The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew.
A report was received that D III was partially submerged in Road Town, Tortola. MI contacted vsl owner; Owner stated the rudder was removed in order to change props and the vessel took on water.
A damage survey and written report shall be provided in writing by a qualified marine surveyor. The survey shall include a full assessment of the vessels structure, all equipment, and overall condition of seaworthiness.
A root cause and analysis shall be provided in writing to MSU St. Thomas for review. A determination of casual factors shall be provided and all steps taken to safely recover the vessel.
Owner shall provide a detailed and written repair plan and submit to Marine Safety Unit St. Thomas for review. Once the repair plan has been reviewed, a response will be provided to the owner prior to commencing repairs.
All Repairs and/or alterations will need to be reviewed prior to commencing and will require Coast Guard oversight throughout process.
All above mentioned requirements shall be met to the satisfaction of Marine Safety Unit St. Thomas prior to operating commercially in USVI waters. D III is required to conduct a USCG COI inspection prior to continuing operations in USVI waters. In addition, a drydock inspection may be required. 46 CFR 177.100
