While a ship is operating within an emission control area, the sulphur content of fuel oil used on board that ship shall not exceed 0.10% m/m.
On December 15, 2022, the permit titled “USCG and EPA APPS and MARPOL ANNEX VI Regulation 3 Permit Terms and Conditions to Support the Exemption from MARPOL ANNEX VI Regulations 14.4” for the HORIZON SPIRIT (IMO 7729459) allowing the vessel to operate in the ECA using 0.5% sulfur fuel expired. At the time of expiration, the vessel had a pending extension request into Coast Guard CVC and EPA. While this extension request is being reviewed by Coast Guard CVC and EPA, the vessel may operate under the terms of the aforementioned expired permit. This authorization to operate ceases once Coast Guard CVC and EPA has officially responded, either approving or denying the extension request. 73/78 MARPOL Annex VI, Reg 14.4.4
