The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. A report was received that D III was partially submerged in Road Town, Tortola. MI contacted vsl owner; Owner stated the rudder was removed in order to change props and the vessel took on water. A damage survey and written report shall be provided in writing by a qualified marine surveyor. The survey shall include a full assessment of the vessels structure, all equipment, and overall condition of seaworthiness. A root cause and analysis shall be provided in writing to MSU St. Thomas for review. A determination of casual factors shall be provided and all steps taken to safely recover the vessel. Owner shall provide a detailed and written repair plan and submit to Marine Safety Unit St. Thomas for review. Once the repair plan has been reviewed, a response will be provided to the owner prior to commencing repairs. All Repairs and/or alterations will need to be reviewed prior to commencing and will require Coast Guard oversight throughout process. All above mentioned requirements shall be met to the satisfaction of Marine Safety Unit St. Thomas prior to operating commercially in USVI waters. D III is required to conduct a USCG COI inspection prior to continuing operations in USVI waters. In addition, a drydock inspection may be required. 46 CFR 177.100

If your vessel is operated on international voyages..... it must undergo a drydock examination once every 12 months. D III did not conduct yearly drydock inspection as indicated on USCG COI. Coordinate with USCG for scheduling for drydock inspection and provide intentions for operating in USVI prior to carrying passengers in USVI. 46 CFR 176.600(b)

Main passenger cabin deck plating was not secured and provided open access to engine room which is protected with CO2. Multiple areas of the engine room allowed the passage of vapors. Provide repair plan for securing deck plating and making engine room vapor tight. Submit repair plan for approval prior conducting repairs. Make engine room vapor tight as original.

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child life jacket stowage was not seperate from adults. Stow child life jacket seperately and label prior to COI issuance. 46 CFR 180.78(a)(5)

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Stbd ER battery bank and wiring was found wasted; replace battery and install battery wiring as required prior to COI issuance. 46 CFR 183.200 (b)

All engines must be water cooled and meet the requirements of this paragraph.A suitable hull strainer must be installed in the circulating raw water intake line of an engine cooling water system. ME (port) raw water strainer housing was found without strainer, replace as required prior to COI issuance. 46 CFR 182.420 (a)(2) 46 CFR 182.100

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. Bother caps on raw water strainers were found with temp repairs and broken, replace as required 46 CFR 182.100

Boundaries that separate machinery spaces from accommodation spaces, service spaces, and control spaces must be lined with noncombustible panels or insulation approved in accordance with § 164.009 in subchapter Q of this chapter, or other standard specified by the Commandant. ER access hatch insulation was removed; replace as required 46 CFR 177.410(c)(4)

Shall be provided with individual bigle lines and suctions for each water tight compartment. Aft steering bilge system float switch was broken and ovbd discharge was not properly configured 46 CFR 182.25-5(a)

Shut off valve at the tank shall be operable from outside the tank compartment. Emergency Fuel COV was not operable and linkage was wasted, make COV operable and replace fasteners. Also secure pull handle closure box and label. 46 CFR 182.20-40(b)(3)

MI discovered daylight from multiple areas on main deck to aft steering. Make permanent repairs to deck plating. 46 CFR 177.100

All fuel tanks shall be electrically bonded to the common ground. Vsl rep did not know which fuel tank piping was for vent or fill. Electrical bonding was not installed; install bonding on fill side. 46 CFR 182.20-25(b)(4)

Filling and sounding pipes shall be so arranged that overflow of liquid or vapor cannot escape to the inside of the vessel. Wasted piping was discovered above fuel tank on fill/vent. Replace fuel tank piping in corroded sections. 46 CFR 182.20-30(b)

The general construction shall be such as to minimize fire hazarards. Seal bulkhead penetrations in ER protected with CO2 46 CFR 177.10-5(a)

All electrical installations shall be to the satisfaction of the OCMI, Marine Inspections. Electrical junction box in aft steering and ER was not sealed; seal as required 46 CFR 183.01-15

All watertight doors in subdivision bulkheads must be kept tightly closed during the navigation of the vessel except when being used for transit between compartments. Aft steering water tight hatch gasket is wasted; replace gasket 46 CFR 185.330(b)

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons who have fallen overboard. MOB drill: Effective communication was lacking, and boat hook was not on board. Crew was not competent with drill. Run drill again and demonstrate crew proficiency. 46 CFR 185.520(a)

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Covered employee list from 2022. Provide current covered employee list. 46 CFR 16.210

At each initial and subsequent inspection for certification and reinspection the marine inspector shall inspect all lifesaving equipment to determine its serviceability. Port and starboard liferaft cradle lashing pelican hooks found loose and unsecured. Properly secure liferafts to the cradles in accordance with manufacturers instructions.

At each initial and subsequent inspection for certification the marine inspector shall examine and test the following items to the extent necessary to determine that they are in proper operating condition, safe electrical condition, and fit for the service for which they are intended. Electrical wiring and steering hoses below operating station covered in hydraulic fluid. Clean all affected wires, cables, and hoses for USCG reinspection.

Bilge and drainage systems. The means provided for pumping bilges shall be tested by operation. Attending MI's were unable to test bilge suction in after steering due to oily bilge conditions. Also did not function correctly in FWD lower compartment.46CFR176.25-1 (b)(7)

The fire pump shall be tested and the fire hose shall be subjected to the available fire pump pressure. The fire pump was inoperable during USCG Inspection.46CFR176.25-25

Re-inspection conducted of lifesaving equipment shall be made as deemed necessary by the Officer in Charge of marine inspection. Attending MI's noted that the IBA's listed on vessels BVI and USCG COI's have been replaced by life floats.46CFR176.25-22

At each inspection for certification and re inspection the marine inspector shall examine the bilges and other spaces to see that there is no accumulation of oil or other matter which might create a fire hazard. Attending MI's noted excessive oil in the engine room and steering compartment bilges. 46CFR176.25-50(b)

Electrical equipment shall be reasonably safe from electrical shock of personal. The breaker panel which contains the fire pump breaker has loose and missing a cover. 46CFR183.01-5

Fire hose length shall be not less than 25 feet and not more than 50 feet. Attending MI’s noted that he fire hoses on board were 100 feet in length which will reduce their effectiveness in an emergency. 46CFR181.15-10 (b)

Fuel systems installed shall be checked and tested by operation locally and at remote locations. Attending MI's noted that the fuel shut off valve was inaccessible and not conducive to easy rapid closing of the fuel.46CFR176.25(5)

Flexible or portable cords such as SO, STO and similar types cannot be used for permanently installed wiring. Attending MI's noted a wired plug over the sink. 46CFR183.10-10(c)(2)

Suitable covers, guards or rails shall be installed in a way of all exposed and hazardous places such as gears and machinery. The installed generator guard is insufficient to protect crew.46CFR177.35-15

Deck Rails shall be installed near the periphery of all weather decks accessible to passengers and crew. Attending MI's noted that the after most port handrail was loose and easily pushed out with minimal force. 46CFR177.35(a)

Battery connections shall be made to the battery terminals with permanent type connections. Spring clips or other temporary type clams are not permitted. Attending MI's noted that numerous battery terminals of the temporary type. 46CFR183.05-20(c)

All wires shall terminate in a junction box. MI's noted open wires top of open deck, lower forward compartment and in the engine room. All dead ended or unused wires shall be terminated in a junction box. 46CFR183.10-20 46CFR183.10-20

Piping, including valves, pipe fittings and flanges, conveying vapor, gas or liquid the temperature of which exceeds 150F, must be suitably insulated where necessary to prevent injuries. Attending MI's noted that the exhaust manifold expansion joints before the water inlet were uninsulated. 46CFR177-970, 46CFR182.20-20

Vessel shall be inspected for compliance with standards required by this sub chapter. Jacket water piping for both main engines is being held in place with plastic wire ties as opposed to permeate pipe hangers. 46CFR176.25

Escape hatch located under operating station console blocked by storage items. Remove all storage items blocking hatch. 46 CFR 185.310-15

All electrical cables and wiring in the engine room are suspended by plastic zip ties. Wiring and cables must be suspended by metal supports not more than 24” apart in a manner to avoid chaffing. 46 CFR 183.340(b)(4)

The owner or managing operator shall make a vessel available for drydock examinations, internal structural examinations, and underwater surveys (UWILD) required by this section. If your vessel is operated on international voyages subject to SOLAS requirements, it must undergo a drydock examination once every 12 months unless it has been approved to undergo an underwater survey (UWILD) per § 176.615 of this part. Operator failed to complete required drydock by inspection date listed on COI of 31July2022.

Provide proof of DAPI compliance of a chemical testing program for the crew and current enrollment list.

Post Stability Letter and COI outside the operating station where passengers can view them.
