, each vessel must undergo drydock, internal structural, and cargo tank internal examinations as follows:Except under paragraph (a)(2) of this section, vessels that operate in salt water must be examined in accordance with the intervals set forth in Table 91.40–3(a) of this section. Vessel is overdue for completing required internal structural exams.

If, during an internal structural, cargo tank internal examination, or underwater survey, damage or deterioration to the hull plating, structural members, or cargo tanks is discovered, the Officer in Charge, Marine Inspection, may require the vessel to be drydocked or otherwise taken out of service to further assess the extent of the damage and to effect permanent repairs. #3 Port Deep tank has through thickness deterioration providing free communication from the tank to the engine room. Permanent repairs to be completed. 46CFR91.40-39(c)

Each fuel oil tank with at least one side integral to the vessel's hull and located within the hull (“integral fuel oil tank”) is subject to inspection as provided in this section. The owner or operator of the vessel shall have the tanks cleaned out and gas freed as necessary to permit internal examination of the tank or tanks designated by the marine inspector. Make tanks 5P DB and 3S DB clean and available for inspection by 31DEC2024. 46 CFR 91.43-1(a)

Each fuel oil tank with at least one side integral to the vessel's hull and located within the hull (“integral fuel oil tank”) is subject to inspection as provided in this section. The owner or operator of the vessel shall have the tanks cleaned out and gas freed as necessary to permit internal examination of the tank or tanks designated by the marine inspector. Make 2P DB clean and available for inspection by 31DEC2025. 46 CFR 91.43-1(a)

Each fuel oil tank with at least one side integral to the vessel's hull and located within the hull (“integral fuel oil tank”) is subject to inspection as provided in this section. The owner or operator of the vessel shall have the tanks cleaned out and gas freed as necessary to permit internal examination of the tank or tanks designated by the marine inspector. Make 1 CL DB clean and available for inspection by 31DEC2026. 46 CFR 91.43-1(a)

Each fuel oil tank with at least one side integral to the vessel's hull and located within the hull (“integral fuel oil tank”) is subject to inspection as provided in this section. The owner or operator of the vessel shall have the tanks cleaned out and gas freed as necessary to permit internal examination of the tank or tanks designated by the marine inspector. Make tanks 2S DB and 3P DB clean and available for inspection by 30NOV2027. 46 CFR 91.43-1(a)

It shall be the duty of the master or PIC to ensure the vessel’s firefighting equipment is at all times ready for use and maintained properly. One of two SCBA’s found not operational.

In the inspection of hulls, boilers, and machinery of vessels, the standards established by ABS and the certificate of classification shall be accepted as standard by the inspectors. Vessel’s Class Certificate is expired due to overdue drydock exam. Provide documentation for force majeure details.

All officers on a vessel must have their licenses or officer endorsements conspicuously displayed. Onboard documentation for credentialed mariners was insufficient to determine whether mariners were qualified for the position they were serving or that the credentials were not expired.

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: Spaces storing carbon dioxide - “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. VENTILATE THE AREA BEFORE ENTERING. A HIGH CONCENTRATION CAN OCCUR IN THIS AREA AND CAN CAUSE SUFFOCATION.”. CO2 warning sign missing outside main CO2 storage room.

Electric installations on vessels must ensure: Protection of passengers, crew, and other persons, and the vessel from electrical hazards. Cargo hold 5 tween deck had daisy chained electrical cords near laundry.

There shall be at least two means of escape from areas where crew is normally employed. Multiple escape trunks from engine room and lower cargo holds found cluttered with cables or other debris that would hinder emergency escape.

Every crewmember must participate in at least one abandon ship drill and one fire drill every month. The OCMI may accept other equivalent drill arrangements for those classes of vessel for which compliance with this paragraph is impracticable. Historic record of safety drills was not available. Current records have a gap of 6 months with no drills conducted. Drill intervals found insufficient based on ship operations.

Approved portable fire extinguishers must be installed in accordance with Table 95.50-10(a) of this section. The location of the equipment must be to the satisfaction of the [name withheld] portable extinguishers onboard found not properly secured.

It shall be the duty of the master or PIC to ensure the vessel’s firefighting equipment is at all times ready for use and maintained properly. Main deck emergency locker found locked with combination lock.

Nontank vessels subject to this subpart may not—continue to operate on the navigable waters of the United States if—The vessel is not operating in compliance with the submitted VRP. Vessel could not provide documentation that the engineering crew, holding responsibility for spill response mitigation, had been provided training or participated in emergency procedures exercises as required by the approved NTVRP. Correct prior to operating any machinery or conducting transfer operations.

No person may operate a U.S. non-oceangoing ship in the navigable waters of the United States, unless it has the capacity to retain on board all oily mixtures and is equipped to discharge these oily mixtures to a reception facility. Vessel witnessed discharging bilge water ashore via their sewage connection without valid approval permitting from the municipality. Discharge was not made through oily-water separating equipment as is required with municipal permits. Correct prior operating machinery or conducting transfer operations.

Fire pumps may be used for other purposes provided at least one of the required pumps is kept available for use on the fire system at all times. In no case shall a pump having connection to an oil line be used as a fire pump. Water produced by the ships fire pump was witnessed bearing what appeared to be a petroleum oil sheen. Correct prior operating machinery or conducting transfer operations.

Safety and relief valves for steam or air service shall be provided with a substantial lifting device so that the disk can be lifted from its seat when the pressure in the vessel is 75 percent of that at which the valve is set to blow. 02 relief valves were identified on the #220 steam line just forward of the stbd boiler missing their lifting devices.

No more than 19 liters (five gallons) of flammable liquids may be stowed in any machinery space. The flammable liquids must be in containers of 3.8 liters (one gallon) or less. Paints and solvents were found in shaft alley outside of the installed paint lockers in containers exceeding the one gallon limit.

Items of equipment, which are in use on vessels, previously approved by the Commandant but not complying with the latest specification requirements may be continued in use so long as they are maintained in good and serviceable condition to the satisfaction of the Officer in Charge, Marine Inspection, until replacement is deemed necessary by such officer or as specified in the regulations. The viewing port on the middle aft burner of the stbd boiler has broken lose and is no longer maintaining a boundary for the furnace.

If a District Commander determines that the overall safety of the persons on board a vessel will not be significantly reduced, the District Commander may grant an exemption from compliance with a provision of this part to a specific vessel for a specified geographic area within the boundaries of the Coast Guard District. This exemption may be limited to certain periods of the year. Requests for exemption under this paragraph must be made in writing to the OCMI for transmission to the District Commander for the area in which the vessel is in service or will be in service. If the exemption is granted by the District Commander, the OCMI will endorse the vessel's Certificate of Inspection with a statement describing the exemption. Vessel identified utilizing a passenger vessel primary lifesaving allowance not applicable to the vessel. Vessel shall submit a proposal detailing their requested number and type of lifesaving appliances for review.

Items of equipment, which are in use on vessels, previously approved by the Commandant but not complying with the latest specification requirements may be continued in use so long as they are maintained in good and serviceable condition to the satisfaction of the Officer in Charge, Marine Inspection, until replacement is deemed necessary by such officer or as specified in the regulations. Main circ pump was identified as having a broken slinger ring which has been held together by a hose clamp. Correct prior to credit drydock.

Items of equipment, which are in use on vessels, previously approved by the Commandant but not complying with the latest specification requirements may be continued in use so long as they are maintained in good and serviceable condition to the satisfaction of the Officer in Charge, Marine Inspection, until replacement is deemed necessary by such officer or as specified in the regulations. The fire/general service pump has a hose clamped rubber patch on the discharge line connection point. Correct prior to credit drydock.

It shall be the duty of the master or PIC to ensure the vessel's firefighting equipment is at all times ready for us and maintained properly. Portable fire extinguisher #11 did not have an inspection tag showing it is being properly maintained and serviced.

Before the vessel leaves port and at all times during the voyage, each lifesaving appliance must be in working order and ready for immediate use. 175 adult life-jackets were condemned due to non-serviceability. Replace all 175 condemned life-jackets prior to issuance of next Excursion Permit in order to maintain 900 passenger count.

There shall be at least two means of escape from areas where crew is normally employed. Escape platform from the engineroom on the 02 deck is blocked with miscellaneous books and equipment. Remove all excess material prior to issuance of next Excursion Permit.

It shall be the duty of the master or PIC to ensure the vessel's firefighting equipment is at all times ready for us and maintained properly. Condemned on (1) fire hose. Vessel replaced with a new hose.

Each vessel must undergo internal structural examinations in accordance with the intervals set forth in Table 91.40-3(a). Where Table 91.40-3(a) indicates a 2.5 year examination interval, it means a vessel must undergo two examinations within any five year period. 1 Center DB Ballast tank is overdue for internal inspection.

The position of the rudder, if power-operated, must be shown at the principal steering station. Rudder angle indicators on the bridge and flying bridge (principal steering station) are off by more than 30 degrees. Repair both rudder angle indicators and demonstrate proper operation. 46 CFR 113.40-5

Vessel's crew may not use the aux AC generator installed in the #5 tween deck until plan review has been completed by MSC and all testing and inspections conducted to the satisfaction of the attending marine inspector.

Provide proof of current valid FCC Vessel Bridge to Bridge Radiotelephony Cert. as per 47 CFR 80.
