a pre-engineered fixed gas fire extinguishing system must: (1) Be approved by the Commandant; (3) Automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space; and (4) Be installed in accordance with the manufacturer's instructions. Pre-engineered system did not operate according to approved design. Shutdown of main propulsion engine was significantly delayed. Main propulsion engine was able to restart without using override switch after system was activated. 46 CFR 181.400(a)

All passenger accommodations must be arranged and equipped to provide for the safety of the passengers in consideration of the route, modes of operation, and speed of the vessel. Standing rigging cotter pins are protruding at deck level in passenger area and pose a safety risk to passengers onboard. 46 CFR 177.800(a)

Each item of survival craft equipment must be of good quality, and efficient for the purpose it is intended to serve. Inflatable liferaft could not be verified as matching sales receipt due to labeling on storage case being worn away. Liferaft must be confirmed as serviceable and storage case relabeled by a certified survival craft servicing company. Lifefloat is showing signs of sun damage / degrading of materials. Vessel limited to operating no more than 1 mile from shore. 46 CFR 180.175(a)

The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility must perform the required inspections, maintenance procedures, and hydrostatic pressure tests. A tag issued by a qualified servicing organization, and attached to each extinguisher, may be accepted as evidence that the necessary maintenance procedures have been conducted. Portable fire extinguishers did not have monthly inpsection records.

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances, including the following: 3) Inspection of the condition of the superstructure, masts, and similar arrangements constructed on the hull, and on a sailing vessel all spars, standing rigging, running rigging, blocks, fittings, and sails. Main sail has tear in leach.

Electrical equipment and installations must be suitable for the roll, pitch, and vibration of the vessel underway. Receptacle in galley was not secured. 46 CFR 183.220

Alcohol-testing devices must be used according to the procedures specified by the manufacturer of the testing deice and by this part. Alcohol test strips were expired. 46 CFR 4.06-3(a)(2)

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. Bracket on #1 fire extinguisher is damaged.

Each floating waterlight installed after March 11, 1997, on a vessel carrying only one ring buoy, must be attached to the lanyard with a corrosion-resistant clip. The clip must have a strength of at least 22.7 kilograms (50 pounds), and allow the waterlight to be quickly disconnected from the ring life buoy. Waterlight did not have a clip. 46CFR 180.70(d)(3)

Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. Vessel did not have record of monthly testing.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. 46 CFR 185.510(a)

A pre-engineered fixed gas fire extinguishing system must: automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space. Vessel’s main engine did not shut down upon simulated activation of the pre-engineered fixed gas fire extinguishing system. Vessel is restricted to prior to passengers until rectified. 46CFR181.420(a)(3)

Except as otherwise noted, medical certificates will be issued for the following periods of time: Medical certificates issued to all other mariners will be issued for a maximum period of 5 years. Master’s medical card was found expired. 46CFR10.301(b)(2)

At each initial and subsequent inspection for certification, the marine inspector may require that an abandon ship or man overboard drill be held under simulated emergency conditions specified by the inspector. 46CFR176.808(g)

At each initial and subsequent inspection for certification, the marine inspector may require that a fire drill be held under simulated emergency conditions to be specified by the inspector. 46CFR176.810(d)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. Vessel is using temporary lines for staysail, 02 spinnakers and fishermansail. Vessel must operate IAW CG approved sail plan prior to operating under sail. 46CFR176.700(a)

The design, materials, and construction of masts, posts, yards, booms, bowsprits, and standing rigging on a sailing vessel must be suitable for the intended service. MI found vessel is not completing maintenance/examinations IAW their preventative maintenance plan. Provide required maintenance prior to operating under sail. 46CFR177.330

A vessel on a coastwise route must carry six hand red flare distress signals approved in accordance with 160.021 in subchapter Q of this chapter and six hand orange smoke distress signals approved in accordance with 160.037 in subchapter Q of this chapter. Vessel did not have correct amount of flares for route on COI. Vessel is restricted to operating on L/B/S route identified on COI. 46CFR180.68(a)

A vessel must carry one floating waterlight, unless it is limited to daytime operation, in which case no floating waterlight is required. Each floating waterlight must be approved in accordance with 161.010 in subchapter Q of this chapter. Vessel has unapproved battery for floating waterlight and is restricted to daylight/high visibility operations only. 46CFR180.70(d)(1)

The equipment required for lifefloats must meet the following specifications: The light must be a floating waterlight approved under approval series 161.010. The floating waterlight must be attached around the body of the life float by a 3/8” lanyard, resistant to deterioration from ultraviolet light, and at least 18’ in length. Found the floating waterlight for the lifefloat had unapproved battery and was not properly attached around the body of the life float. Vessel is restricted to daylight/high visability operations only. 46CFR180.175(f)(4)

The name of the vessel must be marked or painted in clearly legible letters on each life float paddle. 02 paddles were found on the life float without vessel’s name marked. 46CFR185.604(g)

The equipment required for lifefloats and buoyant apparatus must meet the following specifications: Each paddle must be of at least 4 feet in length, lashed to the life float to which it belongs and buoyant. 46CFR180.175(f)(2)

The number and identification of the items stowed inside, and their sizes must be marked in clearly legible letters and numbers on each container for life jackets. Found multiple containers without identification and or number of PFDs stowed. 46CFR185.604(f)

When operating a vessel on a body of water where the discharge of treated or untreated sewage is prohibited by the EPA, the operator must secure each Type I and II device in a manner which prevents discharge of treated or untreated sewage. Acceptable methods of securing the device include, closing the seacock and removing the handle, padlocking the seacock in the closed position, using a non-releasable wire tire to hold the seacock in the closed position, or locking the door to the space enclosing the toilets with a padlock or door handle key lock. Vessel’s MSD overboard valve was not properly secured 33CFR159.7

Each portable fire extinguisher on a vessel must be of an approved type. MI found stern operating station portable fire extinguisher bracket broken and unable to secure the extinguisher. 46CFR181.500(a)

Each portable extinguisher must be inspected and maintained in accordance with NFPA 10 as amended her: certification or licensing by a state or local jurisdiction as a fire extinguishing servicing agency will be accepted by the USCG for annual maintenance and recharging of extinguishers. Annual servicing report did not include aft operating station portable fire extinguisher. 46CFR176.810(b)(1)(i)

In systems and applications where flexible hoses are permitted to be clamped: two clamps must be used on each end of the hose, or one hose clamp can be used if the pipe ends are expanded or beaded to provide a positive stop against hose slippage. Bilge pump raw water return end missing double clamps on aft end of flexible hose. 46CFR182.410(d)(4)

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable or operating at constant marine load under such requirements without exceeding its designed limitations. Found leak in M/E raw water 46CFR182.200

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: charts of large enough scale to make safe navigation possible. 46CFR184.420(a)(1)

The name of the vessel must be marked or painted in clearly legible letters on each EPIRB. Vessel’s EPIRB was not marked with vessels name. 46CFR185.604(c)

Each ladder used as a means of escape must be mounted at least 180 millimeters (7 inches) from the nearest permanent object in back of the ladder. Rungs must be:(1) At least 405 millimeters (16 inches) in width; and(2) Not more than 305 millimeters (12 inches) apart, and uniformly spaced for the length of the ladder with at least 114 millimeters (4.5 inches) clearance above each rung. The vertical ladder constituting the forward escape from the accommodation space does not have 7 inches clearance from the nearest permanent object in the back of the ladder, is narrower than 16 inches, and does not have 4.5 inches clearance above each rung. Rectify prior to carriage of passengers. 46 CFR 177.500(k), 701c

All cable and wire must: Be installed with metal supports spaced not more than 610 millimeters (24 inches) apart, and in such a manner as to avoid chafing and other damage. The use of plastic tie wraps must be limited to bundling or retention of multiple cable installations, and not used as a means of support. Wires in steering room were mounted with plastic tie wraps as a means on support. 46 CFR 183.340(b)(4)

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. Wash down spigot in engine room needs to be capped. 46 CFR 176.830(a)

Machinery and fuel tank spaces must be separated from accommodation spaces by boundaries that prevent the passage of vapors. The aft engine room penetrations were not sealed to prevent engine vapors or fire fighting system from leaking into accommodations space. 46 CFR 177.405(c)

A pre-engineered fixed gas fire extinguishing system must automatically shut down all engines that draw intake air from within the protected space. Demonstrate that the re-engineered fixed gas fire extinguishing system shutdowns the main engine upon simulated activation prior to carrying passengers.

Provide 03 additional hand red flare distress signals approved under 46 CFR 160.021 for a total of 06 on board prior to carrying passengers.

Mount or secure the watchmen monitoring devices to prevent them from being removed from their current locations.

Prove proper operation of machinery space shutdowns upon activation of pre-engineered fixed gas fire extinguishing system (Fireboy) prior to carrying passengers.

Provide invoice for electrical work completed.

Remove dead-end wiring or properly secure exposed ends in a suitable enclosure.

Install metal supports with chafing protection at intervals not exceeding 24 inches on all cable/wire runs.

Replace deteriorated grab lines on the ring life buoy and properly mark buoy with the vessel's name.

Provide two additional fire buckets with 2.5 gallon capacity, tie with a lanyard long enough to reach the water's surface, and mark "FIRE BUCKET".

Maintain rigging maintenance and inspection log in accordance with vessel's Rigging Preventative Maintenance Plan.

Provide proof that all crewmembers employed in a safety sensitive position are enrolled in a random drug testing program.

Provide and document drug and alcohol use training for all crewmembers as part of the company's required Employee Assistance Program.

Post a passenger safety bill in each cabin and passenger accommodation space with the following information: 1) The embarkation station and the number and location of the survival craft to which each passenger is assigned, if applicable; 2) The fire and emergency signal and the abandon ship signal; and 3) Essential action that must be taken in an emergency.

Inflatable liferaft was not present onboard, operations limited to within three miles of shore until properly installed.

Oil pressure gauge was not functional.

Life jacket stowage was not labeled with contents and number.

Ring life buoy was not marked with vessel name. Corrected on the spot.

Wastage around port lights in the main cabin. Port covers are within 6” of the main deck. Crop to good steel and renew.

Provide installation dates for all rigging components listed in Appendix (1) to Enclosure (1) of NVIC 02-16.

Make available a Rigging Preventative Maintenance Program that provides a level of detail commensurate with Appendix (2) to Enclosure (1) of NVIC 02-16 (Rigging Inventory/Preventative Maintenance Inspection Template (Sample)) or propose a mutually acceptable third party to survey the rigging and provide a report with a level of detailed commensurate with either Appendix (3) or (4) to Enclosure (1) of NVIC 02-16 (Third Party Rigging Survey Samples A&B).

Make toggles available for inspection for attending Marine Inspector (STBD lower aft shroud, Port forward middle shroud)

Replace aft port deck drain hose, hose was wasted.

Mount EPIRB in a float free location, currently EPIRB is mound at operating station that is covered by a fixed bimini top.

Pre-engineered fixed gas fire extinguishing system must be capable of automatically shutting down all powered ventilation, electric blower is installed in Laz space that draws intake from engine room. Demonstrate shut down or terminate powered ventilation.

Vessel lost propulsion while underway causing vessel to run aground. Conduct sea trail with Marine Inspector prior to carriage of passengers.

A hole was identified on the pipeline for the bilge system. Provide plan for the repair/replacement/removal of the pipe located off the #8 valve just aft of the fire pump to local OCMI Marine Inspectors prior to credit dry dock.

Unable to access the internal structure of the vessel under the AC. Where the internal framing, plating, or planking of the vessel is concealed, sections of the lining, ceiling or insulation may be removed or the parts otherwise probed or exposed so that the inspector may be satisfied as to the condition of the hull structure. Provide access to internal structure on the starboard side just forward of the head under the AC system for re-inspection by local CG Marine Inspector.

Gate valves in engine room were unable to be exercised. All valves shall be opened for examination. Operate engine room gate valves in the presence of Coast Guard Marine Inspector.

Vessel will be on an increased dry dock schedule due to increased scaling rust. Next dry dock will be completed no later than October 22, 2020 that will also require a means to determine the current hull thickness (for example:UT Shots).

Each berth must measure atleast 74 inches, by 24 inches and have at least 24 inches clear space above. Multiple berths are less than the required 24inches wide. Numerous canvas bunks prohibit the required 24 inch vertical space. Additionally, all aisles alongside bunks shall be not less than 24 inches in width. After joining two or more aisles, the width of the aisles leading to an escape shall be not less than 42 inches wide. Bunk space in galley requires adjacent aisle and thus creating 2 isles, main isle is not 42 inches wide Provide a written plan to the OCMI on how the vessel will achieve compliance or equivalent level of safety with these required standards within 30 days (03NOV2019).

Each berth shall be constructed of wood, fiber reinforced plastic, or metal. Five berths of a cot/hammock design are throughout the vessel, berths are not of a rigid construction. Provide plans for berths that meets the above mentioned characteristics.

Remove "Triple Berth" in galley, berthing arrangement is a safety concern for egress and does not meet berth space requirements.

When a deck scuttle serves as a means of escape, it must be fitted with a hold back device to hold the scuttle in position. None of the emergency escapes have hold back devices. Provide hold back devices for the emergency escapes.

When a deck scuttle serves as a means of escape, it must be capable of being opened by one person from either side. Both escape hatches were difficult to slide open when tested. Demonstrate hatches can easily be opened by one person in the presence of attending MI.

Aft escape hatch sliding hatch design provides a potential for something to be placed in the path of the hatch that would restrict its opening. Provide a plan to address OCMI safety concern.

Waste receptacles must be constructed of non-combustible materials. Trash cans in heads are made of plastic. Provide non combustible waste receptacles any time they are used below the main deck.

Each ladder used as a means of escape must be mounted at least 7 inches from the nearest permanent object in back of the ladder.

Means of escape must be adequately marked both inside and out. Escape hatches are not adequately marked. Ensure that hatches are marked with two inch lettering "Emergency Escape, Keep Clear"

On a vessel of more than 24 hours duration, passengers shall don life jackets and and go to the appropriate embarkation station. Ensure that emergency escape drills are conducted each time overnight passengers are embarked to ensure their understanding of emergency escape routes. These drills should be logged in the ship's log.

Each vessel shall have a suitable number of watchmen to ensure that patrols are conducted during night time, whether or not the vessel is underway, to guard against, and give alarm in case of , a fire, man overboard, or other dangerous situation. For these watchmen, provide a list of areas/ procedures to use while on watch. Additionally, provide an entry in the log for watch relief.

Provide documentation for mattresses onboard that comply with either The U.S. Department of Commerce "Standard for Mattress Flammability" (FF 4-72.16) and do not contain polyurethane foam, or IMO Resolution A.688(17) and mattresses tested to that standard may contain polyurethane foam.

Repairs for a steel hull must be at a minimum 18" by 18" area and span at least 1 frame. Corners shall be radius or use relief cuts at a minimum 6". Fit-up shall have no more than a 1/8" root gap and beveled at 60 degrees.

Provide means to close forward engine room vent, engine room is protected by a fixed fire extinguishing system. Closure device must be readily available and mounted in the vicinity of vent.

Service A-I portable fire extinguisher or provide receipt from servicing facility.

Vsl is broadcasting greater than expected LOA.

All crew members were not listed on company drug testing policy as required.

Vessel did not have visual indicators for automatic bilge pumps

Provide each overnight accommodation space with an independent modular smoke detector and alarm unit. (forward compartment, galley).
