46 CFR 185.726 (e) Each battery without an expiration date indicated on it or for which the owner or managing operator does not have a record of the expiration date, used in an item of lifesaving equipment, must be replaced during the annual inspection. MI observed that all 05 float light batteries didn't have expiration date and had wrong battery as per manufacturer instructions. CODE 705: Vessel is restricted to daytime operations.

46 CFR 185.604(h) Each life jacket must be marked with Type I retroreflective material approved in 46 CFR 164.018 or other standard specified by the Commandant MI observed multiple adult size life jackets that need new Type I retroreflective material.

46 CFR 182.100 All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. MI observed both steering ram hose connections had small leaks.

46CFR176.500(b) Vessel must undergo an annual inspection as specified in paragraph (b)(1) of this section. Vessel must undergo an annual inspection within 3 months before or after the each anniversary date. Vessels anniversary date was 19SEP2024, and vessel is past 3 months from said date. Vessel shall not operate with passengers until an annual inspection has been complete.

46 CFR 182.200 (a) Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. O/O is replacing both main engines. Engines are being replaced in kind. Vessel must demonstrate operation of new main engines to the satisfaction of attending USCG Marine Inspector.

46 CFR 181.405(c); 705c Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Inspector observed missing fire detection system on top deck for passenger accommodations. Restricted to no overnight voyages until installed.

46 CFR 181.120(a); 16c Fire extinguishing equipment installed on a vessel in excess of the requirements of §§ 181.400 and 181.500 must be maintained in accordance with a recognized industry standard acceptable to the Commandant (CG-ENG-4). Inspector observed 01 extra fire extinguisher not serviced.

46 CFR 185.604(b); 16c Each ring life buoy must be marked in clearly legible block capital letters with the vessel's name. Inspector observed vessel's name not marked.

46 CFR 182.410 (d)1; 16c Double hose clamping is required where practicable. Inspector observed fuel service hoses in machinery spaces not attached with double hose clamps.

46 CFR 179.320(c); 16c The number of penetrations in a watertight bulkhead must be minimized. A penetration in a watertight bulkhead must be as high and as far inboard in the bulkhead as practicable, and made watertight. Inspector observed 02 penetrations in STBD void and within machinery spaces.

46 CFR 183.200(b); 16c Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Inspector observed exposed wires terminating without connections.

Propulsion machinery shall be suitable in type and design for propulsion requirements and capable of operating at constant marine load without exceeding its design limitations. MI observed a water leak on the port main engine where the exhaust header at turbo charger meets the exhaust piping (wet system). Repair by next planned drydock on 08JAN23. 46 CFR 182.05-1(a)

Auxiliary machinery shall be suitable in type and design for the purpose intended. MI observed damaged and missing exhaust pipe lagging for the port auxiliary generator. Repair by next planned drydock on 08JAN23. 46 CFR 182.10-1

Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Vessel shall install system to the satisfaction of attending USCG Marine Inspector. 46 CFR 181.405(c) - 50C

Flammable items not otherwise covered by the regulations of this subchapter, such as rechargeable batteries, including lithium ion batteries utilized for commercial purposes, must be handled, stored, and operated in a way that mitigates the risk of hazardous conditions. Vessel shall develop plan to the satisfaction of attending USCG Marine Inspector. 46 CFR 185.364 - 50C

Vessels described by 46 CFR 175.110(d) must submit plans to the cognizant OCMI, in accordance with 46 CFR 176.700, for the installation and use of monitoring device to ensure the wakefulness of the watchmen required in paragraph (a) of this section. Vessels with a keel laid date after March 28, 2022, must include plans for the monitoring device(s) within the plan submissions required in 46 CFR 177.202. The Coast Guard will work with the vessel operators to determine a reasonable implementation schedule once the plans are accepted. The monitoring device(s) must: (1) Ensure the wakefulness of the crew in the event that the watchman required in paragraph (a) of this section is unresponsive; (2) Remain operable during the nighttime watch; and (3) Be arranged to ensure proper coverage of the passenger accommodation spaces, common areas, and spaces with potential fire hazards. 46 CFR 185.410(b) - 50C

(d) Where rigid nonmetallic material (plastic) is permitted for use in piping systems by this section, the following restrictions apply: (ii) One or more metallic shutoff valves must be installed adjacent to the fitting in one of the following ways: (A) Only one metallic shutoff valve must be installed if it is operable from above the bulkhead deck; (B) If two metallic shutoff valves are installed, one on either side of the bulkhead, they need not be operable from above the bulkhead deck provided immediate access to both is possible; or (C) Where both plastic and metallic materials are used in piping that penetrates a bulkhead, and the two materials exist entirely on opposite sides of the bulkhead, a metallic shutoff valve must be installed at the bulkhead in the metallic part of the system, with the valve being capable of operation from above the bulkhead deck, or locally if immediate access is possible;MI observed no shutoff valves on either side of the through bulkhead fitting. 46 CFR 182.720 (d)(ii)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI. Vessel notified USCG Sector St. Petersburg that the vessel had a broken waterline in engine room causing flooding while outbound from John's Pass. The vessel shall make satisfactory repairs and contact USCG MI to attend the vessel. 46 CFR 176.700

The number and identification of the items stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets. Letters and numbers must be at least 50 millimeters (2 inches) high. Symbols must be at least 100 mm (4 inches) square. During inspection Life jacket storage did not have any labeling. 46 CFR 185.604(f)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. First-aid kit on board the vessel did not have a tourniquet. 46 CFR 184.710

All electrical installations shall be to the satisfaction of the Officer in Charge , Marine Inspection. During inspection multiple electrical wires had been pulled out of their holders or cable runs and were hanging low enough to become a hazard on the 2nd deck. 46 CFR 183.01-15

All vessels except non self propelled vessels shall be provided with a suitable steering apparatus. Helm wheel was not tight and had tape on nut holding it on. Helm was loose and wobbling during operation. 46 CFR 183.30-1(a)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without OCMI approval. Vessel master notified USCG Sector St. Pete after the vessel allegedly ran aground in the channel at John's Pass, St. Pete, FL on October 30, 2022. The vessel returned to the dock and the master stated that the starboard shaft was vibrating on the return trip. A diver confirmed that the starboard (4 blade) propeller was bent at a 90 degree angle on three of the four blades. The operator shall make satisfactory repairs or replace the propeller in kind and contact USCG MI to attend for a sea trial after repairs are complete. 46 CFR 176.700

The intent of this part is to insure that the scantlings, material, fastenings, workmanship and arrangements of each vessel are such as to provide for the safe operation in accordance with the terms of its Certificate of Inspection. Primary consideration shall be given to the provision of a seaworthy hull. The 1, 2 and 3 overhead longitudinal main deck support frames located inboard from the hatch in the forward starboard compartment were found fractured at the weld to the collision bulkhead. 46 CFR 177.01-5 (Old-T)

Suitable covers, guards, or rails shall be installed in way of all exposed and hazardous places such as gears, machinery, etc. The Starboard side generator is missing its belt guard. 46 CFR 177.35-15 (Old-T)

It is intended that all machinery be installed an maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. The wet exhaust on the Starboard side main engine has a leak on the inboard side. 46 CFR 182.01-5 (Old-T)

Each connection to a conductor or terminal part of a conductor must be made within an enclosure. The wiring to the air conditioning unit water pump has twist-on wire nuts to make the connection, and it is not inside of an enclosure. 46 CFR 183.340(g)

Identified fractured welds in the overhead stiffners located port side #1 forward space. Overhead stiffners located at the cross deck, stiffners #1, #2, #3; numbering of stiffners from outboard to inboard. Forward welds on stiffners fractured, aft welds appeared satisfactory. Operator to renew in kind. 46 CFR 176.700

Deck rails must be designed and constructed to withstand a point load of 91 kilograms (200 pounds) applied a any point in and direction. The starboard deck rail, above the engine room is cracked. Repair as original. 46 CFR 177.900(b)

Whenever damage or deterioration to hull plating g or structural members that may affect the seaworthiness of a vessel is discovered the cognizant OCMI may require the vessel to effect permanent repairs. The port generator exhaust is cracked where the pipes meets the hull. Repair as original. 46 CFR 176.600(b)

All cable and wire must: be installed with metal supports spaced not more than 610 millimeters (24 inches) apart, and in such a manner to avoid chafing and other damage. The hot water heater electrical supply wires were supported by other wires and not their own metal supports. 46 CFR 183.340(b)(4)

Vessel's port main engine experienced electric starter failure. Repair and prove proper operation in the presence of a USCG Marine Inspector. IAW: 46 CFR 182.200(a)

Piping used in a vital system must be composed of ferrous metal except when non-metallic piping material is permitted by 46 CFR 185.720(e). Found non metallic materials used in bilge piping system (flex hose). Make repairs to bilge piping as original or as required. 46 CFR 182.710(c)(1).

A vessel must be provided with a main steering gear that is of adequate strength and capable of steering the vessel at all service speeds. Make repairs and prove proper operation of steering gear. 46 CFR §182.610.

Replace 02 life floats in kind and reduce manning to 40 pax 4 crew iaw 46CFR180,10-5.

Repair/Replace port fuel shutoff iaw 46CFR182.20-4(3) prior to carrying passengers.
